GENERAL PROVISIONS

NRS 385.005 Declarationof legislative intent; policies of integration or desegregation of publicschools; recommendations to Legislature for equality of educationalopportunity.

1. The Legislature reaffirms its intent that publiceducation in the State of Nevada is essentially a matter for local control bylocal school districts. The provisions of this title are intended to reserve tothe boards of trustees of local school districts within this state such rightsand powers as are necessary to maintain control of the education of thechildren within their respective districts. These rights and powers may only belimited by other specific provisions of law.

2. The responsibility of establishing a statewidepolicy of integration or desegregation of public schools is reserved to theLegislature. The responsibility for establishing a local policy of integrationor desegregation of public schools consistent with the statewide policyestablished by the Legislature is delegated to the respective boards oftrustees of local school districts and to the governing body of each charterschool.

3. The State Board shall, and each board of trusteesof a local school district, the governing body of each charter school and anyother school officer may, advise the Legislature at each regular session of anyrecommended legislative action to ensure high standards of equality ofeducational opportunity for all children in the State of Nevada.

NRS 385.007 Definitions. As used in this title, unless the context otherwiserequires:

1. Charter school means a public school that isformed pursuant to the provisions of NRS386.500 to 386.610, inclusive.

2. Department means the Department of Education.

3. Homeschooled child means a child who receivesinstruction at home and who is exempt from compulsory attendance pursuant to NRS 392.070.

4. Limited English proficient has the meaningascribed to it in 20 U.S.C. 7801(25).

5. Public schools means all kindergartens andelementary schools, junior high schools and middle schools, high schools,charter schools and any other schools, classes and educational programs whichreceive their support through public taxation and, except for charter schools,whose textbooks and courses of study are under the control of the State Board.

6. State Board means the State Board of Education.

7. University school for profoundly gifted pupilshas the meaning ascribed to it in NRS392A.040.

DEPARTMENT OF EDUCATION

NRS 385.010 Creation;composition; executive head.

1. A Department of Education is hereby created.

2. The Department consists of the State Board ofEducation, the State Board for Career and Technical Education and theSuperintendent of Public Instruction.

3. The Superintendent of Public Instruction is theexecutive head of the Department.

NRS 385.014 Opinionsof Attorney General. When required, theAttorney General shall give his opinion in writing and without fee to the StateBoard, the Superintendent of Public Instruction and the Commission onProfessional Standards in Education on matters relating to the powers andduties of the Department.

STATE BOARD OF EDUCATION

NRS 385.017 Definitions. As used in NRS 385.017to 385.0265, inclusive, unless thecontext otherwise requires:

1. Block means the smallest geographical unit whoseboundaries were designated by the Bureau of the Census of the United StatesDepartment of Commerce in its topographically integrated geographic encodingand referencing system.

2. Block group means a combination of blocks whosenumbers begin with the same digit.

3. Census tract means a combination of block groups.

4. Census voting district means the voting district:

(a) Based on the geographic and population databasescompiled by the Bureau of the Census of the United States Department of Commerceas validated and incorporated into the geographic information system by theLegislative Counsel Bureau for use by the Nevada Legislature; and

(b) Designated in the maps filed with the Office of theSecretary of State pursuant to NRS 385.0175.

NRS 385.0175 Mapsof districts: Duties of Director of Legislative Counsel Bureau. The Director of the Legislative Counsel Bureau shall:

1. Retain in an office of the Legislative CounselBureau, copies of maps of the districts described in NRS 385.0225 to 385.0265, inclusive.

2. Make available copies of the maps to any interestedperson for a reasonable fee, not to exceed the actual costs of producing copiesof the maps.

3. File a copy of the maps with the Secretary ofState.

NRS 385.018 Mapsof districts: Duties of Secretary of State. TheSecretary of State shall:

1. Provide to the clerk of each county and the Clerkof Carson City, copies of the maps filed pursuant to NRS 385.0175.

2. Make available copies of the maps to any interestedperson for a reasonable fee, not to exceed the actual costs of producing copiesof the maps.

NRS 385.019 Attachmentof omitted area to appropriate district.

1. If any area of this state is omitted from theprovisions of NRS 385.017 to 385.0265, inclusive, the county clerk, theCarson City Clerk or the Director of the Legislative Counsel Bureau, upondiscovery of the omission, shall notify the Secretary of State of the omission.The Secretary of State shall attach that area to the appropriate district asfollows:

(a) If the area is surrounded by a district, it must beattached to that district.

(b) If the area is contiguous to two or more districts,it must be attached to the district that has the least population.

2. Any attachments made pursuant to the provisions ofthis section must be certified in writing and filed with the Director of theLegislative Counsel Bureau and with the Secretary of State. No change may bemade in any attachments until the districts are again reapportioned.

NRS 385.021 Composition;election of members; vacancies; limit on number of terms of members.

1. The State Board consists of 10 members elected bythe registered voters within the districts described in NRS 385.0225 to 385.0265, inclusive.

2. Each member of the State Board must be a residentof the district from which that member is elected.

3. At the general election in 2002, and every 4 yearsthereafter, one member of the State Board must be elected for a term of 4 yearsfrom Districts Numbers 2, 5, 6 and 10.

4. At the general election in 2004, and every 4 yearsthereafter, one member of the State Board must be elected for a term of 4 yearsfrom Districts Numbers 1, 3, 4, 7, 8 and 9.

5. If a vacancy occurs on the State Board, theGovernor shall appoint a member to fill the vacancy until the next generalelection, at which election a member must be chosen for the balance of theunexpired term. The appointee must be a resident of the district where thevacancy occurs.

6. No member of the State Board may be elected to theoffice more than three times.

1. At its first meeting after each election andqualification of newly elected members, the State Board of Education shallorganize by electing one of its members as President, to serve at the pleasureof the Board.

NRS 385.040 Meetingsand quorum.

1. The State Board of Education may hold at least fourregular meetings annually at the state capital. The Secretary shall call allregular meetings.

2. The Board may hold special meetings at such othertimes and places as the Board may direct. The Secretary shall call specialmeetings upon the written request of the President or any three members of theBoard.

3. A majority of the Board constitutes a quorum forthe transaction of business, and no action of the Board is valid unless thataction receives, at a legally called meeting, the approval of a majority of allboard members.

NRS 385.050 Compensationof members; claims.

1. Each member of the State Board of Education isentitled to receive compensation of not more than $80 per day, as fixed by theBoard, for attending each meeting of the Board, not to exceed 12 meetings inany calendar year.

2. While engaged in the business of the State Board,each member and employee of the State Board is entitled to receive the per diemallowance and travel expenses provided for state officers and employeesgenerally.

3. Claims for compensation and expenses must beapproved by the Superintendent of Public Instruction and the State Board ofExaminers, and must be paid from money provided by direct legislativeappropriation from the State General Fund as other claims against the State arepaid.

NRS 385.080 Regulations. The State Board may adopt regulations for its owngovernment and as necessary for the execution of the powers and duties conferredupon it by law.

NRS 385.091 Nonprofitcorporation for educational enhancement and recognition: Formation. The State Board, in the name and on behalf of the systemof public schools in this state, may:

1. Cause to be formed a nonprofit corporation pursuantto chapter 82 of NRS for the acquisition ofmoney and personal property for awards in recognition of exceptional teachers,pupils and public schools and for special projects regarding educationalenhancement, including, but not limited to, any unique educational activitywhich is conducted by officials of the public schools to improve theeducational performance of or learning opportunities for pupils or teachers inthe public schools.

2. Determine the name of the corporation.

3. Specify that the corporation is formed forcharitable and educational purposes, subject to the basic purpose of thecorporation as set forth in subsection 1.

4. Specify any incidental powers which the corporationmay exercise, including:

(a) The power to solicit and receive contributions,gifts, grants, devises and bequests of money and personal property, or anycombination thereof;

(b) Any of the powers enumerated in NRS 82.121 except that the corporation maynot receive or hold real property; and

(c) The power to do all acts as may be necessary,convenient or desirable to carry out the purposes for which the corporation isformed.

5. Provide for:

(a) The location and relocation of the office of thecorporation;

(b) Upon the dissolution of the corporation and theliquidation of its obligations, the distribution of its assets to the system ofpublic schools in this state;

(c) The perpetual existence of the corporation;

(d) The governing body of the corporation and theappointment and reappointment of members thereto; and

(e) The adoption of the bylaws for the corporation andany amendments thereto.

NRS 385.092 Nonprofitcorporation for educational enhancement and recognition: Nature.

1. The nonprofit corporation, upon its formation, is:

(a) A body corporate and politic; and

(b) A political subdivision of this state.

2. The activities of this corporation are herebydetermined to be public in nature.

NRS 385.093 Nonprofitcorporation for educational enhancement and recognition: Income not to inure toany person; exceptions. Any income of thenonprofit corporation may not inure to any member thereof or to any othernatural person or partnership or corporation, excluding any payment of theexpenses of the corporation for its operation and maintenance and any otherobligations based on contract or tort.

NRS 385.095 EducationGift Fund; restrictions on use of money in Fund. Exceptas otherwise provided in NRS 385.091:

1. All gifts of money which the State Board isauthorized to accept must be deposited in a special revenue fund in the StateTreasury designated as the Education Gift Fund.

2. The money available in the Education Gift Fund mustbe used only for the purpose specified by the donor, within the scope of theState Boards powers and duties, and no expenditure may be made until approvedby the Legislature in an authorized expenditure act or by the Interim FinanceCommittee if the Legislature is not in session.

3. If all or part of the money accepted by the StateBoard from a donor is not expended before the end of any fiscal year, theremaining balance of the amount donated must remain in the Education Gift Funduntil needed for the purpose specified by the donor.

NRS 385.100 Regulations:Conditions for acceptance of money, services, commodities or equipment forpublic schools from federal agencies; exceptions.

1. The State Board of Education shall prescriberegulations under which contracts, agreements or arrangements may be made withagencies of the Federal Government for money, services, commodities orequipment to be made available to the public schools, subject to thesupervision and control of the Superintendent of Public Instruction.

2. All contracts, agreements or arrangements made bypublic schools in the State of Nevada involving money, services, commodities orequipment which may be provided by agencies of the Federal Government, must beentered into in accordance with the regulations prescribed by the State Boardand in no other manner.

3. This section does not apply to any money receivedby any school district in the State of Nevada pursuant to the provisions of:

(a) An Act to provide financial assistance for localeducational agencies in areas affected by federal activities, and for otherpurposes, being Public Law 874-81st Congress; and

(b) An Act relating to the construction of schoolfacilities in areas affected by federal activities, and for other purposes,being Public Law 815-81st Congress,

as thesestatutes were enacted and may be amended.

NRS 385.102 HigherEducation Student Loan Program: Institution of higher education defined. As used in NRS 385.104,institution of higher education means an educational institution which:

1. Admits as regular students only persons havingreceived a certificate of graduation from high school, or the recognizedequivalent of such a certificate, or those approved by the Superintendent ofPublic Instruction for training at a vocational-technical level;

2. Is authorized to provide a program of educationbeyond high school;

3. Awards a bachelors degree or a 2-year degree orcertificate of graduation or a certificate of completion of a program beyondhigh school;

4. Is an institution with full approval of the Stateof Nevada or the United States Department of Education; and

5. Has recognized accreditation.

NRS 385.104 HigherEducation Student Loan Program: Establishment; use of money; policies andregulations of State Board.

1. The Higher Education Student Loan Program is herebyestablished.

2. Money available for the Higher Education StudentLoan Program must be used to provide loans to further the educational goals ofNevada residents who are admitted to and attending institutions of highereducation.

3. The State Board shall establish policies and mayadopt regulations for the administration of the Higher Education Student LoanProgram.

NRS 385.106 HigherEducation Student Loan Program: Administration; powers of State Board.

1. The Superintendent of Public Instruction mayadminister the Higher Education Student Loan Program and may consult with anypublic officer or private person in the State who may have an interest inhigher education or in the Program. The Superintendent of Public Instructionshall notify the State Board at least 30 days in advance if he intends to stopadministering the Program.

2. After receiving notice from the Superintendent ofPublic Instruction that he intends to stop administering the Program, butbefore he actually stops administering it, the State Board, with theconcurrence of the Governor, shall designate another public agency or privatenonprofit organization to administer the Program in a manner which ensurescontinued access to the Program by postsecondary schools in this State,including all of the institutions of the Nevada System of Higher Education. Thedesignation may authorize assumption of any reserves or liability accruing toan agency or organization engaged in administering the Program or the guaranteeof student loans.

3. If the Superintendent of Public Instructionadministers the Program, the State Board may:

(a) Negotiate and accept federal and other moneyappropriated and available to insure loans for student educational purposesunder the Program.

(b) Negotiate and enter into such agreements with otheragencies as it deems proper for the administration and conduct of the Program.

(c) Accept gifts, grants and contributions from anysource that will facilitate and assist the higher education of Nevadaresidents.

NRS 385.107 HigherEducation Student Loan Program: Higher Education Student Loan Fund. If the Superintendent of Public Instruction administersthe Higher Education Student Loan Program:

1. The money available for the Program must bedeposited in the State Treasury for credit to the Higher Education Student LoanFund which is hereby created as a special revenue fund.

2. Each expenditure from this Fund must be paid asother claims against the State are paid.

NRS 385.108 HigherEducation Student Loan Program: Withdrawals; records. Ifthe Superintendent of Public Instruction administers the Higher EducationStudent Loan Program, he shall:

1. Certify to the State Controller all withdrawals forpurposes of the Program. The State Controller shall then issue a warrant to theState Treasurer in the amount of the certification. The State Treasurer shalldisburse that amount in accordance with the warrant.

2. Use the money received for the Higher EducationStudent Loan Program for that Program.

3. Establish and maintain such records for the Programas are required by good accounting practices.

NRS 385.109 StateBoard to cooperate in plan for lunches for aged persons; regulations. The State Board shall:

1. Cooperate with the Aging Services Division of theDepartment of Health and Human Services in the planning of programs whereby theschool districts may prepare hot lunches for persons 60 years of age or olderand their spouses or any group of such persons by utilizing the systems andprocedures already developed for use in the operation of school lunch programs;and

2. Adopt regulations containing guidelines for boardsof trustees of school districts entering into such agreements.

NRS 385.110 StateBoard to prescribe and cause enforcement of courses of study for publicschools; exceptions.

1. Except as otherwise provided in subsections 2 and3, the State Board shall prescribe and cause to be enforced the courses ofstudy for the public schools of this state. The courses of study prescribed andenforced by the State Board must comply with the standards of content andperformance established by the Council to Establish Academic Standards forPublic Schools pursuant to NRS 389.520.

2. For those courses of study prescribed by the StateBoard:

(a) High schools may have modified courses of study,subject to the approval of the State Board; and

(b) Any high school offering courses normallyaccredited as being beyond the level of the 12th grade shall, before offeringsuch courses, have them approved by the State Board.

3. A charter school is not required to offer thecourses of study prescribed by the State Board except for those courses ofstudy which are required for promotion to the next grade or graduation fromhigh school.

NRS 385.115 StateBoard to cooperate in establishment of programs of information about missingchildren; regulations. The State Board shallcooperate with the Attorney General in the establishment in the schools,including, without limitation, charter schools, of programs of informationabout missing children and adopt regulations containing guidelines for suchprograms.

NRS 385.125 Standardplans, designs and specifications for construction of school buildings:Adoption; approval by State Public Works Board.

1. The State Board may adopt standard plans, designsand specifications for the construction of school buildings by the boards oftrustees of the various school districts. If such plans, designs andspecifications are adopted, provision must be made for the production anddistribution of such plans, designs and specifications by appropriate rules andregulations. The board of trustees of a school district may use any such plans,designs and specifications if it determines that the plans, designs andspecifications are in the best interests of the district.

2. Before the adoption of any such standard plans,designs and specifications, the State Board shall submit the plans, designs andspecifications to the State Public Works Board, whose written approval thereofmust be obtained before any further consideration by the State Board. The StatePublic Works Board shall verify that the plans, designs and specificationscomply with all applicable requirements of the Americans with Disabilities Actof 1990, 42 U.S.C. 12101 et seq., and the regulations adopted pursuantthereto, including, without limitation, the Americans with Disabilities ActAccessibility Guidelines for Buildings and Facilities set forth in Appendix Aof Part 36 of Title 28 of the Code of Federal Regulations. The requirements ofthis subsection are not satisfied if the plans, designs and specificationscomply solely with the Uniform Federal Accessibility Standards set forth inAppendix A of Part 101-19.6 of Title 41 of the Code of Federal Regulations.

3. The State Public Works Board may charge and collectand the State Board may pay a reasonable fee for the costs incurred by theState Public Works Board in approving the standard plans, designs andspecifications submitted.

SUPERINTENDENT OF PUBLIC INSTRUCTION

NRS 385.150 Appointment;term; removal; vacancy; classification.

1. The State Board shall appoint the Superintendent ofPublic Instruction for a term of 3 years. The State Board may remove theSuperintendent of Public Instruction from office for inefficiency, neglect ofduty, malfeasance in office or for other just cause.

2. A vacancy must be filled by the State Board for theremainder of the unexpired term.

3. The Superintendent of Public Instruction is in theunclassified service of the State.

2. Employ personnel for the positions approved by theState Board and necessary for the efficient operation of the Department.

3. Organize the Department in a manner which willassure efficient operation and service.

4. Maintain liaison and coordinate activities withother state agencies performing educational functions.

5. Perform such other duties as are prescribed by law.

NRS 385.180 Visitationof schools; consultations with educators. TheSuperintendent of Public Instruction or a staff member of the Department designatedby him shall:

1. Visit each county in the State at least once eachschool year, and shall conduct institutes, visit schools, consult with schoolofficers, or address public assemblies on subjects pertaining to the schools.

2. Consult and study with school officers andeducators of this and other states on topics of school administration, schoolmethods and school law.

NRS 385.190 Conferencesof teachers and administrators; expenses.

1. The Superintendent of Public Instruction or a staffmember designated by him shall:

(a) Convene teachers conferences in the varioussections of the State in such places and at such times as he deems advisable.

(b) Engage such conference lecturers and leaders as he deemsadvisable.

(c) Preside over and regulate the programs of allteachers conferences.

2. No teachers conference may continue more than 5days.

3. The Superintendent of Public Instruction or hisdesignated staff member shall convene, in such places and at such times as hemay designate, conferences of school administrators.

4. The expenses of holding teachers andadministrators conferences must be paid from the State Distributive SchoolAccount in the State General Fund, but the amount must not exceed $8,400 in anyone biennium. The State Controller shall draw his warrants for such expensesupon the order of the Superintendent of Public Instruction.

NRS 385.200 Regulations:Reports to Department; proceedings. TheSuperintendent of Public Instruction shall prescribe proper and necessaryregulations for making reports to the Department and for conducting allnecessary proceedings for which he is responsible.

NRS 385.210 Formof school register; dissemination of information regarding statutes andregulations relating to schools; memorandum to school districts and charterschools; preparation and publication of Department bulletin.

1. The Superintendent of Public Instruction shallprescribe a convenient form of school register for the purpose of securingaccurate returns from the teachers of public schools.

