VERMONT SUPREME COURT Case No. 22-AP-160 109 State Street Montpelier VT 05609-0801 802-828-4774 www.vermontjudiciary.org ENTRY ORDER JUNE TERM, 2022 State of Vermont v. Neal Joseph* } } } } APPEALED FROM: Superior Court, Washington Unit, Criminal Division CASE NO. 22-CR-02380 In the above-entitled cause, the Clerk will enter: Defendant Neal Joseph filed this appeal on June 7, 2022, alleging that he has been held without bail in pre-trial detention for a period exceeding the sixty-day maximum allowable under 13 V.S.A. § 7553b(b). However, defendant filed a motion on May 25, 2022, requesting the criminal division to “schedule a bail-review hearing and . . . set bail for [him.]” Id. § 7553b(b). The criminal division granted the motion on the same day, but it did not schedule a hearing at that time. On June 9, 2022, the criminal division scheduled a bail-review hearing for June 13, 2022. Because that hearing has not yet occurred, defendant’s appeal is premature and therefore dismissed. FOR THE COURT: ______________________________ Karen R. Carroll, Associate Justice