2. The Superintendent shall prepare pamphlet copies ofthe codified statutes relating to schools and shall transmit a copy to eachschool, school trustee and other school officer in this State. If the StateBoard adopts regulations to carry out these codified statutes or if additionsor amendments are made to these codified statutes, the Superintendent shallhave the regulations, additions or amendments printed and transmittedimmediately thereafter. Each pamphlet must be marked State propertyto beturned over to your successor in office. Each school shall maintain a copy ofthe pamphlet with any regulations, additions or amendments in the schoollibrary.

3. In addition to the requirements set forth insubsection 2, the Superintendent shall, to the extent practicable and not laterthan July 1 of each year, provide to the board of trustees of each schooldistrict and to the governing body of each charter school a memorandum thatincludes:

(a) A description of each statute newly enacted by theLegislature which affects the public schools in this State and the pupils whoare enrolled in the public schools in this State. The memorandum may compileall the statutes into one document.

(b) A description of each bill, or portion of a bill,newly enacted by the Legislature that appropriates or authorizes money forpublic schools or for employees of a school district or charter school, orboth, or otherwise affects the money that is available for public schools orfor employees of school districts or charter schools, or both, including,without limitation, each line item in a budget for such an appropriation or authorization.The memorandum may compile all bills, or portions of bills, as applicable, intoone document.

(c) If a statute or bill described in the memorandumrequires the State Board or the Department to take action to carry out thestatute or bill, a brief plan for carrying out that statute or bill.

(d) The date on which each statute and bill describedin the memorandum becomes effective and the date by which it must be carriedinto effect by a school district or public school, including, withoutlimitation, a charter school.

4. If a statute or bill described in subsection 3 isenacted during a special session of the Legislature that concludes after July1, the Superintendent shall prepare an addendum to the memorandum that includesthe information required by this section for each such statute or bill. Theaddendum must be provided to the board of trustees of each school district andthe governing body of each charter school not later than 30 days after thespecial session concludes.

5. The Superintendent shall, if directed by the StateBoard, prepare and publish a bulletin as the official publication of theDepartment.

NRS 385.250 Deliveryof property to successor. At the expiration ofhis term of office, the Superintendent of Public Instruction shall deliverimmediately to his successor in office all property and effects belonging tothe office, and he shall take a receipt for the same.

DEPUTY SUPERINTENDENTS, PROFESSIONAL STAFF AND OTHERPERSONNEL

NRS 385.290 DeputySuperintendent of Instructional, Research and Evaluative Services: Appointment;qualifications; powers and duties.

1. The Superintendent of Public Instruction mayappoint a Deputy Superintendent of Instructional, Research and Evaluative Serviceswho:

(a) Holds a masters degree in school administration ora related subject from an accredited college or university.

(b) Has a minimum of 3 years of administrativeexperience which includes:

(1) Supervision and evaluation of staff;

(2) Development and administration of budgets;and

(3) Development of curriculum.

2. The Deputy Superintendent of Instructional,Research and Evaluative Services may perform any duty required of theSuperintendent of Public Instruction during the absence of the Superintendentand shall do such work as the Superintendent may direct under the laws of theState.

NRS 385.300 DeputySuperintendent for Administrative and Fiscal Services: Qualifications andappointment.

1. The Superintendent of Public Instruction mayappoint a Deputy Superintendent for Administrative and Fiscal Services.

2. The Deputy Superintendent for Administrative andFiscal Services must:

(a) Be a graduate of a 4-year accredited college oruniversity.

(b) Have familiarity with the field of education, asevidenced by:

(1) Sufficient college credits in education toqualify for a license to teach in a high school in this state; or

(2) Participation in recognized educationalresearch and study.

(c) Have familiarity with the general field of publicadministration and budgeting, as evidenced by:

(1) Sufficient college credits to qualify for aminor in public administration, government management or business management;or

(2) Experience in the preparation of governmentalbudgets or in governmental accounting or research.

3. No person may be appointed to the position ofDeputy Superintendent for Administrative and Fiscal Services unless he has thequalifications outlined in subsection 2.

NRS 385.310 DeputySuperintendent for Administrative and Fiscal Services: Duties. The Deputy Superintendent for Administrative and FiscalServices, under the direction of the Superintendent of Public Instruction,shall:

1. Determine the apportionment of all state schoolmoney to schools of the State as prescribed by law.

2. Develop for public schools of the State a uniformsystem of budgeting and accounting. The system must provide for the separatereporting of expenditures for each:

(a) School district; and

(b) School within a school district.

Uponapproval of the State Board, the system is mandatory for all public schools inthis state and must be enforced as provided in subsection 2 of NRS 385.315.

3. Carry on a continuing study of school finance inthe State, particularly the method by which schools are financed on the statelevel, and make such recommendations to the Superintendent of PublicInstruction for submission to the State Board as he deems advisable.

4. Recommend to the Superintendent of PublicInstruction for submission to the State Board such changes in budgetary andfinancial procedures as his studies may show to be advisable.

5. Perform such other statistical and financial dutiespertaining to the administration and finances of the schools of the State asmay be required by the Superintendent of Public Instruction.

6. Prepare for the Superintendent of PublicInstruction the biennial budgets of the Department for consideration by theState Board and submission to the Governor.

NRS 385.315 DeputySuperintendent for Administrative and Fiscal Services: Additional duties. In addition to his other duties, the Deputy Superintendentfor Administrative and Fiscal Services, under the direction of theSuperintendent of Public Instruction, shall:

1. Investigate any claim against any school fund orseparate account established under NRS354.603 whenever a written protest against the drawing of a warrant, checkor order in payment of the claim is filed with the county auditor. If, upon investigation,the Deputy Superintendent finds that any such claim is unearned, illegal orunreasonably excessive, he shall notify the county auditor and the clerk of theboard of trustees who drew the order for the claim, stating the reasons inwriting why the order is unearned, illegal or excessive. If so notified, thecounty auditor shall not draw his warrant in payment of the claim nor shall theboard of trustees draw a check or order in payment of the claim from a separateaccount established under NRS 354.603.If the Deputy Superintendent finds that any protested claim is legal andactually due the claimant, he shall authorize the county auditor or the boardof trustees to draw his warrant or its check or order on an account establishedunder NRS 354.603 for the claim, and thecounty auditor or the board of trustees shall immediately draw his warrant orits check or order in payment of the claim.

2. Inspect the record books and accounts of boards oftrustees, and enforce the uniform method of keeping the financial records andaccounts of school districts.

3. Inspect the school fund accounts of the countyauditors of the several counties, and report the condition of the funds of anyschool district to the board of trustees thereof.

4. Inspect the separate accounts established by boardsof trustees under NRS 354.603, andreport the condition of the accounts to the respective boards of countycommissioners and county treasurers.

1. Are in the unclassified service of the State.

2. Except as otherwise provided in NRS 284.143, shall each devote his entiretime and attention to the business of his office and shall not pursue any otherbusiness or occupation or hold any other office of profit.

NRS 385.345 Coordinatorof the Use of Libraries and Related Technical Systems: Appointment; duties.

1. The position of Coordinator of the Use of Librariesand Related Technical Systems is hereby created. The Superintendent of PublicInstruction may:

(a) Assign the duties of the Coordinator to an employeeof the Department of Education; or

(b) Appoint a Coordinator.

2. The Coordinator of the Use of Libraries and RelatedTechnical Systems shall:

(a) Coordinate the use of public libraries by localschool districts;

(b) Coordinate services offered by the libraries ineach school district;

(c) Advise school districts on the proper use andmanagement of libraries in the school districts and the services offered bythose libraries;

(d) In conjunction with the State Library and Archives,coordinate the loan of materials and supplies between libraries;

(e) Offer libraries assistance in the automation oftheir access to and use of technical materials;

(f) Develop a library of audiovisual software andsoftware for computers for the use of school libraries; and

(g) Offer technical expertise to school librariesregarding such subjects as the new methods of gathering and retaininginformation.

Annual Reports and Summaries of AccountabilityInformation; Plans to Improve the Achievement of Pupils; Duties of LegislativeBureau of Educational Accountability and Program Evaluation

NRS 385.3469 Contentsof annual report of accountability for State Board; public dissemination ofreport; notice of availability on Internet.

1. The State Board shall prepare an annual report ofaccountability that includes, without limitation:

(a) Information on the achievement of all pupils basedupon the results of the examinations administered pursuant to NRS 389.015 and 389.550, reported for each school district,including, without limitation, each charter school in the district, and forthis State as a whole.

(b) Except as otherwise provided in subsection 2, pupilachievement, reported separately by gender and reported separately for thefollowing subgroups of pupils:

(1) Pupils who are economically disadvantaged,as defined by the State Board;

(2) Pupils from major racial and ethnic groups,as defined by the State Board;

(3) Pupils with disabilities;

(4) Pupils who are limited English proficient;and

(5) Pupils who are migratory children, asdefined by the State Board.

(c) A comparison of the achievement of pupils in eachsubgroup identified in paragraph (b) of subsection 1 of NRS 385.361 with the annual measurableobjectives of the State Board.

(d) The percentage of all pupils who were not tested,reported for each school district, including, without limitation, each charterschool in the district, and for this State as a whole.

(e) Except as otherwise provided in subsection 2, thepercentage of pupils who were not tested, reported separately by gender andreported separately for the subgroups identified in paragraph (b).

(f) The most recent 3-year trend in the achievement ofpupils in each subject area tested and each grade level tested pursuant to NRS 389.015 and 389.550, reported for each school district,including, without limitation, each charter school in the district, and forthis State as a whole, which may include information regarding the trend in theachievement of pupils for more than 3 years, if such information is available.

(g) Information on whether each school district hasmade adequate yearly progress, including, without limitation, the name of eachschool district, if any, designated as demonstrating need for improvementpursuant to NRS 385.377 and the numberof consecutive years that the school district has carried that designation.

(h) Information on whether each public school,including, without limitation, each charter school, has made adequate yearlyprogress, including, without limitation, the name of each public school, ifany, designated as demonstrating need for improvement pursuant to NRS 385.3623 and the number of consecutiveyears that the school has carried that designation.

(i) Information on the results of pupils whoparticipated in the examinations of the National Assessment of EducationalProgress required pursuant to NRS 389.012.

(j) The ratio of pupils to teachers in kindergarten andat each grade level for all elementary schools, reported for each schooldistrict, including, without limitation, each charter school in the district,and for this State as a whole, and the average class size for each core academicsubject, as set forth in NRS 389.018,for each secondary school, reported for each school district and for this Stateas a whole.

(k) For each school district, including, withoutlimitation, each charter school in the district, and for this State as a whole,information on the professional qualifications of teachers employed by theschool districts and charter schools, including, without limitation:

(1) The percentage of teachers who are:

(I) Providing instruction pursuant to NRS 391.125;

(II) Providing instruction pursuant to awaiver of the requirements for licensure for the grade level or subject area inwhich the teachers are employed; or

(III) Otherwise providing instructionwithout an endorsement for the subject area in which the teachers are employed;

(2) The percentage of classes in the coreacademic subjects, as set forth in NRS389.018, in this State that are not taught by highly qualified teachers;

(3) The percentage of classes in the coreacademic subjects, as set forth in NRS389.018, in this State that are not taught by highly qualified teachers, inthe aggregate and disaggregated by high-poverty compared to low-povertyschools, which for the purposes of this subparagraph means schools in the topquartile of poverty and the bottom quartile of poverty in this State;

(4) For eachmiddle school, junior high school and high school:

(I) On and after July 1, 2005, the numberof persons employed as substitute teachers for 20 consecutive days or more inthe same classroom or assignment, designated as long-term substitute teachers,including the total number of days long-term substitute teachers were employedat each school, identified by grade level and subject area; and

(II) On and after July 1, 2006, the numberof persons employed as substitute teachers for less than 20 consecutive days,designated as short-term substitute teachers, including the total number ofdays short-term substitute teachers were employed at each school, identified bygrade level and subject area; and

(5) For each elementary school:

(I) On and after July 1, 2005, the numberof persons employed as substitute teachers for 20 consecutive days or more inthe same classroom or assignment, designated as long-term substitute teachers,including the total number of days long-term substitute teachers were employedat each school, identified by grade level; and

(II) On and after July 1, 2006, the numberof persons employed as substitute teachers for less than 20 consecutive days,designated as short-term substitute teachers, including the total number ofdays short-term substitute teachers were employed at each school, identified bygrade level.

(l) The total expenditure per pupil for each schooldistrict in this State, including, without limitation, each charter school inthe district. If this State has a financial analysis program that is designedto track educational expenditures and revenues to individual schools, the StateBoard shall use that statewide program in complying with this paragraph. If astatewide program is not available, the State Board shall use the Departmentsown financial analysis program in complying with this paragraph.

(m) The total statewide expenditure per pupil. If thisState has a financial analysis program that is designed to track educationalexpenditures and revenues to individual schools, the State Board shall use thatstatewide program in complying with this paragraph. If a statewide program isnot available, the State Board shall use the Departments own financialanalysis program in complying with this paragraph.

(n) For all elementary schools, junior high schools andmiddle schools, the rate of attendance, reported for each school district,including, without limitation, each charter school in the district, and forthis State as a whole.

(o) The annual rate of pupils who drop out of school ingrades 9 to 12, inclusive, reported for each school district, including,without limitation, each charter school in the district, and for this State asa whole, excluding pupils who:

(1) Provide proof to the school district ofsuccessful completion of the examinations of general educational development.

(2) Are enrolled in courses that are approved bythe Department as meeting the requirements for an adult standard diploma.

(3) Withdraw from school to attend anotherschool.

(p) The attendance of teachers who provide instruction,reported for each school district, including, without limitation, each charterschool in the district, and for this State as a whole.

(q) Incidents involving weapons or violence, reportedfor each school district, including, without limitation, each charter school inthe district, and for this State as a whole.

(r) Incidents involving the use or possession ofalcoholic beverages or controlled substances, reported for each schooldistrict, including, without limitation, each charter school in the district,and for this State as a whole.

(s) The suspension and expulsion of pupils required orauthorized pursuant to NRS 392.466 and 392.467, reported for each school district,including, without limitation, each charter school in the district, and forthis State as a whole.

(t) The number of pupils who are deemed habitualdisciplinary problems pursuant to NRS392.4655, reported for each school district, including, without limitation,each charter school in the district, and for this State as a whole.

(u) The number of pupils in each grade who are retainedin the same grade pursuant to NRS 392.033or 392.125, reported for each schooldistrict, including, without limitation, each charter school in the district,and for this State as a whole.

(v) The transiency rate of pupils, reported for eachschool district, including, without limitation, each charter school in thedistrict, and for this State as a whole. For the purposes of this paragraph, apupil is not a transient if he is transferred to a different school within theschool district as a result of a change in the zone of attendance by the boardof trustees of the school district pursuant to NRS 388.040.

(w) Each source of funding for this State to be usedfor the system of public education.

(x) A compilation of the programs of remedial studypurchased in whole or in part with money received from this State that are usedin each school district, including, without limitation, each charter school inthe district. The compilation must include:

(1) The amount and sources of money received forprograms of remedial study.

(2) An identification of each program ofremedial study, listed by subject area.

(y) The percentage of pupils who graduated from a highschool or charter school in the immediately preceding year and enrolled inremedial courses in reading, writing or mathematics at a university, statecollege or community college within the Nevada System of Higher Education,reported for each school district, including, without limitation, each charterschool in the district, and for this State as a whole.

(z) The technological facilities and equipmentavailable for educational purposes, reported for each school district,including, without limitation, each charter school in the district, and forthis State as a whole.

(aa) For each school district, including, withoutlimitation, each charter school in the district, and for this State as a whole,the number and percentage of pupils who received:

(1) A standard high school diploma.

(2) An adjusted diploma.

(3) A certificate of attendance.

(bb) The number and percentage of pupils who did notreceive a high school diploma because the pupils failed to pass the high schoolproficiency examination, reported for each school district, including, withoutlimitation, each charter school in the district, and for this State as a whole.

(cc) The number of habitual truants who are reported toa school police officer or local law enforcement agency pursuant to paragraph(a) of subsection 2 of NRS 392.144 andthe number of habitual truants who are referred to an advisory board to reviewschool attendance pursuant to paragraph (b) of subsection 2 of NRS 392.144, reported for each schooldistrict, including, without limitation, each charter school in the district,and for this State as a whole.

(dd) Information on the paraprofessionals employed atpublic schools in this State, including, without limitation, the charterschools in this State. The information must include:

(1) The number of paraprofessionals employed,reported for each school district, including, without limitation, each charterschool in the district, and for this State as a whole; and

(2) For each school district, including, withoutlimitation, each charter school in the district, and for this State as a whole,the number and percentage of all paraprofessionals who do not satisfy thequalifications set forth in 20 U.S.C. 6319(c). The reporting requirements ofthis subparagraph apply to paraprofessionals who are employed in programssupported with Title I money and to paraprofessionals who are not employed inprograms supported with Title I money.

(ee) An identification of appropriations made by theLegislature to improve the academic achievement of pupils and programs approvedby the Legislature to improve the academic achievement of pupils.

(ff) A compilation of the special programs availablefor pupils at individual schools, listed by school and by school district,including, without limitation, each charter school in the district.

2. A separate reporting for a subgroup of pupils mustnot be made pursuant to this section if the number of pupils in that subgroupis insufficient to yield statistically reliable information or the resultswould reveal personally identifiable information about an individual pupil. TheState Board shall prescribe a mechanism for determining the minimum number ofpupils that must be in a subgroup for that subgroup to yield statisticallyreliable information.

3. The annual report of accountability must:

(a) Comply with 20 U.S.C. 6311(h)(1) and theregulations adopted pursuant thereto;

(b) Be prepared in a concise manner; and

(c) Be presented in an understandable and uniformformat and, to the extent practicable, provided in a language that parents canunderstand.

4. On or before September 1 of each year, the StateBoard shall:

(a) Provide for public dissemination of the annualreport of accountability by posting a copy of the report on the Internet websitemaintained by the Department; and

(b) Provide written notice that the report is availableon the Internet website maintained by the Department. The written notice mustbe provided to the:

(1) Governor;

(2) Committee;

(3) Bureau;

(4) Board of Regents of the University ofNevada;

(5) Board of trustees of each school district;and

(6) Governing body of each charter school.

5. Upon the request of the Governor, an entitydescribed in paragraph (b) of subsection 4 or a member of the general public,the State Board shall provide a portion or portions of the annual report ofaccountability.

6. As used in this section:

(a) Highly qualified has the meaning ascribed to itin 20 U.S.C. 7801(23).

(b) Paraprofessional has the meaning ascribed to itin NRS 391.008.

NRS 385.34691 Planby State Board to improve achievement of pupils: Preparation; contents;submission; annual review.

1. The State Board shall prepare a plan to improve theachievement of pupils enrolled in the public schools in this State. The plan:

(a) Must be prepared in consultation with:

(1) Employees of the Department;

(2) At least one employee of a school districtin a county whose population is 100,000 or more, appointed by the NevadaAssociation of School Boards;

(3) At least one employee of a school districtin a county whose population is less than 100,000, appointed by the NevadaAssociation of School Boards; and

(4) At least one representative of the StatewideCouncil for the Coordination of the Regional Training Programs created by NRS 391.516, appointed by the Council; and

(b) May be prepared in consultation with:

(1) Representatives of institutions of highereducation;

(2) Representatives of regional educationallaboratories;

(3) Representatives of outside consultantgroups;

(4) Representatives of the regional trainingprograms for the professional development of teachers and administratorscreated by NRS 391.512;

(5) The Bureau; and

(6) Other persons who the State Board determinesare appropriate.

2. A plan to improve the achievement of pupilsenrolled in public schools in this State must include:

(a) A review and analysis of the data upon which thereport required pursuant to NRS 385.3469is based and a review and analysis of any data that is more recent than thedata upon which the report is based.

(b) The identification of any problems or factorscommon among the school districts or charter schools in this State, as revealedby the review and analysis.

(c) Strategies based upon scientifically basedresearch, as defined in 20 U.S.C. 7801(37), that will strengthen the coreacademic subjects, as set forth in NRS389.018.

(d) Strategies to improve the academic achievement ofpupils enrolled in public schools in this State, including, without limitation,strategies to:

(1) Instruct pupils who are not achieving totheir fullest potential, including, without limitation:

(I) The curriculum appropriate to improveachievement;

(II) The manner by which the instructionwill improve the achievement and proficiency of pupils on the examinationsadministered pursuant to NRS 389.015 and389.550; and

(III) An identification of the instructionand curriculum that is specifically designed to improve the achievement andproficiency of pupils in each subgroup identified in paragraph (b) ofsubsection 1 of NRS 385.361;

(2) Increase the rate of attendance of pupilsand reduce the number of pupils who drop out of school;

(3) Integrate technology into the instructionaland administrative programs of the school districts;

(4) Manage effectively the discipline of pupils;and

(5) Enhance the professional development offeredfor the teachers and administrators employed at public schools in this State toinclude the activities set forth in 20 U.S.C. 7801(34) and to address thespecific needs of the pupils enrolled in public schools in this State, asdeemed appropriate by the State Board.

(e) Strategies designed to provide to the pupilsenrolled in middle school, junior high school and high school, the teachers andcounselors who provide instruction to those pupils, and the parents andguardians of those pupils information concerning:

(1) The requirements for admission to aninstitution of higher education and the opportunities for financial aid;

(2) The availability of Governor GuinnMillennium Scholarships pursuant to NRS396.911 to 396.938, inclusive; and

(3) The need for a pupil to make informeddecisions about his curriculum in middle school, junior high school and highschool in preparation for success after graduation.

(f) An identification, by category, of the employees ofthe Department who are responsible for ensuring that each provision of the planis carried out effectively.

(g) For each provision of the plan, a timeline forcarrying out that provision, including, without limitation, a timeline formonitoring whether the provision is carried out effectively.

(h) For each provision of the plan, measurable criteriafor determining whether the provision has contributed toward improving theacademic achievement of pupils, increasing the rate of attendance of pupils andreducing the number of pupils who drop out of school.

(i) Strategies to improve the allocation of resourcesfrom this State, by program and by school district, in a manner that willimprove the academic achievement of pupils. If this State has a financialanalysis program that is designed to track educational expenditures andrevenues to individual schools, the State Board shall use that statewideprogram in complying with this paragraph. If a statewide program is notavailable, the State Board shall use the Departments own financial analysisprogram in complying with this paragraph.

(j) Based upon the reallocation of resources set forthin paragraph (i), the resources available to the State Board and the Departmentto carry out the plan, including, without limitation, a budget for the overallcost of carrying out the plan.

(k) A summary of the effectiveness of appropriationsmade by the Legislature to improve the academic achievement of pupils andprograms approved by the Legislature to improve the academic achievement ofpupils.

3. The State Board shall:

(a) Review the plan prepared pursuant to this sectionannually to evaluate the effectiveness of the plan; and

(b) Based upon the evaluation of the plan, makerevisions, as necessary, to ensure that the plan is designed to improve theacademic achievement of pupils enrolled in public schools in this State.

4. On or before December 15 of each year, the StateBoard shall submit the plan or the revised plan, as applicable, to the:

(a) Governor;

(b) Committee;

(c) Bureau;

(d) Board of Regents of the University of Nevada;

(e) Council to Establish Academic Standards for PublicSchools created by NRS 389.510;

(f) Board of trustees of each school district; and

(g) Governing body of each charter school.

NRS 385.34692 Summaryof accountability information for State Board; submission and publicdissemination of summary; availability of summary on Internet.

1. The State Board shall prepare a summary of theannual report of accountability prepared pursuant to NRS 385.3469 that includes, withoutlimitation, a summary of the following information for each school district,each charter school and the State as a whole:

(a) Demographic information of pupils, including,without limitation, the number and percentage of pupils:

(1) Who are economically disadvantaged, asdefined by the State Board;

(2) Who are from major racial or ethnic groups,as defined by the State Board;

(3) With disabilities;

(4) Who are limited English proficient; and

(5) Who are migratory children, as defined bythe State Board;

(b) The average daily attendance of pupils, reportedseparately for the subgroups identified in paragraph (a);

(c) The transiency rate of pupils;

(d) The percentage of pupils who are habitual truants;

(e) The percentage of pupils who are deemed habitualdisciplinary problems pursuant to NRS392.4655;

(f) The number of incidents resulting in suspension orexpulsion for:

(1) Violence to other pupils or to schoolpersonnel;

(2) Possession of a weapon;

(3) Distribution of a controlled substance;

(4) Possession or use of a controlled substance;and

(5) Possession or use of alcohol;

(g) For kindergarten through grade 8, the number andpercentage of pupils who are retained in the same grade;

(h) For grades 9 to 12, inclusive, the number andpercentage of pupils who are deficient in the number of credits required for promotionto the next grade or graduation from high school;

(i) The pupil-teacher ratio for kindergarten and grades1 to 8, inclusive;

(j) The average class size for the subject area ofmathematics, English, science and social studies in schools where pupils rotateto different teachers for different subjects;

(k) The number and percentage of pupils who graduatedfrom high school;

(l) The number and percentage of pupils who received a:

(1) Standard diploma;

(2) Adult diploma;

(3) Adjusted diploma; and

(4) Certificate of attendance;

(m) The number and percentage of pupils who graduatedfrom high school and enrolled in remedial courses at the Nevada System ofHigher Education;

(n) Per pupil expenditures;

(o) Information on the professional qualifications ofteachers;

(p) The average daily attendance of teachers andlicensure information;

(q) Information on the adequate yearly progress of theschools and school districts;

(r) Pupil achievement based upon the examinationsadministered pursuant to NRS 389.550 andthe high school proficiency examination;

(s) To the extent practicable, pupil achievement basedupon the examinations administered pursuant to NRS 389.015 for grades 4, 7 and 10; and

(t) Other information required by the Superintendent ofPublic Instruction in consultation with the Bureau.

2. The summary prepared pursuant to subsection 1 must:

(a) Comply with 20 U.S.C. 6311(h)(1) and theregulations adopted pursuant thereto;

(b) Be prepared in a concise manner; and

(c) Be presented in an understandable and uniformformat and, to the extent practicable, provided in a language that parents willlikely understand.

3. On or before September 7 of each year, the StateBoard shall:

(a) Provide for public dissemination of the summaryprepared pursuant to subsection 1 by posting the summary on the Internetwebsite maintained by the Department; and

(b) Submit a copy of the summary in an electronicformat to the:

(1) Governor;

(2) Committee;

(3) Bureau;

(4) Board of Regents of the University ofNevada;

(5) Board of trustees of each school district;and

(6) Governing body of each charter school.

4. The board of trustees of each school district andthe governing body of each charter school shall ensure that the parents andguardians of pupils enrolled in the school district or charter school, asapplicable, have sufficient information concerning the availability of thesummary prepared by the State Board pursuant to subsection 1, including,without limitation, information that describes how to access the summary on theInternet website maintained by the Department. Upon the request of a parent orguardian of a pupil, the Department shall provide the parent or guardian with awritten copy of the summary.

5. The Department shall, in consultation with theBureau and the school districts, prescribe a form for the summary required bythis section.

NRS 385.347 Programof accountability for school districts; contents of annual report ofaccountability; public dissemination of report; notice of availability onInternet.

1. The board of trustees of each school district inthis State, in cooperation with associations recognized by the State Board asrepresenting licensed personnel in education in the district, shall adopt aprogram providing for the accountability of the school district to theresidents of the district and to the State Board for the quality of the schoolsand the educational achievement of the pupils in the district, including,without limitation, pupils enrolled in charter schools in the school district.The board of trustees of each school district shall:

(a) Report the information required by subsection 2 foreach charter school that is located within the school district, regardless ofthe sponsor of the charter school.

(b) For the information that is reported in anaggregated format, include the data that is applicable to the charter schoolssponsored by the school district but not the charter schools that are sponsoredby the State Board.

(c) Denote separately in the report those charterschools that are located within the school district and sponsored by the StateBoard.

2. The board of trustees of each school districtshall, on or before August 15 of each year, prepare an annual report ofaccountability concerning:

(a) The educational goals and objectives of the schooldistrict.

(b) Pupil achievement for each school in the districtand the district as a whole, including, without limitation, each charter schoolin the district. The board of trustees of the district shall base its report onthe results of the examinations administered pursuant to NRS 389.015 and 389.550 and shall compare the results ofthose examinations for the current school year with those of previous schoolyears. The report must include, for each school in the district, including,without limitation, each charter school in the district, and each grade inwhich the examinations were administered:

(1) The number of pupils who took theexaminations;

(2) A record of attendance for the period inwhich the examinations were administered, including an explanation of anydifference in the number of pupils who took the examinations and the number ofpupils who are enrolled in the school;

(3) Except as otherwise provided in thisparagraph, pupil achievement, reported separately by gender and reportedseparately for the following subgroups of pupils:

(I) Pupils who are economicallydisadvantaged, as defined by the State Board;

(II) Pupils from major racial and ethnicgroups, as defined by the State Board;

(III) Pupils with disabilities;

(IV) Pupils who are limited Englishproficient; and

(V) Pupils who are migratory children, asdefined by the State Board;

(4) A comparison of the achievement of pupils ineach subgroup identified in paragraph (b) of subsection 1 of NRS 385.361 with the annual measurableobjectives of the State Board;

(5) The percentage of pupils who were not tested;

(6) Except as otherwise provided in thisparagraph, the percentage of pupils who were not tested, reported separately bygender and reported separately for the subgroups identified in subparagraph(3);

(7) The most recent 3-year trend in pupil achievementin each subject area tested and each grade level tested pursuant to NRS 389.015 and 389.550, which may include informationregarding the trend in the achievement of pupils for more than 3 years, if suchinformation is available;

(8) Information that compares the results ofpupils in the school district, including, without limitation, pupils enrolledin charter schools in the district, with the results of pupils throughout thisState. The information required by this subparagraph must be provided inconsultation with the Department to ensure the accuracy of the comparison; and

(9) For each school in the district, including,without limitation, each charter school in the district, information thatcompares the results of pupils in the school with the results of pupilsthroughout the school district and throughout this State. The informationrequired by this subparagraph must be provided in consultation with theDepartment to ensure the accuracy of the comparison.

A separatereporting for a subgroup of pupils must not be made pursuant to this paragraphif the number of pupils in that subgroup is insufficient to yield statisticallyreliable information or the results would reveal personally identifiableinformation about an individual pupil. The State Board shall prescribe themechanism for determining the minimum number of pupils that must be in asubgroup for that subgroup to yield statistically reliable information.

(c) The ratio of pupils to teachers in kindergarten andat each grade level for each elementary school in the district and the districtas a whole, including, without limitation, each charter school in the district,and the average class size for each core academic subject, as set forth in NRS 389.018, for each secondary school inthe district and the district as a whole, including, without limitation, eachcharter school in the district.

(d) Information on the professional qualifications ofteachers employed by each school in the district and the district as a whole,including, without limitation, each charter school in the district. Theinformation must include, without limitation:

(1) The percentage of teachers who are:

(I) Providing instruction pursuant to NRS 391.125;

(II) Providing instruction pursuant to awaiver of the requirements for licensure for the grade level or subject area inwhich the teachers are employed; or

(III) Otherwise providing instructionwithout an endorsement for the subject area in which the teachers are employed;

(2) The percentage of classes in the coreacademic subjects, as set forth in NRS389.018, that are not taught by highly qualified teachers;

(3) The percentage of classes in the coreacademic subjects, as set forth in NRS389.018, that are not taught by highly qualified teachers, in the aggregateand disaggregated by high-poverty compared to low-poverty schools, which forthe purposes of this subparagraph means schools in the top quartile of povertyand the bottom quartile of poverty in this State;

(4) For each middle school, junior high schooland high school:

(I) On and after July 1, 2005, the numberof persons employed as substitute teachers for 20 consecutive days or more inthe same classroom or assignment, designated as long-term substitute teachers,including the total number of days long-term substitute teachers were employedat each school, identified by grade level and subject area; and

(II) On and after July 1, 2006, the numberof persons employed as substitute teachers for less than 20 consecutive days,designated as short-term substitute teachers, including the total number ofdays short-term substitute teachers were employed at each school, identified bygrade level and subject area; and

(5) For each elementary school:

(I) On and after July 1, 2005, the numberof persons employed as substitute teachers for 20 consecutive days or more inthe same classroom or assignment, designated as long-term substitute teachers,including the total number of days long-term substitute teachers were employedat each school, identified by grade level; and

(II) On and after July 1, 2006, the numberof persons employed as substitute teachers for less than 20 consecutive days,designated as short-term substitute teachers, including the total number ofdays short-term substitute teachers were employed at each school, identified bygrade level.

(e) The total expenditure per pupil for each school inthe district and the district as a whole, including, without limitation, eachcharter school in the district. If this State has a financial analysis programthat is designed to track educational expenditures and revenues to individualschools, each school district shall use that statewide program in complyingwith this paragraph. If a statewide program is not available, each schooldistrict shall use its own financial analysis program in complying with thisparagraph.

(f) The curriculum used by the school district,including:

(1) Any special programs for pupils at anindividual school; and

(2) The curriculum used by each charter schoolin the district.

(g) Records of the attendance and truancy of pupils inall grades, including, without limitation:

(1) The average daily attendance of pupils, foreach school in the district and the district as a whole, including, withoutlimitation, each charter school in the district.

(2) For each elementary school, middle school andjunior high school in the district, including, without limitation, each charterschool in the district that provides instruction to pupils enrolled in a gradelevel other than high school, information that compares the attendance of thepupils enrolled in the school with the attendance of pupils throughout thedistrict and throughout this State. The information required by thissubparagraph must be provided in consultation with the Department to ensure theaccuracy of the comparison.

(h) The annual rate of pupils who drop out of school ingrades 9 to 12, inclusive, for each such grade, for each school in the districtand for the district as a whole, excluding pupils who:

(1) Provide proof to the school district ofsuccessful completion of the examinations of general educational development.

(2) Are enrolled in courses that are approved bythe Department as meeting the requirements for an adult standard diploma.

(3) Withdraw from school to attend anotherschool.

(i) Records of attendance of teachers who provideinstruction, for each school in the district and the district as a whole,including, without limitation, each charter school in the district.

(j) Efforts made by the school district and by eachschool in the district, including, without limitation, each charter school inthe district, to increase:

(1) Communication with the parents of pupils inthe district; and

(2) The participation of parents in theeducational process and activities relating to the school district and eachschool, including, without limitation, the existence of parent organizationsand school advisory committees.

(k) Records of incidents involving weapons or violencefor each school in the district, including, without limitation, each charterschool in the district.

(l) Records of incidents involving the use orpossession of alcoholic beverages or controlled substances for each school inthe district, including, without limitation, each charter school in thedistrict.

(m) Records of the suspension and expulsion of pupilsrequired or authorized pursuant to NRS392.466 and 392.467.

(n) The number of pupils who are deemed habitualdisciplinary problems pursuant to NRS392.4655, for each school in the district and the district as a whole, including,without limitation, each charter school in the district.

(o) The number of pupils in each grade who are retainedin the same grade pursuant to NRS 392.033or 392.125, for each school in thedistrict and the district as a whole, including, without limitation, eachcharter school in the district.

(p) The transiency rate of pupils for each school inthe district and the district as a whole, including, without limitation, eachcharter school in the district. For the purposes of this paragraph, a pupil isnot transient if he is transferred to a different school within the schooldistrict as a result of a change in the zone of attendance by the board oftrustees of the school district pursuant to NRS388.040.

(q) Each source of funding for the school district.

(r) A compilation of the programs of remedial studythat are purchased in whole or in part with money received from this State, foreach school in the district and the district as a whole, including, withoutlimitation, each charter school sponsored by the district. The compilation mustinclude:

(1) The amount and sources of money received forprograms of remedial study for each school in the district and the district asa whole, including, without limitation, each charter school in the district.

(2) An identification of each program ofremedial study, listed by subject area.

(s) For each high school in the district, including,without limitation, each charter school in the district, the percentage ofpupils who graduated from that high school or charter school in the immediatelypreceding year and enrolled in remedial courses in reading, writing ormathematics at a university, state college or community college within theNevada System of Higher Education.

(t) The technological facilities and equipmentavailable at each school, including, without limitation, each charter school,and the districts plan to incorporate educational technology at each school.

(u) For each school in the district and the district asa whole, including, without limitation, each charter school in the district,the number and percentage of pupils who received:

(1) A standard high school diploma.

(2) An adjusted diploma.

(3) A certificate of attendance.

(v) For each school in the district and the district asa whole, including, without limitation, each charter school in the district,the number and percentage of pupils who did not receive a high school diplomabecause the pupils failed to pass the high school proficiency examination.

(w) The number of habitual truants who are reported toa school police officer or law enforcement agency pursuant to paragraph (a) ofsubsection 2 of NRS 392.144 and thenumber of habitual truants who are referred to an advisory board to reviewschool attendance pursuant to paragraph (b) of subsection 2 of NRS 392.144, for each school in thedistrict and for the district as a whole.

(x) The amount and sources of money received for thetraining and professional development of teachers and other educationalpersonnel for each school in the district and for the district as a whole,including, without limitation, each charter school in the district.

(y) Whether the school district has made adequateyearly progress. If the school district has been designated as demonstratingneed for improvement pursuant to NRS 385.377,the report must include a statement indicating the number of consecutive yearsthe school district has carried that designation.

(z) Information on whether each public school in thedistrict, including, without limitation, each charter school in the district,has made adequate yearly progress, including, without limitation:

(1) The number and percentage of schools in thedistrict, if any, that have been designated as needing improvement pursuant to NRS 385.3623; and

(2) The name of each school, if any, in thedistrict that has been designated as needing improvement pursuant to NRS 385.3623 and the number of consecutiveyears that the school has carried that designation.

(aa) Information on the paraprofessionals employed byeach public school in the district, including, without limitation, each charterschool the district. The information must include:

(1) The number of paraprofessionals employed atthe school; and

(2) The number and percentage of allparaprofessionals who do not satisfy the qualifications set forth in 20 U.S.C. 6319(c). The reporting requirements of this subparagraph apply toparaprofessionals who are employed in positions supported with Title I moneyand to paraprofessionals who are not employed in positions supported with TitleI money.

(bb) For each high school in the district, including,without limitation, each charter school that operates as a high school,information that provides a comparison of the rate of graduation of pupilsenrolled in the high school with the rate of graduation of pupils throughoutthe district and throughout this State. The information required by thisparagraph must be provided in consultation with the Department to ensure theaccuracy of the comparison.

(cc) An identification of the appropriations made bythe Legislature that are available to the school district or the schools withinthe district and programs approved by the Legislature to improve the academicachievement of pupils.

(dd) Such other information as is directed by theSuperintendent of Public Instruction.

3. The records of attendance maintained by a schoolfor purposes of paragraph (i) of subsection 2 must include the number ofteachers who are in attendance at school and the number of teachers who areabsent from school. A teacher shall be deemed in attendance if the teacher isexcused from being present in the classroom by the school in which he isemployed for one of the following reasons:

(a) Acquisition of knowledge or skills relating to theprofessional development of the teacher; or

(b) Assignment of the teacher to perform duties forcocurricular or extracurricular activities of pupils.

4. The annual report of accountability preparedpursuant to subsection 2 must:

(a) Comply with 20 U.S.C. 6311(h)(2) and theregulations adopted pursuant thereto; and

(b) Be presented in an understandable and uniformformat and, to the extent practicable, provided in a language that parents canunderstand.

5. The Superintendent of Public Instruction shall:

(a) Prescribe forms for the reports required pursuantto subsection 2 and provide the forms to the respective school districts.

(b) Provide statistical information and technicalassistance to the school districts to ensure that the reports providecomparable information with respect to each school in each district and amongthe districts throughout this State.

(c) Consult with a representative of the:

(1) Nevada State Education Association;

(2) Nevada Association of School Boards;

(3) Nevada Association of School Administrators;

(4) Nevada Parent Teacher Association;

(5) Budget Division of the Department ofAdministration; and

(6) Legislative Counsel Bureau,

concerningthe program and consider any advice or recommendations submitted by therepresentatives with respect to the program.

6. The Superintendent of Public Instruction mayconsult with representatives of parent groups other than the Nevada ParentTeacher Association concerning the program and consider any advice or recommendationssubmitted by the representatives with respect to the program.

7. On or before August 15 of each year, the board oftrustees of each school district shall submit to each advisory board to reviewschool attendance created in the county pursuant to NRS 392.126 the information required inparagraph (g) of subsection 2.

8. On or before August 15 of each year, the board oftrustees of each school district shall:

(a) Provide written notice that the report requiredpursuant to subsection 2 is available on the Internet website maintained by theschool district, if any, or otherwise provide written notice of theavailability of the report. The written notice must be provided to the:

(1) Governor;

(2) State Board;

(3) Department;

(4) Committee; and

(5) Bureau.

(b) Provide for public dissemination of the annualreport of accountability prepared pursuant to subsection 2 in the manner setforth in 20 U.S.C. 6311(h)(2)(E) by posting a copy of the report on theInternet website maintained by the school district, if any. If a schooldistrict does not maintain a website, the district shall otherwise provide forpublic dissemination of the annual report by providing a copy of the report tothe schools in the school district, including, without limitation, each charterschool in the district, the residents of the district, and the parents andguardians of pupils enrolled in schools in the district, including, withoutlimitation, each charter school in the district.

9. Upon the request of the Governor, an entitydescribed in paragraph (a) of subsection 8 or a member of the general public,the board of trustees of a school district shall provide a portion or portionsof the report required pursuant to subsection 2.

10. As used in this section:

(a) Highly qualified has the meaning ascribed to itin 20 U.S.C. 7801(23).

(b) Paraprofessional has the meaning ascribed to itin NRS 391.008.

NRS 385.348 Planby school district to improve achievement of pupils: Preparation; contents;submission; annual review.

1. The board of trustees of each school districtshall, in consultation with the employees of the school district, prepare aplan to improve the achievement of pupils enrolled in the school district,excluding pupils who are enrolled in charter schools located in the schooldistrict. If the school district is a Title I school district designated asdemonstrating need for improvement pursuant to NRS 385.377, the plan must also be preparedin consultation with parents and guardians of pupils enrolled in the schooldistrict and other persons who the board of trustees determines are appropriate.

2. Except as otherwise provided in this subsection,the plan must include the items set forth in 20 U.S.C. 6316(c)(7) and theregulations adopted pursuant thereto. If a school district has not beendesignated as demonstrating need for improvement pursuant to NRS 385.377, the board of trustees of theschool district is not required to include those items set forth in 20 U.S.C. 6316(c)(7) and the regulations adopted pursuant thereto that directly relate tothe status of a school district as needing improvement.

3. In addition to the requirements of subsection 2, aplan to improve the achievement of pupils enrolled in a school district mustinclude:

(a) A review and analysis of the data upon which thereport required pursuant to subsection 2 of NRS385.347 is based and a review and analysis of any data that is more recentthan the data upon which the report is based.

(b) The identification of any problems or factors atindividual schools that are revealed by the review and analysis.

(c) Strategies based upon scientifically basedresearch, as defined in 20 U.S.C. 7801(37), that will strengthen the coreacademic subjects, as set forth in NRS389.018.

(d) Strategies to improve the academic achievement ofpupils enrolled in the school district, including, without limitation,strategies to:

(1) Instruct pupils who are not achieving totheir fullest potential, including, without limitation:

(I) The curriculum appropriate to improveachievement;

(II) The manner by which the instructionwill improve the achievement and proficiency of pupils on the examinationsadministered pursuant to NRS 389.015 and389.550; and

(III) An identification of the instructionand curriculum that is specifically designed to improve the achievement andproficiency of pupils in each subgroup identified in paragraph (b) ofsubsection 1 of NRS 385.361;

(2) Increase the rate of attendance of pupilsand reduce the number of pupils who drop out of school;

(3) Integrate technology into the instructionaland administrative programs of the school district;

(4) Manage effectively the discipline of pupils;and

(5) Enhance the professional development offeredfor the teachers and administrators employed by the school district to includethe activities set forth in 20 U.S.C. 7801(34) and to address the specificneeds of the pupils enrolled in the school district, as deemed appropriate bythe board of trustees of the school district.

(e) An identification, by category, of the employees ofthe school district who are responsible for ensuring that each provision of theplan is carried out effectively.

(f) In consultation with the Department, anidentification, by category, of the employees of the Department, if any, whoare responsible for overseeing and monitoring whether the plan is carried outeffectively.

(g) For each provision of the plan, a timeline forcarrying out that provision, including, without limitation, a timeline formonitoring whether the provision is carried out effectively.

(h) For each provision of the plan, measurable criteriafor determining whether the provision has contributed toward improving theacademic achievement of pupils, increasing the rate of attendance of pupils andreducing the number of pupils who drop out of school.

(i) Strategies to improve the allocation of resourcesfrom the school district, by program and by school, in a manner that willimprove the academic achievement of pupils. If this State has a financialanalysis program that is designed to track educational expenditures andrevenues to individual schools, each school district shall use that statewideprogram in complying with this paragraph. If a statewide program is notavailable, each school district shall use its own financial analysis program incomplying with this paragraph.

(j) Based upon the reallocation of resources set forthin paragraph (i), the resources available to the school district to carry outthe plan, including, without limitation, a budget of the overall cost forcarrying out the plan.

(k) A summary of the effectiveness of appropriationsmade by the Legislature that are available to the school district or theschools within the school district to improve the academic achievement ofpupils and programs approved by the Legislature to improve the academicachievement of pupils.

(l) An identification of the programs, practices andstrategies that are used throughout the school district and by the schoolswithin the school district that have proven successful in improving theachievement and proficiency of pupils, including, without limitation:

(1) An identification of each school thatcarries out such a program, practice or strategy;

(2) An indication of which programs, practicesand strategies are carried out throughout the school district and whichprograms, practices and strategies are carried out by individual schools;

(3) The extent to which the programs, practicesand strategies include methods to improve the achievement and proficiency ofpupils in each subgroup identified in paragraph (b) of subsection 1 of NRS 385.361; and

(4) A description of how the school districtdisseminates information concerning the successful programs, practices andstrategies to all schools within the school district.

4. The board of trustees of each school districtshall:

(a) Review the plan prepared pursuant to this sectionannually to evaluate the effectiveness of the plan; and

(b) Based upon the evaluation of the plan, makerevisions, as necessary, to ensure that the plan is designed to improve theacademic achievement of pupils enrolled in the school district.

5. On or before December 15 of each year, the board oftrustees of each school district shall submit the plan or the revised plan, asapplicable, to the:

(a) Superintendent of Public Instruction;

(b) Governor;

(c) State Board;

(d) Department;

(e) Committee; and

(f) Bureau.

NRS 385.349 Summaryof accountability information for school districts; submission and publicdissemination of summary; availability of summary on Internet.

1. The board of trustees of each school district shallprepare a summary of the annual report of accountability prepared pursuant to NRS 385.347 on the form prescribed by theDepartment pursuant to subsection 3 or an expanded form, as applicable. Thesummary must include, without limitation:

(a) The information set forth in subsection 1 of NRS 385.34692, reported for the schooldistrict as a whole and for each school within the school district;

(b) Information on the involvement of parents and legalguardians in the education of their children; and

(c) Other information required by the Superintendent ofPublic Instruction in consultation with the Bureau.

2. The summary prepared pursuant to subsection 1 must:

(a) Comply with 20 U.S.C. 6311(h)(2) and theregulations adopted pursuant thereto; and

(b) Be presented in an understandable and uniformformat and, to the extent practicable, provided in a language that parents willlikely understand.

3. The Department shall, in consultation with theBureau and the school districts, prescribe a form that contains the basicinformation required by subsection 1. The board of trustees of a schooldistrict may use an expanded form that contains additions to the formprescribed by the Department if the basic information contained in the expandedform complies with the form prescribed by the Department.

4. On or before September 7 of each year, the board oftrustees of each school district shall:

(a) Submit the summary in an electronic format to the:

(1) Governor;

(2) State Board;

(3) Department;

(4) Committee;

(5) Bureau; and

(6) Schools within the school district.

(b) Provide for the public dissemination of the summaryby posting a copy of the summary on the Internet website maintained by theschool district, if any. If a school district does not maintain a website, thedistrict shall otherwise provide for public dissemination of the summary. Theboard of trustees of each school district shall ensure that the parents andguardians of pupils enrolled in the school district have sufficient informationconcerning the availability of the summary, including, without limitation,information that describes how to access the summary on the Internet websitemaintained by the school district, if any. Upon the request of a parent or legalguardian, the school district shall provide the parent or legal guardian with awritten copy of the summary.

5. The board of trustees of each school districtshall:

(a) Report the information required by this section foreach charter school that is located within the school district, regardless ofthe sponsor of the charter school.

(b) For the information that is reported in anaggregated format, include the data that is applicable to the charter schoolssponsored by the school district but not the charter schools that are sponsoredby the State Board.

(c) Denote separately in the report those charterschools that are located within the school district and sponsored by the StateBoard.

NRS 385.354 Reportsof regional subdistricts in certain school districts; contents and submissionof reports; compilation of reports by board of trustees. [Effective throughJune 30, 2007.]

1. If the board of trustees of a school district in acounty whose population is 400,000 or more, or the superintendent of schools ofsuch a school district, creates regional subdistricts within the schooldistrict, each regional subdistrict shall, on or before August 15 of each year,prepare an annual report. The annual report must include, without limitation,for the immediately preceding school year:

(a) A description of the geographic area that comprisesthe subdistrict.

(b) A list of the administrative leadership of thesubdistrict.

(c) The number of public meetings, if any, held by thesubdistrict.

(d) The information required by subsection 2 of NRS 385.347, reported for the subdistrictas a whole and for each school within the subdistrict.

(e) The total number of administrators employed toprovide services within the subdistrict, and the total amount of money paid tothose administrators for salaries and benefits.

(f) The total number of teachers and other educationalpersonnel employed to provide instruction and other educational services inschools within the subdistrict, and the total amount of money paid to thoseteachers and personnel for salaries and benefits.

(g) The number of substitute teachers who were employedto provide instruction in schools within the subdistrict for a period of 30consecutive days or more and the subject areas taught by those substituteteachers.

(h) The number of administrators, teachers and othereducational personnel identified in paragraphs (e) and (f) that attended aregional training program for the professional development of teachers andadministrators created by NRS 391.512,including, without limitation:

(1) The type of training received; and

(2) A summary of the evaluation of the trainingby the teachers and administrators who participated.

(i) Demographic information concerning the pupilsenrolled in schools within the subdistrict, including, without limitation:

(1) Race;

(2) Ethnicity;

(3) Gender;

(4) The percentage of pupils with disabilitieswho received special education pursuant to NRS388.440 to 388.520, inclusive;

(5) The percentage of gifted and talented pupilswho received special education pursuant to NRS388.440 to 388.520, inclusive;

(6) The percentage of pupils who participated inthe program for free or reduced-price school lunches pursuant to 42 U.S.C. 1751 et seq.; and

(7) The percentage of pupils who participated ineducational programs for migratory children provided pursuant to 20 U.S.C. 6391 et seq.

(j) The number of schools, if any, within thesubdistrict that were designated as demonstrating need for improvement.

(k) A summary of each program for remediation, if any,purchased for the schools within the subdistrict, including, withoutlimitation:

(1) The name of the program; and

(2) The costs of the program.

(l) The number of preschool children who participatedin early childhood education programs provided by the school district, thesubdistrict or schools within the subdistrict.

(m) The budget for the subdistrict, including, withoutlimitation, the:

(1) Amount of money from the school districtstotal budget that was allocated to the subdistrict or for use to operate theschools within the subdistrict; and

(2) Actual expenditures of the subdistrict orschool district, as applicable, expressed on a per pupil basis, to operate theschools within the subdistrict.

(n) The establishment of zones of attendance, if any,or changes made to the existing zones of attendance, if any, that affected thesubdistrict and the number of pupils within the subdistrict who were affectedby each change.

(o) The number of schools within the subdistrict, ifany, that converted to a year-round schedule.

(p) A description of the procedure of the subdistrictfor hearing grievances and complaints of parents and legal guardians of pupilsenrolled in schools within the subdistrict.

2. On or before August 15 of each year, each regionalsubdistrict shall submit to the board of trustees of the school district inwhich the subdistrict is located, the written report prepared pursuant tosubsection 1. On or before December 15 of each year, the board of trusteesshall submit a written compilation of the reports to the:

(a) Legislative Commission;

(b) Committee; and

(c) Department.

The writtencompilation must include, without limitation, an analysis and evaluation of theequity among the regional subdistricts based upon the information reported.

3. The board of trustees of a school district thatincludes regional subdistricts which are required to submit reports pursuant tothis section shall prescribe forms for the reports.

NRS 385.357 Planto improve achievement of pupils for individual schools; duties of technicalassistance partnership or school support team in preparing plan; annual review;process for approval and submission of plan; timeline for carrying out plan.

1. The principal of each school, including, withoutlimitation, each charter school, shall, in consultation with the employees ofthe school, prepare a plan to improve the achievement of the pupils enrolled inthe school.

2. The plan developed pursuant to subsection 1 mustinclude:

(a) A review and analysis of the data pertaining to theschool upon which the report required pursuant to subsection 2 of NRS 385.347 is based and a review and analysisof any data that is more recent than the data upon which the report is based.

(b) The identification of any problems or factors atthe school that are revealed by the review and analysis.

(c) Strategies based upon scientifically basedresearch, as defined in 20 U.S.C. 7801(37), that will strengthen the coreacademic subjects, as defined in NRS 389.018.

(d) Policies and practices concerning the core academicsubjects which have the greatest likelihood of ensuring that each subgroup ofpupils identified in paragraph (b) of subsection 1 of NRS 385.361 who are enrolled in the schoolwill make adequate yearly progress and meet the minimum level of proficiencyprescribed by the State Board.

(e) Annual measurable objectives, consistent with theannual measurable objectives established by the State Board pursuant to NRS 385.361, for the continuous andsubstantial progress by each subgroup of pupils identified in paragraph (b) ofsubsection 1 of that section who are enrolled in the school to ensure that eachsubgroup will make adequate yearly progress and meet the level of proficiencyprescribed by the State Board.

(f) Strategies, consistent with the policy adoptedpursuant to NRS 392.457 by the board oftrustees of the school district in which the school is located, to promote effectiveinvolvement by parents and families of pupils enrolled in the school in theeducation of their children.

(g) As appropriate, programs of remedial education ortutoring to be offered before and after school, during the summer, or betweensessions if the school operates on a year-round calendar for pupils enrolled inthe school who need additional instructional time to pass or to reach a levelconsidered proficient.

(h) Strategies to improve the academic achievement ofpupils enrolled in the school, including, without limitation, strategies to:

(1) Instruct pupils who are not achieving totheir fullest potential, including, without limitation:

(I) The curriculum appropriate to improveachievement;

(II) The manner by which the instructionwill improve the achievement and proficiency of pupils on the examinationsadministered pursuant to NRS 389.015 and389.550; and

(III) An identification of the instructionand curriculum that is specifically designed to improve the achievement andproficiency of pupils in each subgroup identified in paragraph (b) ofsubsection 1 of NRS 385.361;

(2) Increase the rate of attendance of pupilsand reduce the number of pupils who drop out of school;

(3) Integrate technology into the instructionaland administrative programs of the school;

(4) Manage effectively the discipline of pupils;and

(5) Enhance the professional development offeredfor the teachers and administrators employed at the school to include theactivities set forth in 20 U.S.C. 7801(34) and to address the specific needsof pupils enrolled in the school, as deemed appropriate by the principal.

(i) An identification, by category, of the employees ofthe school who are responsible for ensuring that the plan is carried outeffectively.

(j) In consultation with the school district orgoverning body, as applicable, an identification, by category, of the employeesof the school district or governing body, if any, who are responsible forensuring that the plan is carried out effectively or for overseeing andmonitoring whether the plan is carried out effectively.

(k) In consultation with the Department, anidentification, by category, of the employees of the Department, if any, whoare responsible for overseeing and monitoring whether the plan is carried outeffectively.

(l) For each provision of the plan, a timeline forcarrying out that provision, including, without limitation, a timeline formonitoring whether the provision is carried out effectively.

(m) For each provision of the plan, measurable criteriafor determining whether the provision has contributed toward improving theacademic achievement of pupils, increasing the rate of attendance of pupils andreducing the number of pupils who drop out of school.

(n) The resources available to the school to carry outthe plan. If this State has a financial analysis program that is designed totrack educational expenditures and revenues to individual schools, each schoolshall use that statewide program in complying with this paragraph. If astatewide program is not available, each school shall use the financialanalysis program used by the school district in which the school is located incomplying with this paragraph.

(o) A summary of the effectiveness of appropriationsmade by the Legislature that are available to the school to improve theacademic achievement of pupils and programs approved by the Legislature toimprove the academic achievement of pupils.

(p) A budget of the overall cost for carrying out theplan.

3. In addition to the requirements of subsection 2, ifa school has been designated as demonstrating need for improvement pursuant to NRS 385.3623, the plan must comply with 20U.S.C. 6316(b)(3) and the regulations adopted pursuant thereto.

4. Except as otherwise provided in subsection 5, theprincipal of each school shall, in consultation with the employees of theschool:

(a) Review the plan prepared pursuant to this sectionannually to evaluate the effectiveness of the plan; and

(b) Based upon the evaluation of the plan, makerevisions, as necessary, to ensure that the plan is designed to improve theacademic achievement of pupils enrolled in the school.

5. If a school has been designated as demonstratingneed for improvement pursuant to NRS385.3623, the technical assistance partnership or the support team establishedfor the school, as applicable, shall review the plan and make revisions to themost recent plan for improvement of the school pursuant to NRS 385.3692 or 385.3741, as applicable. If the school isa Title I school that has been designated as demonstrating need forimprovement, the technical assistance partnership or support team establishedfor the school, as applicable, shall, in making revisions to the plan, work inconsultation with parents and guardians of pupils enrolled in the school and,to the extent deemed appropriate by the entity responsible for creating thepartnership or support team, outside experts.

6. On or before November 1 of each year, the principalof each school, or the technical assistance partnership or support teamestablished for the school, as applicable, shall submit the plan or the revisedplan, as applicable, to:

(a) If the school is a public school of the schooldistrict, the superintendent of schools of the school district.

(b) If the school is a charter school, the governingbody of the charter school.

7. If a Title I school is designated as demonstratingneed for improvement pursuant to NRS385.3623, the superintendent of schools of the school district or thegoverning body, as applicable, shall carry out a process for peer review of theplan or the revised plan, as applicable, in accordance with 20 U.S.C. 6316(b)(3)(E) and the regulations adopted pursuant thereto. Not later than 45days after receipt of the plan, the superintendent of schools of the schooldistrict or the governing body, as applicable, shall approve the plan or therevised plan, as applicable, if it meets the requirements of 20 U.S.C. 6316(b)(3) and the regulations adopted pursuant thereto and the requirements ofthis section. The superintendent of schools of the school district or thegoverning body, as applicable, may condition approval of the plan or therevised plan, as applicable, in the manner set forth in 20 U.S.C. 6316(b)(3)(B) and the regulations adopted pursuant thereto. The State Boardshall prescribe the requirements for the process of peer review, including,without limitation, the qualifications of persons who may serve as peerreviewers.

8. If a school is designated as demonstratingexemplary achievement, high achievement or adequate achievement, or if a schoolthat is not a Title I school is designated as demonstrating need forimprovement, not later than 45 days after receipt of the plan or the revisedplan, as applicable, the superintendent of schools of the school district orthe governing body, as applicable, shall approve the plan or the revised planif it meets the requirements of this section.

9. On or before December 15 of each year, theprincipal of each school, or the technical assistance partnership or supportteam established for the school, as applicable, shall submit the final plan orthe final revised plan, as applicable, to the:

(a) Superintendent of Public Instruction;

(b) Governor;

(c) State Board;

(d) Department;

(e) Committee;

(f) Bureau; and

(g) Board of trustees of the school district in whichthe school is located.

10. A plan for the improvement of a school must becarried out expeditiously, but not later than January 1 after approval of theplan pursuant to subsection 7 or 8, as applicable.

NRS 385.358 Summaryof accountability information for individual schools; submission and publicdissemination of summary; availability of summary on Internet.

1. The principal of each public school, including,without limitation, each charter school, shall prepare a summary ofaccountability information on the form prescribed by the Department pursuant tosubsection 3 or an expanded form, as applicable. The summary must include,without limitation:

(a) The information set forth in subsection 1 of NRS 385.34692, reported only for theschool;

(b) Information on the involvement of parents and legalguardians in the education of their children; and

(c) Such other information as is directed by theSuperintendent of Public Instruction in consultation with the Bureau.

2. The summary prepared pursuant to subsection 1 mustbe presented in an understandable and uniform format and, to the extentpracticable, provided in a language that parents will likely understand.

3. The Department shall, in consultation with theBureau and the school districts, prescribe a form that contains the basicinformation required by subsection 1. The principal of a school may use anexpanded form that contains additions to the form prescribed by the Departmentif the basic information contained in the expanded form complies with the formprescribed by the Department.

4. On or before September 7 of each year:

(a) The principal of each public school shall submitthe summary in electronic format to the:

(1) Department;

(2) Bureau; and

(3) Board of trustees of the school district inwhich the school is located.

(b) The school district in which the school is locatedshall ensure that the summary is posted on the Internet website maintained bythe school, if any, or the Internet website maintained by the school district,if any. If the summary is not posted on the website of the school or the schooldistrict, the school district shall otherwise provide for public disseminationof the summary.

(c) The principal of each public school shall ensurethat the parents and legal guardians of the pupils enrolled in the school havesufficient information concerning the availability of the summary, including,without limitation, information that describes how to access the summary on theInternet website, if any, and how a parent or guardian may otherwise access thesummary.

(d) The principal of each public school shall provide awritten copy of the summary to each parent and legal guardian of a pupilenrolled in the school.

NRS 385.359 Dutyof Bureau to contract with consultant to review accountability information andsubmit written reports; qualifications of consultant.

1. The Bureau shall contract with a person or entityto:

(a) Review and analyze, in accordance with thestandards prescribed by the Committee pursuant to subsection 2 of NRS 218.5354, the:

(1) Annualreport of accountability prepared by:

(I)The State Board pursuant to NRS 385.3469;and

(II)The board of trustees of each school district pursuant to NRS 385.347.

(2) Planto improve the achievement of pupils prepared by:

(I)The State Board pursuant to NRS 385.34691;

(II)The board of trustees of each school district pursuant to NRS 385.348; and

(III)Each school pursuant to NRS 385.357identified by the Bureau for review, if any.

(b) Submit a written report to and consult with theState Board and the Department regarding any methods by which the State Boardmay improve the accuracy of the report of accountability required pursuant to NRS 385.3469 and the plan to improve theachievement of pupils required pursuant to NRS385.34691, and the purposes for which the report and plan to improve areused.

(c) Submit awritten report to and consult with each school district regarding any methodsby which the district may improve the accuracy of the report required pursuantto subsection 2 of NRS 385.347 and theplan to improve the achievement of pupils required pursuant to NRS 385.348, and the purposes for which thereport and plan to improve are used.

(d) If requested by the Bureau, submit a written reportto and consult with individual schools identified by the Bureau regarding anymethods by which the school may improve the accuracy of the informationrequired to be reported for the school pursuant to subsection 2 of NRS 385.347 and the plan to improve theachievement of pupils required pursuant to NRS385.357.

(e) Submit written reports and any recommendations tothe Committee and the Bureau concerning:

(1) The effectiveness of the provisions of NRS 385.3455 to 385.391, inclusive, in improving theaccountability of the schools of this state;

(2) The status of each school district that isdesignated as demonstrating need for improvement pursuant to NRS 385.377 and each school that isdesignated as demonstrating need for improvement pursuant to NRS 385.3623; and

(3) Any other matter related to theaccountability of the public schools of this state, as deemed necessary by theBureau.

2. The consultant with whom the Bureau contracts toperform the duties required pursuant to subsection 1 must possess theexperience and knowledge necessary to perform those duties, as determined bythe Committee.

Duties of State Board: Measurement of Adequate YearlyProgress; Criteria for Designating Schools and School Districts; Inclusion ofCertain Pupils Within Statewide System of Accountability

NRS 385.361 Measurementof adequate yearly progress prescribed by State Board; regulations governingconsequences for certain non-Title I schools.

1. The State Board shall define the measurement fordetermining whether each public school, each school district and this state aremaking adequate yearly progress. The definition of adequate yearly progressmust:

(a) Comply with 20 U.S.C. 6311(b)(2) and theregulations adopted pursuant thereto;

(b) Be designed to ensure that all pupils will meet orexceed the minimum level of proficiency set by the State Board, including,without limitation:

(1) Pupils who are economically disadvantaged,as defined by the State Board;

(2) Pupils from major racial and ethnic groups,as defined by the State Board;

(3) Pupils with disabilities; and

(4) Pupils who are limited English proficient;

(c) Be based primarily upon the measurement of progressof pupils on the examinations administered pursuant to NRS 389.550 or the high school proficiencyexamination, as applicable;

(d) Include annual measurable objectives establishedpursuant to 20 U.S.C. 6311(b)(2)(G) and the regulations adopted pursuantthereto;

(e) For high schools, include the rate of graduation;and

(f) For elementary schools, junior high schools andmiddle schools, include the rate of attendance.

2. The examination in science must not be included inthe definition of adequate yearly progress.

3. The State Board shall prescribe, by regulation, theconsequences or sanctions, or both, that apply to a public school that is not aTitle I school and that has been designated as demonstrating need forimprovement for 4 consecutive years or more. In no event may the consequencesor sanctions be more strict than the restructuring that applies to Title Ischools.

NRS 385.3611 Regulationsgoverning criteria for designating schools and school districts. The State Board shall adopt regulations that prescribe thecriteria to be used for designating:

1. Public schools that do not satisfy the criteria fordemonstrating adequate achievement or need for improvement:

(a) As demonstrating exemplary achievement.

(b) As demonstrating high achievement.

2. School districts that do not satisfy the criteriafor demonstrating adequate achievement or need for improvement:

(a) As demonstrating exemplary achievement.

(b) As demonstrating high achievement.

NRS 385.3612 Regulationsgoverning inclusion of pupils enrolled in certain alternative programs withinstatewide system of accountability.

1. The State Board shall adopt regulations thatprescribe, consistent with 20 U.S.C. 6301 et seq. and the regulationsadopted pursuant thereto, the manner in which pupils enrolled in:

(a) A program of distance education pursuant to NRS 388.820 to 388.874, inclusive;

(b) An alternative program for the education of pupilsat risk of dropping out of high school; or

(c) A program of education that:

(1) Primarily serves pupils with disabilities;or

(2) Is operated within a:

(I) Local, regional or state facility forthe detention of children;

(II) Juvenile forestry camp;

(III) Child welfare agency; or

(IV) Correctional institution,

will beincluded within the statewide system of accountability set forth in NRS 385.3455 to 385.391, inclusive.

2. The regulations adopted pursuant to subsection 1must also set forth the manner in which:

(a) The progress of pupils enrolled in a program ofdistance education, an alternative program or a program of education describedin subsection 1 will be accounted for within the statewide system ofaccountability; and

(b) The results of pupils enrolled in a program ofdistance education, an alternative program or a program of education describedin subsection 1 on the examinations administered pursuant to NRS 389.015 and 389.550 will be reported.

Accountability of Public Schools: Annual Determination ofAdequate Yearly Progress; Consequences for Failure to Make Adequate YearlyProgress; Annual Designations of Schools; Consequences for Schools That AreDesignated as Demonstrating Need for Improvement

NRS 385.3613 Annualdetermination of adequate yearly progress for public schools; transmission ofdeterminations; effect of irregularity in testing administration or testingsecurity.

1. Except as otherwise provided in subsection 2, on orbefore June 15 of each year, the Department shall determine whether each publicschool is making adequate yearly progress, as defined by the State Boardpursuant to NRS 385.361.

2. On or before June 30 of each year, the Departmentshall determine whether each public school that operates on a schedule otherthan a traditional 9-month schedule is making adequate yearly progress, asdefined by the State Board pursuant to NRS385.361.

3. The determination pursuant to subsection 1 or 2, asapplicable, for a public school, including, without limitation, a charterschool sponsored by the board of trustees of the school district, must be madein consultation with the board of trustees of the school district in which thepublic school is located. If a charter school is sponsored by the State Board,the Department shall make a determination for the charter school inconsultation with the State Board. The determination made for each school mustbe based only upon the information and data for those pupils who are enrolledin the school for a full academic year. On or before June 15 or June 30 of eachyear, as applicable, the Department shall transmit:

(a) Except as otherwise provided in paragraph (b), thedetermination made for each public school to the board of trustees of theschool district in which the public school is located.

(b) To the State Board the determination made for eachcharter school that is sponsored by the State Board.

4. Except as otherwise provided in this subsection,the Department shall determine that a public school has failed to make adequateyearly progress if any subgroup identified in paragraph (b) of subsection 1 of NRS 385.361 does not satisfy the annualmeasurable objectives established by the State Board pursuant to that section.To comply with 20 U.S.C. 6311(b)(2)(I) and the regulations adopted pursuantthereto, the State Board shall prescribe by regulation the conditions underwhich a school shall be deemed to have made adequate yearly progress eventhough a subgroup identified in paragraph (b) of subsection 1 of NRS 385.361 did not satisfy the annualmeasurable objectives of the State Board.

5. In addition to the provisions of subsection 4, theDepartment shall determine that a public school has failed to make adequateyearly progress if:

(a) The number of pupils enrolled in the school whotook the examinations administered pursuant to NRS 389.550 or the high school proficiencyexamination, as applicable, is less than 95 percent of all pupils enrolled inthe school who were required to take the examinations; or

(b) Except as otherwise provided in subsection 6, foreach subgroup of pupils identified in paragraph (b) of subsection 1 of NRS 385.361, the number of pupils in thesubgroup enrolled in the school who took the examinations administered pursuantto NRS 389.550 or the high schoolproficiency examination, as applicable, is less than 95 percent of all pupilsin that subgroup enrolled in the school who were required to take theexaminations.

6. If the number of pupils in a particular subgroupwho are enrolled in a public school is insufficient to yield statisticallyreliable information:

(a) The Department shall not determine that the schoolhas failed to make adequate yearly progress pursuant to paragraph (b) ofsubsection 5 based solely upon that particular subgroup.

(b) The pupils in such a subgroup must be included inthe overall count of pupils enrolled in the school who took the examinations.

The StateBoard shall prescribe the mechanism for determining the number of pupils thatmust be in a subgroup for that subgroup to yield statistically reliable information.

7. If an irregularity in testing administration or anirregularity in testing security occurs at a school and the irregularityinvalidates the test scores of pupils, those test scores must be included inthe scores of pupils reported for the school, the attendance of those pupilsmust be counted towards the total number of pupils who took the examinationsand the pupils must be included in the total number of pupils who were requiredto take the examinations.

8. As used in this section:

(a) Irregularity in testing administration has themeaning ascribed to it in NRS 389.604.

(b) Irregularity in testing security has the meaningascribed to it in NRS 389.608.

NRS 385.362 Consequencesfor failure to make adequate yearly progress for 1 year.

1. If a public school fails to make adequate yearlyprogress for 1 year:

(a) Except as otherwise provided in paragraph (b), theboard of trustees of the school district in which the school is located shallensure that the school receives technical assistance in the manner set forth in20 U.S.C. 6316(b)(4) and the regulations adopted pursuant thereto. For acharter school sponsored by the school district, the board of trustees shallprovide the technical assistance to the charter school in conjunction with thegoverning body of the charter school.

(b) For a charter school sponsored by the State Board,the Department shall ensure, in conjunction with the governing body of thecharter school, that the school receives technical assistance in the manner setforth in 20 U.S.C. 6316(b)(4) and the regulations adopted pursuant thereto.

2. If a public school fails to make adequate yearlyprogress for 1 year, the principal of the school shall ensure that the plan toimprove the achievement of pupils enrolled in the school is reviewed, revisedand approved in accordance with NRS 385.357.

NRS 385.3621 Additionaladministration of examinations required of school if insufficient number ofpupils take initial administration; waiver by Department authorized. Repealed.(See chapter 328, Statutesof Nevada 2005, at page 1182.)

 

NRS 385.3622 Monitoringadministration of examinations by Department required under certaincircumstances if school fails to make adequate yearly progress. If the Department determines that a public school hasfailed to make adequate yearly progress pursuant to subsection 5 of NRS 385.3613, the Department or itsdesignee shall, to the extent money is available, monitor at the school the administrationof the examinations that are required pursuant to NRS 389.550 and ensure that all eligiblepupils who are in attendance on the day of the administration of theexaminations are given an opportunity to take the examinations until the percentageof pupils who take the examinations is 95 percent or more of all pupilsenrolled in the school who are required to take the examinations.

NRS 385.3623 Criteriafor designating schools as demonstrating exemplary achievement, highachievement, adequate achievement or need for improvement.

1. Except as otherwise provided in paragraph (b) ofsubsection 4, a school must be designated as demonstrating exemplaryachievement if the school:

(a) Makes adequate yearly progress, as determined bythe Department pursuant to NRS 385.3613;and

(b) Satisfies the requirements of the State Boardprescribed pursuant to NRS 385.3611.

2. Except as otherwise provided in paragraph (b) ofsubsection 4, a school must be designated as demonstrating high achievement ifthe school:

(a) Makes adequate yearly progress, as determined bythe Department pursuant to NRS 385.3613;and

(b) Satisfies the requirements of the State Boardprescribed pursuant to NRS 385.3611.

3. Except as otherwise provided in paragraph (b) ofsubsection 4, a school must be designated as demonstrating adequate achievementif the school makes adequate yearly progress, as determined by the Departmentpursuant to NRS 385.3613.

4. A school must be designated as demonstrating needfor improvement if the school:

(a) Fails to make adequate yearly progress, as determinedby the Department pursuant to NRS 385.3613;or

(b) The school makes adequate yearly progress, asdetermined by the Department pursuant to NRS385.3613, but was designated as demonstrating need for improvement pursuantto paragraph (a) in the immediately preceding year for failing to make adequateyearly progress.

The initialdesignation of a school as demonstrating need for improvement must be basedupon 2 consecutive years of data and information for that school.

5. If a public school is designated as demonstratingneed for improvement pursuant to paragraph (a) of subsection 4, the designationof the school as demonstrating need for improvement must not be removed untilthe school has made adequate yearly progress for 2 consecutive years.

NRS 385.3625 Recognitionas exemplary turnaround school. In addition tothe designation of a public school pursuant to NRS 385.366, the board of trustees of aschool district or the Department, as applicable, shall recognize a school as anexemplary turnaround school if the school was designated as demonstrating needfor improvement and within 3 consecutive years after the school received thatdesignation, the school is designated as demonstrating exemplary achievement orhigh achievement.

NRS 385.366 Annualdesignation of schools; issuance of preliminary designations; opportunity forschools to review data; notice of final designations.

1. Based upon the information received from theDepartment pursuant to NRS 385.3613,the board of trustees of each school district shall, on or before July 1 ofeach year, issue a preliminary designation for each public school in the schooldistrict in accordance with the criteria set forth in NRS 385.3623, excluding charter schoolssponsored by the State Board. The board of trustees shall make preliminarydesignations for all charter schools that are sponsored by the board oftrustees. The Department shall make preliminary designations for all charterschools that are sponsored by the State Board. The initial designation of aschool as demonstrating need for improvement must be based upon 2 consecutiveyears of data and information for that school.

2. Before making a final designation for a school, theboard of trustees of the school district or the Department, as applicable,shall provide the school an opportunity to review the data upon which thepreliminary designation is based and to present evidence in the manner setforth in 20 U.S.C. 6316(b)(2) and the regulations adopted pursuant thereto.If the school is a public school of the school district or a charter schoolsponsored by the board of trustees, the board of trustees of the schooldistrict shall, in consultation with the Department, make a final determinationconcerning the designation for the school on August 1. If the school is acharter school sponsored by the State Board, the Department shall make a finaldetermination concerning the designation for the school on August 1.

3. On or before August 1 of each year, the Departmentshall provide written notice of the determinations made pursuant to NRS 385.3613 and the final designationsmade pursuant to this section as follows:

(a) The determinations and final designations made forall schools in this State to the:

(1) Governor;

(2) State Board;

(3) Committee; and

(4) Bureau.

(b) The determinations and final designations made forall schools within a school district to the:

(1) Superintendent of schools of the schooldistrict; and

(2) Board of trustees of the school district.

(c) The determination and final designation made foreach school to the principal of the school.

NRS 385.3661 Designationas demonstrating need for improvement for 1 year: Notice; technical assistance;establishment of technical assistance partnership; school choice required forTitle I schools.

1. If a public school is designated as demonstratingneed for improvement pursuant to NRS385.3623 and the provisions of NRS385.3693, 385.3721 or 385.3745 do not apply, the technicalassistance partnership established for the school pursuant to this sectionshall carry out the requirements of NRS 385.3692.

2. Except as otherwise provided in subsection 3, if apublic school is designated as demonstrating need for improvement pursuant to NRS 385.3623 and the provisions of NRS 385.3693, 385.3721 or 385.3745 do not apply, the board of trusteesof the school district shall:

(a) Provide notice of the designation to the parentsand guardians of pupils enrolled in the school on the form prescribed by theDepartment pursuant to NRS 385.382;

(b) Ensure that the school receives technicalassistance in the manner set forth in 20 U.S.C. 6316(b)(4) and theregulations adopted pursuant thereto; and

(c) Establish a technical assistance partnership forthe school, with the membership prescribed pursuant to NRS 385.3691.

3. If a charter school is designated as demonstratingneed for improvement pursuant to NRS385.3623 and the provisions of NRS385.3693, 385.3721 or 385.3745 do not apply:

(a) The governing body of the charter school shall:

(1) Provide notice of the designation to theparents and guardians of pupils enrolled in the charter school on the formprescribed by the Department pursuant to NRS385.382; and

(2) Establish a technical assistance partnershipfor the charter school, with the membership prescribed pursuant to NRS 385.3691.

(b) For a charter school sponsored by the board oftrustees of a school district, the board of trustees shall, in conjunction withthe governing body of the charter school, ensure that the charter schoolreceives technical assistance in the manner set forth in 20 U.S.C. 6316(b)(4)and the regulations adopted pursuant thereto. The provisions of this paragraphdo not require the school district to pay for the technical assistancepartnership established by the governing body of the charter school.

(c) For a charter school sponsored by the State Board,the Department shall, in conjunction with the governing body of the charterschool, ensure that the charter school receives technical assistance in themanner set forth in 20 U.S.C. 6316(b)(4) and the regulations adopted pursuantthereto.

4. In addition to the requirements of subsection 2 or3, as applicable, if a Title I school is designated as demonstrating need forimprovement pursuant to NRS 385.3623and the provisions of NRS 385.3693, 385.3721 or 385.3745 do not apply:

(a) Except as otherwise provided in paragraph (b), theboard of trustees of the school district shall provide school choice to theparents and guardians of pupils enrolled in the school, including, withoutlimitation, a charter school sponsored by the school district, in accordancewith 20 U.S.C. 6316(b)(1) and the regulations adopted pursuant thereto.

(b) For a charter school sponsored by the State Board,the Department shall work cooperatively with the board of trustees of theschool district in which the charter school is located to provide school choiceto the parents and guardians of pupils enrolled in the charter school inaccordance with 20 U.S.C. 6316(b)(1) and the regulations adopted pursuantthereto.

NRS 385.3691 Membershipof technical assistance partnership.

1. The membership of each technical assistancepartnership established by the board of trustees of a school district for apublic school pursuant to NRS 385.3661:

(a) Must consist of:

(1) At least one employee of the public schoolfor which the partnership is established; and

(2) At least one representative of the schooldistrict.

(b) May consist of other persons, as determined by theboard of trustees, in accordance with the needs of the school based upon thedata and information pertaining to that school.

2. The membership of each technical assistancepartnership established by the governing body of a charter school:

(a) Must consist of:

(1) At least one employee of the charter school;

(2) At least one member of the governing body ofthe charter school;

(3) For a charter school sponsored by the boardof trustees of the school district, at least one representative of the schooldistrict, appointed by the school district; and

(4) For a charter school sponsored by the StateBoard, at least one representative of the Department, appointed by theDepartment.

(b) May consist of other persons, as determined by thegoverning body, in accordance with the needs of the charter school based uponthe data and information pertaining to that charter school.

(Added to NRS by 2003, 19th SpecialSession, 19)

NRS 385.3692 Powersand duties of technical assistance partnership; completion and submission ofform concerning review and analysis of school; Department required to prescribeform for use by partnership.

1. Each technical assistance partnership establishedfor a public school shall complete a form prescribed by the Department pursuantto this section or an expanded form, if applicable, that includes:

(a) A review and analysis of the operation of theschool, including, without limitation, the design and operation of theinstructional program of the school;

(b) A review and analysis of the data pertaining to theschool based upon the report required pursuant to subsection 2 of NRS 385.347 and a review and analysis ofany data that is more recent;

(c) A review of the most recent plan to improve theachievement of the schools pupils; and

(d) An identification of the problems and factors atthe school that contributed to the designation of the school as demonstratingneed for improvement.

2. Each technical assistance partnership establishedfor a public school shall:

(a) Assist the school in developing recommendations forimproving the performance of pupils who are enrolled in the school; and

(b) Adopt, in consultation with the employees of theschool, written revisions to the most recent plan to improve the achievement ofthe schools pupils for approval pursuant to NRS385.357. The written revisions must:

(1) Include the data and findings of thetechnical assistance partnership that provide support for the revisions;

(2) If the school is a Title I school, bedeveloped in consultation with parents and guardians of pupils enrolled in theschool and, to the extent deemed appropriate by the entity that created thetechnical assistance partnership, outside experts;

(3) Set forth a timeline to carry out therevisions;

(4) Set forth priorities for the school incarrying out the revisions; and

(5) Set forth the names and duties of eachperson who is responsible for carrying out the revisions.

3. On or before November 1 of each year, eachtechnical assistance partnership shall submit the form completed pursuant tosubsection 1 to the:

(a) Department;

(b) Bureau;

(c) Board of trustees of the school district orgoverning body of the charter school, as applicable; and

(d) Principal of the school.

4. The Department shall, in consultation with theBureau:

(a) Prescribe a form that contains the basicinformation for a technical assistance partnership to carry out its dutiespursuant to subsection 1; and

(b) Make the form available on a computer disc for useby technical assistance partnerships and, upon request, in any other mannerdeemed reasonable by the Department.

5. Except as otherwise provided in this subsection,each technical assistance partnership shall use the form prescribed by theDepartment to carry out its duties pursuant to subsection 1. A school districtor governing body of a charter school may prescribe an expanded form thatcontains additions to the form prescribed by the Department if the basicinformation contained in the expanded form complies with the form prescribed bythe Department.

6. A technical assistance partnership may require theschool for which the partnership was established to submit plans, strategies,tasks and measures that, in the determination of the partnership, will assistthe school in improving the achievement and proficiency of pupils enrolled inthe school.

NRS 385.3693 Designationas demonstrating need for improvement for 2 consecutive years: Notice;technical assistance; continuation of technical assistance partnership.

1. If a public school is designated as demonstratingneed for improvement pursuant to NRS385.3623 for 2 consecutive years, the technical assistance partnershipestablished for the school pursuant to NRS385.3661 shall carry out the requirements of NRS 385.3692.

2. Except as otherwise provided in subsection 3, if apublic school is designated as demonstrating need for improvement pursuant to NRS 385.3623 for 2 consecutive years, theboard of trustees of the school district shall:

(a) Provide notice of the designation to the parentsand guardians of pupils enrolled in the school on the form prescribed by theDepartment pursuant to NRS 385.382;

(b) Ensure that the school receives technicalassistance in the manner set forth in 20 U.S.C. 6316(b)(4) and theregulations adopted pursuant thereto; and

(c) Continue the technical assistance partnership forthe school.

3. If a charter school is designated as demonstratingneed for improvement pursuant to NRS385.3623 for 2 consecutive years:

(a) The governing body of the charter school shall:

(1) Provide notice of the designation to theparents and guardians of pupils enrolled in the school on the form prescribedby the Department pursuant to NRS 385.382;and

(2) Continue the technical assistance partnershipfor the school.

(b) For a charter school sponsored by the board oftrustees of a school district, the board of trustees shall, in conjunction withthe governing body of the charter school, ensure that the charter schoolreceives technical assistance in the manner set forth in 20 U.S.C. 6316(b)(4)and the regulations adopted pursuant thereto. The provisions of this paragraphdo not require the school district to pay for the technical assistance partnershipestablished by the governing body of the charter school.

(c) For a charter school sponsored by the State Board,the Department shall, in conjunction with the governing body of the charterschool, ensure that the charter school receives technical assistance in themanner set forth in 20 U.S.C. 6316(b)(4) and the regulations adopted pursuantthereto.

NRS 385.372 Designationas demonstrating need for improvement for 2 consecutive years: School choiceand supplemental services required for Title I schools; delay from impositionof supplemental services required for certain schools.

1. In addition to the requirements of NRS 385.3693, if a Title I school is designatedas demonstrating need for improvement pursuant to NRS 385.3623 for 2 consecutive years forfailing to make adequate yearly progress:

(a) Except as otherwise provided in paragraph (b), theboard of trustees of the school district shall:

(1) Provide school choice to the parents andguardians of pupils enrolled in the school in accordance with 20 U.S.C. 6316(b)(1) and the regulations adopted pursuant thereto.

(2) Except as otherwise provided in subsection2, provide supplemental educational services in accordance with 20 U.S.C. 6316(e) and the regulations adopted pursuant thereto from a provider approvedpursuant to NRS 385.384, unless a waiveris granted pursuant to that provision of federal law.

(b) If the school is a charter school:

(1) Sponsored by the board of trustees of aschool district, the board of trustees shall provide school choice to theparents and guardians of pupils enrolled in the school in accordance with 20U.S.C. 6316(b)(1) and the regulations adopted pursuant thereto.

(2) Sponsored by the State Board, the Departmentshall work cooperatively with the board of trustees of the school district inwhich the charter school is located to provide school choice to the parents andguardians of pupils enrolled in the charter school in accordance with 20 U.S.C. 6316(b)(1) and the regulations adopted pursuant thereto.

(3) Except as otherwise provided in subsection3, the governing body of the charter school shall provide supplementaleducational services in accordance with 20 U.S.C. 6316(e) and the regulationsadopted pursuant thereto from a provider approved pursuant to NRS 385.384, unless a waiver is grantedpursuant to that provision of federal law.

2. The board of trustees of a school district shallgrant a delay from the imposition of supplemental educational services for aschool for a period not to exceed 1 year if the school qualifies for a delaypursuant to 20 U.S.C. 6316(b)(7)(D). If the school fails to make adequateyearly progress during the period of the delay, the provisions of NRS 385.3721 apply to the school as if thedelay never occurred.

3. The sponsor of a charter school shall grant a delayfrom the imposition of supplemental educational services for the charter schoolfor a period not to exceed 1 year if the charter school qualifies for a delaypursuant to 20 U.S.C. 6316(b)(7)(D). If the charter school fails to makeadequate yearly progress during the period of the delay, the provisions of NRS 385.3721 apply to the charter schoolas if the delay never occurred.

NRS 385.3721 Designationas demonstrating need for improvement for 3 consecutive years: Notice;technical assistance; establishment of school support team.

1. If a public school is designated as demonstratingneed for improvement pursuant to NRS385.3623 for 3 consecutive years, the support team established for theschool pursuant to this section shall carry out the requirements of NRS 385.3741 and 385.3742.

2. Except as otherwise provided in subsection 3, if apublic school is designated as demonstrating need for improvement pursuant to NRS 385.3623 for 3 consecutive years:

(a) The board of trustees of the school district shall:

(1) Provide notice of the designation to theparents and guardians of pupils enrolled in the school on the form prescribedby the Department pursuant to NRS 385.382;and

(2) Ensure that the school receives technicalassistance in the manner set forth in 20 U.S.C. 6316(b)(4) and theregulations adopted pursuant thereto.

(b) The Department shall establish a support team forthe school, with the membership prescribed pursuant to NRS 385.374.

3. If a charter school is designated as demonstratingneed for improvement pursuant to NRS385.3623 for 3 consecutive years:

(a) The governing body of the charter school shallprovide notice of the designation to the parents and guardians of pupilsenrolled in the charter school on the form prescribed by the Departmentpursuant to NRS 385.382.

(b) For a charter school sponsored by the board oftrustees of a school district, the board of trustees shall, in conjunction withthe governing body of the charter school, ensure that the charter schoolreceives technical assistance in the manner set forth in 20 U.S.C. 6316(b)(4)and the regulations adopted pursuant thereto.

(c) For a charter school sponsored by the State Board,the Department shall, in conjunction with the governing body of the charterschool, ensure that the charter school receives technical assistance in themanner set forth in 20 U.S.C. 6316(b)(4) and the regulations adopted pursuantthereto.

(d) The Department shall establish a support team forthe school, with the membership prescribed pursuant to NRS 385.374.

NRS 385.374 Membershipof school support team. The membership of eachsupport team established pursuant to NRS385.3721:

1. Must consist of, without limitation:

(a) Teachers and principals who are considered highlyqualified and who are not employees of the public school for which the supportteam is established;

(b) At least one representative of the Department, whomust serve as the facilitator of the support team;

(c) Except for a charter school, at least oneadministrator at the district level who is employed by the board of trustees ofthe school district;

(d) At least one parent or guardian of a pupil who isenrolled in the public school for which the support team is established; and

(e) In addition to the requirements of paragraphs (a) to(d), inclusive, for a charter school:

(1) At least one member of the governing body ofthe charter school, regardless of the sponsor of the charter school; and

(2) If the charter school is sponsored by theboard of trustees of a school district, at least one employee of the schooldistrict, which may include an administrator.

2. May consist of, without limitation:

(a) Except for a charter school, one or more members ofthe board of trustees of the school district in which the school is located;

(b) Representatives of institutions of highereducation;

(c) Representatives of regional educationallaboratories;

(d) Representatives of outside consultant groups;

(e) Representatives of the regional training programfor the professional development of teachers and administrators created by NRS 391.512 that provides services to theschool district in which the school is located;

(f) The Bureau; and

(g) Other persons who the Department determines areappropriate.

NRS 385.3741 Dutiesand powers of school support team; Department required to prescribe monthlyprogress report for use by school support team.

1. Each support teamestablished for a public school pursuant to NRS385.3721 shall:

(a) Review and analyze the operation of the school,including, without limitation, the design and operation of the instructionalprogram of the school.

(b) Review and analyze the data pertaining to the schoolupon which the report required pursuant to subsection 2 of NRS 385.347 is based and review and analyzeany data that is more recent than the data upon which the report is based.

(c) Review the most recent plan to improve theachievement of the schools pupils.

(d) Identify and investigate the problems and factorsat the school that contributed to the designation of the school asdemonstrating need for improvement.

(e) Assist the school in developing recommendations forimproving the performance of pupils who are enrolled in the school.

(f) Except as otherwise provided in this paragraph,make recommendations to the board of trustees of the school district, the StateBoard and the Department concerning additional assistance for the school incarrying out the plan for improvement of the school. For a charter schoolsponsored by the State Board, the support team shall make the recommendationsto the State Board and the Department.

(g) In accordance with its findings pursuant to thissection and NRS 385.3742, submit, on orbefore November 1, written revisions to the most recent plan to improve theachievement of the schools pupils for approval pursuant to NRS 385.357. The written revisions must:

(1) Comply with NRS 385.357;

(2) If the school is a Title I school, bedeveloped in consultation with parents and guardians of pupils enrolled in theschool and, to the extent deemed appropriate by the entity that created thesupport team, outside experts;

(3) Include the data and findings of the supportteam that provide support for the revisions;

(4) Set forth goals, objectives, tasks andmeasures for the school that are:

(I) Designed to improve the achievement ofthe schools pupils;

(II) Specific;

(III) Measurable; and

(IV) Conducive to reliable evaluation;

(5) Set forth a timeline to carry out therevisions;

(6) Set forth priorities for the school incarrying out the revisions; and

(7) Set forth the names and duties of eachperson who is responsible for carrying out the revisions.

(h) Except as otherwise provided in this paragraph,work cooperatively with the board of trustees of the school district in whichthe school is located, the employees of the school, and the parents andguardians of pupils enrolled in the school to carry out and monitor the planfor improvement of the school. If a charter school is sponsored by the StateBoard, the Department shall assist the school with carrying out and monitoringthe plan for improvement of the school.

(i) Prepare a monthly progress report in the formatprescribed by the Department and:

(1) Submit the progress report to theDepartment.

(2) Distribute copies of the progress report toeach employee of the school for review.

(j) In addition to the requirements of this section, ifthe support team is established for a Title I school, carry out therequirements of 20 U.S.C. 6317(a)(5).

2. A school support team may require the school forwhich the support team was established to submit plans, strategies, tasks andmeasures that, in the determination of the support team, will assist the schoolin improving the achievement and proficiency of pupils enrolled in the school.

3. The Department shall prescribe a concise monthlyprogress report for use by each support team in accordance with paragraph (i)of subsection 1.

NRS 385.3742 Annualwritten report by school support team; contents, submission and availability ofreport.

1. In addition to the duties prescribed in NRS 385.3741, a support team establishedfor a school shall prepare an annual written report that includes:

(a) Information concerning the most recent plan toimprove the achievement of the schools pupils, including, without limitation,an evaluation of:

(1) The appropriateness of the plan for theschool; and

(2) Whether the school has achieved the goalsand objectives set forth in the plan;

(b) The written revisions to the plan to improve theachievement of the schools pupils submitted by the support team pursuant to NRS 385.3741;

(c) A summary of each program for remediation, if any,purchased for the school with money that is available from the FederalGovernment, this state and the school district in which the school is located,including, without limitation:

(1) The name of the program;

(2) The date on which the program was purchasedand the date on which the program was carried out by the school;

(3) The percentage of personnel at the school whowere trained regarding the use of the program;

(4) The satisfaction of the personnel at theschool with the program; and

(5) An evaluation of whether the program hasimproved the academic achievement of the pupils enrolled in the school whoparticipated in the program;

(d) An analysis of the problems and factors at theschool which contributed to the designation of the school as demonstrating needfor improvement, including, without limitation, issues relating to:

(1) The financial resources of the school;

(2) The administrative and educational personnelof the school;

(3) The curriculum of the school;

(4) The facilities available at the school,including the availability and accessibility of educational technology; and

(5) Any other factors that the support teambelieves contributed to the designation of the school as demonstrating need forimprovement; and

(e) Other information concerning the school, including,without limitation:

(1) The results of the pupils who are enrolledin the school on the examinations that are administered pursuant to NRS 389.550 or the high school proficiencyexamination, as applicable;

(2) Records of the attendance and truancy ofpupils who are enrolled in the school;

(3) The transiency rate of pupils who areenrolled in the school;

(4) A description of the number of years thateach teacher has provided instruction at the school and the rate of turnover ofteachers and other educational personnel employed at the school;

(5) A description of the participation ofparents and legal guardians in the educational process and other activitiesrelating to the school;

(6) A description of each source of money forthe remediation of pupils who are enrolled in the school; and

(7) A description of the disciplinary problemsof the pupils who are enrolled in the school, including, without limitation,the information contained in paragraphs (k) to (n), inclusive, of subsection 2of NRS 385.347.

2. On or before November 1, the support team shallsubmit a copy of the final written report to the:

(a) Principal of the school;

(b) Board of trustees of the school district in whichthe school is located;

(c) Superintendent of schools of the school district inwhich the school is located;

(d) Department; and

(e) Bureau.

The supportteam shall make the written report available, upon request, to each parent orlegal guardian of a pupil who is enrolled in the school.

NRS 385.3743 Designationas demonstrating need for improvement for 3 consecutive years: School choice,supplemental services and corrective action required for Title I schools; delayfrom imposition of corrective action required for certain schools.

1. In addition to the requirements of NRS 385.3721, if a Title I school is designatedas demonstrating need for improvement pursuant to NRS 385.3623 for 3 consecutive years:

(a) Except as otherwise provided in paragraph (b), theboard of trustees of the school district shall:

(1) Provide school choice to the parents andguardians of pupils enrolled in the school in accordance with 20 U.S.C. 6316(b)(1) and the regulations adopted pursuant thereto;

(2) Provide supplemental educational services inaccordance with 20 U.S.C. 6316(e) and the regulations adopted pursuantthereto from a provider approved pursuant to NRS385.384, unless a waiver is granted pursuant to that provision of federallaw; and

(3) Except as otherwise provided in subsection2, take corrective action pursuant to 20 U.S.C. 6316(b)(7) and theregulations adopted pursuant thereto.

(b) If the school is a charter school:

(1) Sponsored by the board of trustees of aschool district, the board of trustees shall:

(I) Provide school choice to the parentsand guardians of pupils enrolled in the charter school in accordance with 20U.S.C. 6316(b)(1); and

(II) Except as otherwise provided insubsection 3, take corrective action pursuant to 20 U.S.C. 6316(b)(7) and theregulations adopted pursuant thereto.

(2) Sponsored by the State Board, the Departmentshall:

(I) Work cooperatively with the board oftrustees of the school district in which the charter school is located toprovide school choice to the parents and guardians of pupils enrolled in theschool in accordance with 20 U.S.C. 6316(b)(1) and the regulations adoptedpursuant thereto; and

(II) Except as otherwise provided insubsection 3, take corrective action pursuant to 20 U.S.C. 6316(b)(7) and theregulations adopted pursuant thereto.

(3) Regardless of the sponsor, the governingbody of the charter school shall provide supplemental educational services inaccordance with 20 U.S.C. 6316(e) and the regulations adopted pursuantthereto from a provider approved pursuant to NRS385.384, unless a waiver is granted pursuant to that provision of federallaw.

2. The board of trustees of a school district shallgrant a delay from the imposition of corrective action for a school for aperiod not to exceed 1 year if the school qualifies for a delay pursuant to 20U.S.C. 6316(b)(7)(D). If the school fails to make adequate yearly progressduring the period of the delay, the provisions of NRS 385.3745 apply as if the delay neveroccurred.

3. The sponsor of a charter school shall grant a delayfrom the imposition of corrective action for the charter school for a periodnot to exceed 1 year if the charter school qualifies for a delay pursuant to 20U.S.C. 6316(b)(7)(D). If the charter school fails to make adequate yearlyprogress during the period of the delay, the provisions of NRS 385.3745 apply as if the delay neveroccurred.

NRS 385.3744 Designationas demonstrating need for improvement for 3 consecutive years: Certaincorrective actions authorized for non-Title I schools; delay from imposition ofcorrective action required for certain schools.

1. Except as otherwise provided in subsection 2, if apublic school that is not a Title I school is designated as demonstrating needfor improvement pursuant to NRS 385.3623for 3 consecutive years for failing to make adequate yearly progress, thesupport team established for the school shall consider whether correctiveaction is appropriate for the school. If the support team determines thatcorrective action is appropriate, the support team shall make a recommendationto the Department for corrective action for the school, including, withoutlimitation, the type of corrective action that is recommended from the list ofcorrective actions authorized pursuant to paragraphs (a), (b) and (c).Regardless of whether a support team recommends corrective action for a school,the Department may take one or more of the following corrective actions for theschool:

(a) Develop and carry out a new curriculum at theschool, including the provision of appropriate professional developmentrelating to the new curriculum.

(b) Decrease the number of employees at the school whocarry out managerial duties.

(c) Extend the school year or the school day.

2. The Department shall grant a delay from theimposition of corrective action for a school for a period not to exceed 1 yearif the school qualifies for a delay in the manner set forth in 20 U.S.C. 6316(b)(7)(D). If the school fails to make adequate yearly progress during theperiod of the delay, the Department may proceed with corrective action as ifthe delay never occurred.

NRS 385.3745 Designationas demonstrating need for improvement for 4 or more consecutive years: Notice;technical assistance; continuation of school support team.

1. If a public school is designated as demonstratingneed for improvement pursuant to NRS385.3623 for 4 or more consecutive years, the support team established forthe school pursuant to NRS 385.3721shall carry out the requirements of NRS385.3741, 385.3742 and 385.3744, as applicable.

2. Except as otherwise provided in subsection 3, if apublic school is designated as demonstrating need for improvement pursuant to NRS 385.3623 for 4 or more consecutiveyears:

(a) The board of trustees of the school district shall:

(1) Provide notice of the designation to theparents and guardians of pupils enrolled in the school on the form prescribedby the Department pursuant to NRS 385.382;and

(2) Ensure that the school receives technicalassistance in the manner set forth in 20 U.S.C. 6316(b)(4) and theregulations adopted pursuant thereto.

(b) The Department shall continue a support team forthe school.

3. If a charter school is designated as demonstratingneed for improvement pursuant to NRS385.3623 for 4 or more consecutive years:

(a) The governing body of the charter school shallprovide notice of the designation to the parents and guardians of pupilsenrolled in the school on the form prescribed by the Department pursuant to NRS 385.382.

(b) For a charter school sponsored by the board oftrustees of a school district, the board of trustees shall, in conjunction withthe governing body of the charter school, ensure that the charter schoolreceives technical assistance in the manner set forth in 20 U.S.C. 6316(b)(4)and the regulations adopted pursuant thereto.

(c) For a charter school sponsored by the State Board,the Department shall, in conjunction with the governing body of the charterschool, ensure that the charter school receives technical assistance in themanner set forth in 20 U.S.C. 6316(b)(4) and the regulations adopted pursuantthereto.

(d) The Department shall continue a support team forthe charter school.

NRS 385.3746 Designationas demonstrating need for improvement for 4 or more consecutive years: Schoolchoice, supplemental services and plan for restructuring required for Title Ischools; delay from imposition of plan for restructuring required for certainschools; notice of plan for restructuring.

1. In addition to the requirements of NRS 385.3745, if a Title I school is designatedas demonstrating need for improvement pursuant to NRS 385.3623 for 4 or more consecutiveyears:

(a) Except as otherwise provided in paragraph (b), theboard of trustees of the school district shall:

(1) Provide school choice to the parents andguardians of pupils enrolled in the school in accordance with 20 U.S.C. 6316(b)(1) and the regulations adopted pursuant thereto;

(2) Provide supplemental educational services inaccordance with 20 U.S.C. 6316(e) and the regulations adopted pursuantthereto from a provider approved pursuant to NRS385.384, unless a waiver is granted pursuant to that provision of federallaw; and

(3) Except as otherwise provided in subsection2, proceed with a plan for restructuring the school if required by 20 U.S.C. 6316(b)(8) and the regulations adopted pursuant thereto.

(b) If the school is a charter school:

(1) Sponsored by the board of trustees of aschool district, the board of trustees shall:

(I) Provide school choice to the parentsand guardians of pupils enrolled in the charter school in accordance with 20U.S.C. 6316(b)(1); and

(II) Except as otherwise provided insubsection 3, proceed with a plan for restructuring the school if required by20 U.S.C. 6316(b)(8) and the regulations adopted pursuant thereto.

(2) Sponsored by the State Board, the Departmentshall:

(I) Work cooperatively with the board oftrustees of the school district in which the charter school is located toprovide school choice to the parents and guardians of pupils enrolled in theschool in accordance with 20 U.S.C. 6316(b)(1) and the regulations adoptedpursuant thereto; and

(II) Except as otherwise provided insubsection 3, proceed with a plan for restructuring the school if required by20 U.S.C. 6316(b)(8) and the regulations adopted pursuant thereto.

(3) Regardless of the sponsor, the governingbody of the charter school shall provide supplemental educational services inaccordance with 20 U.S.C. 6316(e) and the regulations adopted pursuantthereto from a provider approved pursuant to NRS385.384, unless a waiver is granted pursuant to that provision of federallaw.

2. The board of trustees of a school district shallgrant a delay from the imposition of a plan for restructuring for a school fora period not to exceed 1 year if the school qualifies for a delay pursuant to20 U.S.C. 6316(b)(7)(D). If the school fails to make adequate yearly progressduring the period of the delay, the board of trustees shall proceed with a planfor restructuring the school as if the delay never occurred.

3. The sponsor of a charter school shall grant a delayfrom the imposition of a plan for restructuring for the charter school for aperiod not to exceed 1 year if the charter school qualifies for a delaypursuant to 20 U.S.C. 6316(b)(7)(D). If the charter school fails to makeadequate yearly progress during the period of the delay, the Department shallproceed with a plan for restructuring the charter school as if the delay neveroccurred.

4. Before the board of trustees of a school districtor the Department proceeds with a plan for restructuring, the board of trusteesor the Department, as applicable, shall provide to the administrators, teachersand other educational personnel employed at that school, and parents andguardians of pupils enrolled in the school:

(a) Notice that the board of trustees or the Department,as applicable, will develop a plan for restructuring the school;

(b) An opportunity to comment before the plan torestructure is developed; and

(c) An opportunity to participate in the development ofthe plan to restructure.

NRS 385.376 Designationas demonstrating need for improvement for 4 or more consecutive years:Corrective actions and other consequences and sanctions authorized fornon-Title I schools; delay from imposition of corrective actions and otherconsequences required for certain schools; notice of consequences andsanctions.

1. Except as otherwise provided in subsection 2, if apublic school that is not a Title I school is designated as demonstrating needfor improvement pursuant to NRS 385.3623for 4 or more consecutive years for failure to make adequate yearly progress,the support team for the school shall:

(a) If corrective action was not taken against theschool pursuant to NRS 385.3744,consider whether corrective action is appropriate for the school.

(b) If corrective action was taken against the schoolpursuant to NRS 385.3744, considerwhether further corrective action is appropriate or whether consequences orsanctions, or both, are appropriate for the school.

Regardlessof whether a support team recommends corrective action or consequences orsanctions for a school, the Department may take corrective action as set forthin NRS 385.3744 or proceed withconsequences or sanctions, or both, as prescribed by the State Board pursuantto NRS 385.361.

2. The Department shall grant a delay from theimposition of corrective action or restructuring pursuant to this section for aschool for a period not to exceed 1 year if the school qualifies for a delay inthe manner set forth in 20 U.S.C. 6316(b)(7)(D). If the school fails to makeadequate yearly progress during the period of the delay, the Department mayproceed with corrective action or with consequences or sanctions, or both, forthe school, as appropriate, as if the delay never occurred.

3. Before the Department proceeds with consequences orsanctions, the board of trustees or the Department, as applicable, shallprovide to the administrators, teachers and other educational personnelemployed at that school, and parents and guardians of pupils enrolled in theschool:

(a) Notice that the board of trustees or theDepartment, as applicable, will proceed with consequences or sanctions for theschool;

(b) An opportunity to comment before the consequencesor sanctions are carried out; and

(c) An opportunity to participate in the development ofthe consequences or sanctions.

NRS 385.3761 Restructuringrequired for Title I schools; notice of restructuring.

1. If restructuring for a Title I school is requiredpursuant to 20 U.S.C. 6316(b)(8), the board of trustees of the schooldistrict or the Department, as applicable, shall carry out a plan forrestructuring that includes:

(a) Replacing those employees at the school who contributedto the failure of the school to make adequate yearly progress;

(b) Entering into a contract with an entity, including,without limitation, a private management company, with a demonstrated record ofeffectiveness to operate the public school;

(c) If the board of trustees is responsible forrestructuring, requesting that the Department oversee the operation of thepublic school;

(d) If the Department is responsible for restructuring,designating the Department as responsible for overseeing the operation of theschool; or

(e) Taking any other action to restructure thegovernance of the school if the action is designed to improve the academicachievement of pupils enrolled in the school and has substantial promise ofensuring that the school makes adequate yearly progress.

2. Before the board of trustees of a school districtor the Department takes action pursuant to subsection 1, the board of trusteesor the Department, as applicable, shall provide to the administrators, teachersand other educational personnel employed at that school, and the parents andguardians of pupils enrolled in the school:

(a) Notice that a plan for restructuring will becarried out at the school; and

(b) An opportunity to comment on the appropriate actionthat should be carried out pursuant to subsection 1.

Accountability of School Districts: Annual Determinationof Adequate Yearly Progress; Annual Designations of School Districts;Consequences for School Districts That Are Designated as Demonstrating Need forImprovement

NRS 385.3762 Annualdetermination of adequate yearly progress for school districts.

1. On or before July 1 of each year, the Departmentshall determine whether each school district is making adequate yearlyprogress, as defined by the State Board pursuant to NRS 385.361. The pupils who are enrolled ina charter school, if any, located within a school district must not be includedin the determination made for that school district. The determination made foreach school district must be based only upon the information and data for thosepupils who were enrolled in the school district for a full academic year,regardless of whether those pupils attended more than one school within theschool district for that academic year.

2. Except as otherwise provided in this subsection,the Department shall determine that a school district has failed to makeadequate yearly progress if any subgroup of pupils identified in paragraph (b)of subsection 1 of NRS 385.361 who areenrolled in the school district does not satisfy the annual measurableobjectives established by the State Board pursuant to that section. To complywith 20 U.S.C. 6311(b)(2)(I) and the regulations adopted pursuant thereto,the State Board shall prescribe by regulation the conditions under which aschool district shall be deemed to have made adequate yearly progress eventhough a subgroup of pupils identified in paragraph (b) of subsection 1 of NRS 385.361 who are enrolled in the schooldistrict did not satisfy the annual measurable objectives of the State Board.

3. In addition to the provisions of subsection 2, theDepartment shall determine that a school district has failed to make adequateyearly progress if:

(a) The number of pupils enrolled in the schooldistrict who took the examinations administered pursuant to NRS 389.550 or the high school proficiencyexamination, as applicable, is less than 95 percent of all pupils enrolled inthe school district who were required to take the examinations; or

(b) Except as otherwise provided in subsection 4, foreach subgroup of pupils identified in paragraph (b) of subsection 1 of NRS 385.361, the number of pupils enrolledin the school district who took the examinations administered pursuant to NRS 389.550 or the high school proficiencyexamination, as applicable, is less than 95 percent of all pupils in thesubgroup who were required to take the examinations.

4. If the number of pupils in a particular subgroupwho are enrolled in a school district is insufficient to yield statisticallyreliable information:

(a) The Department shall not determine that the schooldistrict has failed to make adequate yearly progress pursuant to paragraph (b)of subsection 3 based solely upon that particular subgroup.

(b) The pupils in such a subgroup must be included inthe overall count of pupils enrolled in the school district who took theexaminations.

The StateBoard shall prescribe the mechanism for determining the minimum number ofpupils that must be in a subgroup for that subgroup to yield statisticallyreliable information.

NRS 385.377 Criteriafor designating school districts as demonstrating exemplary achievement, highachievement, adequate achievement or need for improvement.

1. Except as otherwise provided in paragraph (b) ofsubsection 4, a school district must be designated as demonstrating exemplaryachievement if the school district:

(a) Makes adequate yearly progress, as determined bythe Department pursuant to NRS 385.3762;and

(b) Satisfies the requirements prescribed by the StateBoard pursuant to NRS 385.3611.

2. Except as otherwise provided in paragraph (b) ofsubsection 4, a school district must be designated as demonstrating highachievement if the school district:

(a) Makes adequate yearly progress, as determined bythe Department pursuant to NRS 385.3762;and

(b) Satisfies the requirements of the State Boardprescribed pursuant to NRS 385.3611.

3. Except as otherwise provided in paragraph (b) ofsubsection 4, a school district must be designated as demonstrating adequateachievement if the school district makes adequate yearly progress, asdetermined by the Department pursuant to NRS385.3762.

4. A school district must be designated asdemonstrating need for improvement if:

(a) The school district fails to make adequate yearlyprogress, as determined by the Department pursuant to NRS 385.3762; or

(b) The school district makes adequate yearly progress,as determined by the Department pursuant to NRS385.3762, but was designated as demonstrating need for improvement pursuantto paragraph (a) in the immediately preceding year for failing to make adequateyearly progress.

The initialdesignation of a school district as demonstrating need for improvement must bebased upon 2 consecutive years of data and information for that school district.

5. If a school district is designated as demonstratingneed for improvement pursuant to paragraph (a) of subsection 4, the designationof the school district as demonstrating need for improvement must not beremoved until the school district has made adequate yearly progress for 2consecutive years.

NRS 385.3771 Annualdesignation of school districts; issuance of preliminary designations;opportunity for school districts to review data; notice of final designations;public dissemination.

1. The Department shall, on or before July 1 of eachyear, issue a preliminary designation for each school district pursuant to NRS 385.377. The initial designation of aschool district as demonstrating need for improvement must be based upon 2consecutive years of data and information for that school district.

2. Before making a final designation for a schooldistrict, the Department shall provide the school district an opportunity toreview the data upon which the preliminary designation is based and to presentevidence in the manner set forth in 20 U.S.C. 6316(c)(5) and the regulationsadopted pursuant thereto. Not later than August 1, the Department shall make afinal determination concerning the designation of the school district.

3. On or before August 1 of each year, the Departmentshall provide written notice of the determinations made pursuant to NRS 385.3762 and the final designationsmade pursuant to this section as follows:

(a) The determinations and final designations made forall school districts in this State to the:

(1) Governor;

(2) State Board;

(3) Committee; and

(4) Bureau.

(b) The determination and final designation made for aschool district to the:

(1) Superintendent of schools of the schooldistrict; and

(2) Board of trustees of the school district.

4. On or before August 1 of each year, the Departmentshall make public the results of the review of school districts pursuant tothis section and disseminate the results to school personnel, parents andguardians, pupils and members of the general public. The publication anddistribution must be made in the manner set forth in 20 U.S.C. 6316(c)(1) andthe regulations adopted pursuant thereto.

NRS 385.37715 Recognitionas exemplary turnaround school district. In additionto the designation of a school district pursuant to NRS 385.3771, the Department shallrecognize a school district as an exemplary turnaround school district if theschool district was designated as demonstrating need for improvement and within3 consecutive years after the school district received that designation, theschool district is designated as demonstrating exemplary achievement or highachievement.

NRS 385.3772 Consequencesfor school district designated as demonstrating need for improvement; technicalassistance and corrective action.

1. If a school district is designated as demonstratingneed for improvement pursuant to NRS 385.377,the Department shall provide notice of the designation to the parents andguardians of pupils enrolled in the school district on the form prescribed bythe Department pursuant to NRS 385.382.The State Board shall prescribe, by regulation, the time by which such noticemust be provided.

2. If a school district is designated as demonstratingneed for improvement pursuant to NRS 385.377,the Department and any other entity authorized by the Department, including,without limitation, the Bureau, shall provide technical assistance to theschool district in the manner set forth in 20 U.S.C. 6316(c)(9) and the regulationsadopted pursuant thereto.

3. Except as otherwise provided in NRS 385.3774, after providing technicalassistance pursuant to subsection 2, the Department may take corrective actionin the manner set forth in 20 U.S.C. 6316(c)(10) and the regulations adoptedpursuant thereto against a school district that is designated as demonstratingneed for improvement, including, without limitation, a school district that isnot a Title I school district.

4. Except as otherwise provided in NRS 385.3774, if a Title I school districtis designated as demonstrating need for improvement for 3 or more consecutiveyears, the Department shall take corrective action as set forth in 20 U.S.C. 6316(c)(10) and the regulations adopted pursuant thereto against the schooldistrict.

NRS 385.3773 Typesof corrective actions for school districts; notice of corrective action andopportunity for hearing.

1. Except as otherwise provided in NRS 385.3774, if corrective action for aschool district is required pursuant to 20 U.S.C. 6316(c)(10) or if theDepartment determines that corrective action is appropriate for a schooldistrict pursuant to subsection 3 of NRS385.3772, the Department shall take one or more of the following correctiveactions:

(a) Deferring money for programs or reducing money foradministrative purposes.

(b) Instituting and fully carrying out a new curriculumthat is based upon the standards of content and performance adopted by theState Board pursuant to NRS 389.520,including, without limitation, the provision of appropriate professional developmentrelating to the new curriculum.

(c) Replacing employees of the school district if theDepartment determines that those employees contributed to the failure of theschool district to make adequate yearly progress.

(d) Removing particular schools within the schooldistrict from the jurisdiction of the school district and establishing analternative system of governance and supervision for those schools.

(e) Appointing a receiver or trustee to administer theaffairs of the school district.

(f) Taking appropriate steps to abolish the schooldistrict, including, without limitation, making recommendations to theLegislature for revisions to applicable statutes to abolish the schooldistrict.

(g) Authorizing pupils to transfer from schoolsoperated by the school district to schools operated by another school districtthat are not designated as demonstrating need for improvement.

2. Before carrying out corrective action pursuant tothis section, the Department shall provide notice to the board of trustees ofthe school district and an opportunity for a hearing. The Department shallcontinue to provide technical assistance pursuant to subsection 2 of NRS 385.3772 during the time that thecorrective action is carried out.

3. If corrective action is taken against a schooldistrict pursuant to this section, the Department shall, not later than 10 daysafter the corrective action is taken, provide notice to the parents andguardians of pupils enrolled in the school district, the Governor, theCommittee, the Bureau and the general public concerning the corrective action.The notice must comply with 20 U.S.C. 6316(c)(10).

NRS 385.3774 Delayfrom imposition of corrective action required for certain school districts. The Department shall grant a delay from the imposition ofcorrective action for a school district for a period not to exceed 1 year ifthe school district qualifies for a delay in the manner set forth in 20 U.S.C. 6316(c)(10)(F). If the school district fails to make adequate yearly progressduring the period of the delay, the Department shall proceed with corrective actionas if the delay never occurred.

Commission on Educational Excellence

NRS 385.3781 Definitions. As used in NRS385.3781 to 385.379, inclusive,unless the context otherwise requires, the words and terms defined in NRS 385.3782 and 385.3783 have the meanings ascribed tothem in those sections.

NRS 385.3784 Commission:Creation; membership; terms; meetings; compensation of members; duty ofDepartment to provide administrative support; involvement of the LegislativeCounsel Bureau in activities of Commission.

1. The Commission on Educational Excellence,consisting of nine members is hereby created. The Superintendent of Public Instructionshall serve as an ex officio voting member of the Commission. The Governorshall appoint the following members to the Commission:

(a) Three teachers, two of whom have experience inproviding instruction at public elementary schools and who have been successfulin school improvement efforts and one of whom has experience in providinginstruction at secondary schools and who has been successful in schoolimprovement efforts;

(b) Two principals, one of whom has experience inadministering successful school improvement efforts at an elementary school andone of whom has experience in administering successful school improvementefforts at a secondary school;

(c) Two school district administrators, one of whom isemployed by a school district in a county whose population is less than 100,000and one of whom is employed by a school district in a county whose populationis 100,000 or more; and

(d) One parent or legal guardian of a pupil enrolled ina public school in this State.

One or moreof the members appointed pursuant to this subsection may be retired fromemployment, but those retired members that are appointed must have been employedwith a public school in this State in the immediately preceding 5 years.

2. The Governor may solicit recommendations forappointments pursuant to this section from the Nevada State EducationAssociation, the Nevada Association of School Administrators, a statewideorganization for parents of pupils, the Statewide Council for the Coordinationof the Regional Training Programs and other organizations and entities relatedto education in this State. The Governor may consider the recommendationssubmitted and may make appointments from those recommendations. The Governorshall appoint a Chairman from among the members he appoints.

3. After the initial terms, the term of each appointedmember of the Commission is 2 years, commencing on January 1 of the year inwhich he is appointed and expiring on December 31 of the immediately followingyear. A member shall continue to serve on the Commission until his successor isappointed. Upon the expiration of a term of a member, he may be reappointed ifhe still possesses any requisite qualifications for appointment. There is nolimit on the number of terms that a member may serve.

4. The Commission shall hold at least four regularmeetings each year and may hold special meetings at the call of the Chairman.

5. Members of the Commission serve withoutcompensation, except that for each day or portion of a day during which a memberof the Commission attends a meeting of the Commission or is otherwise engagedin the business of the Commission, he is entitled to receive the per diemallowance and travel expenses provided for state officers and employeesgenerally. The per diem allowances and travel expenses must be paid from theAccount and accounted for separately in that Account. In addition, money in theAccount may be used to pay compensation necessary for the employment ofsubstitute teachers who are hired on those days when a member of the Commissionattends a meeting of the Commission or is otherwise engaged in the business ofthe Commission.

6. The Department shall provide:

(a) Administrative support;

(b) Equipment; and

(c) Office space,

as isnecessary for the Commission to carry out its duties.

7. The Legislative Counsel Bureau:

(a) Must be provided with adequate notice of eachmeeting of the Commission; and

(b) Shall provide, as requested by the Committee,technical expertise and assistance to the Commission.

NRS 385.3785 Commission:Establishment of program of educational excellence; allocations of money toschool districts and schools; Department required to provide list of prioritiesof schools for consideration by Commission; review of certain information byCommission.

1. The Commission shall:

(a) Establish a program of educational excellencedesigned exclusively for pupils enrolled in kindergarten through grade 6 inpublic schools in this State based upon:

(1) The plan to improve the achievement ofpupils prepared by the State Board pursuant to NRS 385.34691;

(2) The plan to improve the achievement ofpupils prepared by the board of trustees of each school district pursuant to NRS 385.348;

(3) The plan to improve the achievement ofpupils prepared by the principal of each school pursuant to NRS 385.357, which may include a program ofinnovation; and

(4) Any other information that the Commissionconsiders relevant to the development of the program of educational excellence.

(b) Identify programs, practices and strategies thathave proven effective in improving the academic achievement and proficiency ofpupils.

(c) Develop a concise application and simple proceduresfor the submission of applications by school districts and public schools,including, without limitation, charter schools, for participation in a programof educational excellence and for grants of money from the Account. Grants ofmoney must be made for programs designed for the achievement of pupils that arelinked to the plan to improve the achievement of pupils or for innovativeprograms, or both. All school districts and public schools, including, withoutlimitation, charter schools, are eligible to submit such an application,regardless of whether the school district or school has made adequate yearlyprogress or failed to make adequate yearly progress. A school district orpublic school selected for participation may be approved by the Commission forparticipation for a period not to exceed 2 years, but may reapply.

(d) Prescribe a long-range timeline for the review,approval and evaluation of applications received from school districts andpublic schools that desire to participate in the program.

(e) Prescribe accountability measures to be carried outby a school district or public school that participates in the program if thatschool district or public school does not meet the annual measurable objectivesestablished by the State Board pursuant to NRS385.361, including, without limitation:

(1) The specific levels of achievement expectedof school districts and schools that participate; and

(2) Conditions for school districts and schoolsthat do not meet the grant criteria but desire to continue participation in theprogram and receive money from the Account, including, without limitation, areview of the leadership at the school and recommendations regarding changes tothe appropriate body.

(f) Determine the amount of money that is availablefrom the Account for those school districts and public schools that areselected to participate in the program.

(g) Allocate money to school districts and publicschools from the Account. Allocations must be distributed not later than August15 of each year.

(h) Establish criteria for school districts and publicschools that participate in the program and receive an allocation of money fromthe Account to evaluate the effectiveness of the allocation in improving theachievement of pupils, including, without limitation, a detailed analysis of:

(1) The achievement of pupils enrolled at eachschool that received money from the allocation based upon measurable criteriaidentified in the plan to improve the achievement of pupils for the schoolprepared pursuant to NRS 385.357;

(2) If applicable, the achievement of pupilsenrolled in the school district as a whole, based upon measurable criteriaidentified in the plan to improve the achievement of pupils for the schooldistrict prepared pursuant to NRS 385.348;

(3) If applicable, the effectiveness of theprogram of innovation on the achievement of pupils and the overalleffectiveness for pupils and staff;

(4) The implementation of the applicable plansfor improvement, including, without limitation, an analysis of whether theschool district or the school is meeting the measurable objectives identifiedin the plan; and

(5) The attainment of measurable progress on theannual list of adequate yearly progress of school districts and schools.

2. To the extent money is available, the Commissionshall make allocations of money to school districts and public schools foreffective programs for grades 7 through 12 that are designed to improve theachievement of pupils and effective programs of innovation for pupils. Inmaking such allocations, the Commission shall comply with the requirements ofsubsection 1.

3. If a school district or public school that receivesmoney pursuant to subsection 1 or 2 does not meet the criteria foreffectiveness as prescribed in paragraph (h) of subsection 1 over a 2-yearperiod, the Commission may consider not awarding future allocations of money tothat school district or public school.

4. On or before July 1 of each year, the Departmentshall provide a list of priorities of schools based upon the adequate yearlyprogress status of schools in the immediately preceding year for considerationby the Commission in its development of procedures for the applications.

5. In carrying out the requirements of this section,the Commission shall review and consider the programs of remedial study adoptedby the Department pursuant to NRS 385.389,the list of approved providers of supplemental services maintained by theDepartment pursuant to NRS 385.384 andthe recommendations submitted by the Committee pursuant to NRS 218.5354 concerning programs,practices and strategies that have proven effective in improving the academicachievement and proficiency of pupils.

NRS 385.3787 Useof money by school districts and schools that receive allocations from Account.

1. A school district or public school that receives anallocation of money from the Account shall:

(a) Account for the money separately;

(b) Use the money to supplement and not replace themoney that would otherwise be expended by the school district or public schoolfor the achievement of pupils in kindergarten through grade 6 or pupils ingrades 7 through 12, as applicable; and

(c) Submit an evaluation of the effectiveness of theallocation in improving the achievement of pupils in kindergarten through grade6 or pupils in grades 7 through 12, as applicable, in accordance with thecriteria for evaluation established by the Commission pursuant to NRS 385.3785.

2. A school district or public school that receives anallocation of money from the Account shall not:

(a) Use the money to settle or arbitrate disputes ornegotiate settlements between an organization that represents licensedemployees of the school district or public school and the school district orpublic school, as applicable.

(b) Use the money to adjust the schedules of salariesand benefits of the employees of the school district or public school, asapplicable.

NRS 385.3789 Submissionof annual reports by Commission.

1. The Commission shall prepare an annual report thatdescribes the distribution of money to the school districts and public schoolsand the programs for which money was allocated from the Account. The reportmust be submitted on or before September 1 of each year to the entitiesidentified in subsection 3.

2. The Commission shall:

(a) Prepare an annual report that describes:

(1) The activities of the Commission;

(2) An analysis of the progress of the schooldistricts and public schools in carrying out the plans to improve theachievement of pupils; and

(3) An analysis of the progress of the schooldistrict and public schools that received an allocation of money from theAccount in improving the achievement of pupils.

(b) Submit the report on or before January 31 of eachyear to the entities identified in subsection 3.

3. The Commission shall submit the reports required bythis section to the:

(a) State Board;

(b) Governor;

(c) Committee;

(d) Bureau;

(e) Interim Finance Committee; and

(f) Board of trustees of each school district.

NRS 385.379 Creationof Account for Programs for Innovation and the Prevention of Remediation;acceptance of gifts and grants; use of money in Account.

1. The Account for Programs for Innovation and thePrevention of Remediation is hereby created in the State General Fund, to beadministered by the Superintendent of Public Instruction. The Superintendent ofPublic Instruction may accept gifts and grants of money from any source fordeposit in the Account. Any money from gifts and grants may be expended inaccordance with the terms and conditions of the gift or grant, or in accordancewith subsection 2. The interest and income earned on the money in the Accountmust be credited to the Account. Any money remaining in the Account at the endof a fiscal year does not revert to the State General Fund, and the balance inthe Account must be carried forward to the next fiscal year.

2. The money in the Account may only be used for theallocation of money to school districts and public schools whose applicationsare approved by the Commission pursuant to NRS385.3785.

Duties of Department: Form for Notice to Parents;Providers of Supplemental Educational Services; Programs of Remedial Study;Establishment of Monitoring System; Regulations

NRS 385.382 Formfor notice to parents concerning designation of schools and school districts.

1. The Department shall prescribe a form for notice toparents and guardians concerning the designation of a public school asdemonstrating need for improvement pursuant to NRS 385.3623. For Title I schools, thenotice must comply with 20 U.S.C. 6316(b)(6) and the regulations adoptedpursuant thereto.

2. The Department shall prescribe a form for notice toparents and guardians pursuant to NRS385.3772 concerning the designation of a school district as demonstratingneed for improvement. For Title I school districts, the notice must comply with20 U.S.C. 6316(c)(6) and the regulations adopted pursuant thereto.

NRS 385.384 Selectionof providers of supplemental educational services; maintenance of updated listof approved providers.

1. The Department shall select, in the manner setforth in 20 U.S.C. 6316(e) and the regulations adopted pursuant thereto,providers of supplemental educational services that must be used by Title Ischools designated as demonstrating need for improvement pursuant to NRS 385.372, 385.3743 and 385.3746. In making a selection ofproviders, the Department shall consider the recommendations submitted by theCommittee pursuant to NRS 218.5354.

2. The Department shall maintain an updated list ofapproved providers throughout this state, categorized by the school districtsin which the supplemental educational services are offered.

NRS 385.389 Adoptionof programs of remedial study; schools demonstrating need for improvementrequired to ensure completion of remedial study by certain pupils.

1. TheDepartment shall adopt programs of remedial study for each subject tested onthe examinations administered pursuant to NRS389.015, including, without limitation, programs that are designed forpupils who are limited English proficient. The programs adopted for pupils whoare limited English proficient must be designed to:

(a) Improve theacademic achievement of those pupils; or

(b) Assist those pupils with attaining proficiency inthe English language.

In adoptingthese programs of remedial study, the Department shall consider therecommendations submitted by the Committee pursuant to NRS 218.5354 and programs of remedialstudy that have proven to be successful in improving the academic achievementof pupils.

2. If a school fails to make adequate yearly progressor if less than 60 percent of the pupils enrolled in a school who took theexaminations administered pursuant to NRS389.015 received an average score on those examinations that is at leastequal to the 26th percentile of the national reference group of pupils to whichthe examinations were compared, the school shall adopt a program of remedialstudy that has been adopted by the Department pursuant to subsection 1 or aprogram, practice or strategy recommended by the Commission on EducationalExcellence pursuant to NRS 385.3785, orany combination thereof, as applicable.

3. A school district that includes a school describedin subsection 2 shall ensure that each of the pupils enrolled in the school whofailed to demonstrate at least adequate achievement on the examinationsadministered pursuant to NRS 389.015 completes,in accordance with the requirements set forth in subsection 4 of NRS 389.015, remedial study that is determinedto be appropriate for the pupil.

NRS 385.3891 Establishmentof monitoring system for statewide system of accountability; annual summary offindings.

1. The Department shall establish a monitoring systemfor the statewide system of accountability. The monitoring system must:

(a) Include a common formula that provides a comparisonand analysis of the results of pupils on the examinations that are administeredpursuant to NRS 389.015 and 389.550, identified by grade, school andschool district.

(b) Identify any inconsistencies of the results of theexaminations administered pursuant to NRS389.015 compared with the results of the examinations administered pursuantto NRS 389.550, including, withoutlimitation, an identification of whether the results of one or more subjectareas on the examinations administered pursuant to NRS 389.015 are significantly higher orlower than the results of the same subject area or areas on the examinationsthat are administered pursuant to NRS389.550.

(c) Identify significant levels of achievement ofpupils on the examinations that are administered pursuant to NRS 389.550 and the high school proficiencyexamination that is administered pursuant to NRS389.015, identified by school and by school district.

(d) Include procedures for investigating, and ifnecessary, auditing any inconsistencies identified pursuant to paragraph (b).The audit must include a review of data from the applicable school district orschool districts, school or schools, and if practicable, class or classes.

2. On or before October 1 of each year, the Departmentshall prepare a written summary of the findings made pursuant to subsection 1.The written summary must be provided to:

(a) The Committee; and

(b) If the findings show inconsistencies applicable toa particular school district or school within a school district, the board oftrustees of that school district.

3. The Committee shall review the report submittedpursuant to subsection 2 and take such action as it deems appropriate.

NRS 385.391 Regulationsgoverning recognition of certain schools and to carry out statewide system ofaccountability.

1. The Department shall adopt:

(a) Regulations to provide for the recognition of schoolsthat:

(1) Receive a designation as demonstratingexemplary achievement or high achievement pursuant to NRS 385.3623.

(2) Significantlyimprove the academic achievement of subgroups of pupils identified in paragraph(b) of subsection 1 of NRS 385.361.

(3) Exceedadequate yearly progress, as determined by the Department pursuant to NRS 385.3613, for 2 or more consecutiveyears.

(b) Such regulations as it deems necessary to carry outthe provisions of this section and NRS385.3455 to 385.391, inclusive,including, without limitation, uniform standards for the type and format ofdata that must be submitted by the school districts and the time by which suchdata must be submitted.

2. The Department may work in consultation with theBureau for identifying and publicizing the achievement of schools that arerecognized pursuant to paragraph (a) of subsection 1.

TESTS OF GENERAL EDUCATIONAL DEVELOPMENT

NRS 385.448 Eligibilityto take tests; permission of board of trustees required under certaincircumstances; regulations; definition.

1. A person who:

(a) Is 17 years of age or older;

(b) If he is at least 17 years of age but less than 18years of age, submits to the State Board written permission signed by hisparent or legal guardian;

(c) Has not graduated from a high school;

(d) Is not currently enrolled in a high school; and

(e) Satisfies any other requirements prescribed by theState Board,

may take thetests of general educational development prescribed by the State Board.

2. The board of trustees of a school district may,upon request and for good cause shown, grant permission to take the tests ofgeneral educational development prescribed by the State Board to a person who:

(a) Resides in the school district;

(b) Is at least 16 years of age but less than 17 yearsof age;

(c) Submits to the board of trustees written permissionsigned by his parent or legal guardian;

(d) Has not graduated from a high school;

(e) Is not currently enrolled in a high school; and

(f) Satisfies any other requirements prescribed by theboard of trustees.

3. The State Board may adopt regulations to carry outthe provisions of subsection 1.

4. As used in this section, tests of general educationaldevelopment means examinations which enable persons who have not graduatedfrom high school to demonstrate that they have achieved an educational levelwhich is an acceptable substitute for completing a high school education.

NRS 385.451 Disclosureof questions and answers prohibited; exceptions. Itis unlawful to disclose the questions contained in tests of general educationaldevelopment and the approved answers used for grading the tests except:

1. To the extent that disclosure is required in theDepartments administration of the tests.

2. That a disclosure may be made to a state officerwho is a member of the Executive or Legislative branch to the extent that it isrelated to the performance of that officers duties.
