DEFINITIONS

NRS 467.010 Definitions. As used in this chapter, unless the context otherwiserequires, the words and terms defined in NRS467.0101 to 467.0108, inclusive,have the meanings ascribed to them in those sections.

NRS 467.0101 Boarddefined. Board means the Medical AdvisoryBoard.

NRS 467.0103 Contestantdefined. Contestant means any person whoengages in unarmed combat for remuneration.

NRS 467.01037 Managerdefined.

1. Manager means a person who:

(a) Undertakes to represent the interests of anotherperson, by contract, agreement or other arrangement, in procuring, arranging orconducting a professional contest or exhibition in which that person willparticipate as a contestant;

(b) Directs or controls the activities of an unarmedcombatant relating to the participation of the unarmed combatant inprofessional contests or exhibitions;

(c) Receives or is entitled to receive at least 10percent of the gross purse or gross income of any professional unarmedcombatant for services relating to the participation of the unarmed combatantin a professional contest or exhibition; or

(d) Receives compensation for services as an agent orrepresentative of an unarmed combatant.

2. The term does not include an attorney who islicensed to practice law in this state if his participation in any of theactivities described in subsection 1 is limited solely to his legalrepresentation of a client who is an unarmed combatant.

NRS 467.0104 Promoterdefined. Promoter means any person whoproduces or stages any professional contest or exhibition of unarmed combat.

NRS 467.0105 Pursedefined. Purse means the financial guaranteeor any other remuneration for which contestants are participating in a contestor exhibition and includes the contestants share of any payment received forradio broadcasting, television or motion picture rights.

NRS 467.0106 Ringofficial defined. Ring official means anyperson who performs an official function during the progress of a contest orexhibition of unarmed combat.

NRS 467.01065 Sanctioningorganization defined. Sanctioning organizationmeans an organization that sanctions professional contests of unarmed combat inthis state.

NRS 467.0107 Unarmedcombat defined. Unarmed combat meansboxing, wrestling or any form of competition in which a blow is usually struckwhich may reasonably be expected to inflict injury.

NRS 467.0108 Unarmedcombatant defined.

1. Unarmed combatant means any person who engages inunarmed combat in a contest or exhibition, whether or not the person receivesremuneration.

2. The term includes, without limitation:

(a) A contestant; and

(b) An amateur boxer who:

(1) Is registered with United States AmateurBoxing, Inc., or any other amateur organization recognized by the Commission;and

(2) Participates in an amateur boxing contest orexhibition in this state that is registered and sanctioned by United StatesAmateur Boxing, Inc., or Golden Gloves of America.

3. The term does not include a person who participatesin a contest or exhibition that is exempt from the provisions of this chapter.

MEDICAL ADVISORY BOARD

NRS 467.012 Creation;Chairman; terms.

1. The Medical Advisory Board consisting of fivemembers to be appointed by the Governor is hereby created.

2. The Governor shall designate one of the members ofthe Board as its Chairman.

3. After the initial terms, the Governor shall appointeach member to a term of 4 years. If the position of a member is vacated, theGovernor shall appoint a qualified person to replace the member for theremainder of the unexpired term.

NRS 467.015 Qualificationsof members. Each member of the Board must:

1. Be licensed to practice medicine pursuant to chapter 630 or 633of NRS.

2. Have at least 5 years of experience in the practiceof medicine at the time of his appointment.

NRS 467.018 Duties. The Board shall:

1. Prepare and submit to the Commission appropriatestandards for the physical and mental examination of contestants. No standardis effective until it is approved by the Commission.

2. Recommend to the Commission for licensing,physicians who are qualified to examine contestants.

3. Advise the Commission as to the physical or mentalfitness of a contestant, if it so requests.

4. Prepare and submit to the Legislature and theCommission reports containing any recommendations for revisions in the lawwhich it deems necessary to protect the health of contestants in this state.

NEVADA ATHLETIC COMMISSION

NRS 467.020 Creation;number and appointment of members; quorum; prohibitions concerning contests andexhibitions.

1. The Nevada Athletic Commission, consisting of fivemembers appointed by the Governor, is hereby created within the Department ofBusiness and Industry.

2. Three members of the Commission constitute a quorumfor the exercise of the authority conferred upon the Commission, and aconcurrence of at least three of the members is necessary to render a choice ora decision by the Commission.

3. A member shall not at any time during his serviceas a member of the Commission promote or sponsor any contest or exhibition ofunarmed combat, or combination of those events, or have any financial interestin the promotion or sponsorship of those contests or exhibitions.

NRS 467.030 Chairman;seal; regulations; form of contracts.

1. The members of the Commission shall elect one oftheir number as Chairman of the Commission.

2. The Commission may purchase and use a seal.

3. The Commission may adopt regulations for the administrationof this chapter. The regulations must include:

(a) Number and qualifications of ring officialsrequired at any exhibition or contest.

(b) Procedures for obtaining fingerprints pursuant to NRS 467.100 to investigate the criminalhistory of all ring officials and employees of the Commission and any otherapplicant the Commission wishes to investigate.

(c) Powers, duties and compensation of ring officials.

(d) Qualifications of licensees.

4. The Commission shall prepare all forms of contractsbetween sponsors, licensees, promoters and contestants.

NRS 467.040 Employmentof Executive Director; deposit of money in State General Fund; exceptions.

1. The Commission may employ an Executive Director,who must not be a member of the Commission.

2. Except as provided in NRS 467.080 and 467.135, all money received by theExecutive Director or the Commission pursuant to the provisions of this chaptermust be deposited with the State Treasurer for credit to the State GeneralFund.

NRS 467.050 Inspectors:Appointment; duties; promotion or sponsoring of professional contest orexhibition prohibited.

1. For each county of the State the Commission mayappoint one or more official representatives to be designated as inspectors,and may appoint one chief inspector in each county having a population of100,000 or more. The chief inspectors shall supervise the work of all otherinspectors appointed by the Commission. Each inspector must receive from theCommission a card authorizing him to act as an inspector for the county designated.He holds office as an inspector at the pleasure of the Commission.

2. An inspector shall not at any time during hisservice as an inspector promote or sponsor any professional contest orexhibition of unarmed combat, or combination of those events.

NRS 467.055 Compensationof members of Commission and other employees of Commission; classification ofExecutive Director; certain other employment of Executive Director allowed.

1. Members of the Commission, if authorized by theChairman, are entitled to receive a salary of not more than $80, as fixed bythe Commission, for each full-day meeting of the Commission.

2. While engaged in the business of the Commission,each member and employee of the Commission is, upon the authorization of theChairman, entitled to receive the per diem allowance and travel expensesprovided for state officers and employees generally.

3. The Executive Director of the Commission is in theunclassified service of the State. He may pursue any other business oroccupation not inconsistent or in conflict with his duties as ExecutiveDirector.

4. Each inspector for the Commission is entitled toreceive for the performance of his duties a fee approved by the Commission.

NRS 467.063 Authorityto affiliate with other state or national boxing commission or athleticauthority. The Commission shall have theauthority to affiliate with any other state or national boxing commission orathletic authority.

LICENSING AND CONTROL OF CONTESTS AND EXHIBITIONS OFUNARMED COMBAT

NRS 467.070 Jurisdictionof Commission.

1. The Commission has and is vested with the soledirection, management, control and jurisdiction over all contests orexhibitions of unarmed combat to be conducted, held or given within the Stateof Nevada, and no contest or exhibition may be conducted, held or given withinthis state except in accordance with the provisions of this chapter.

2. Any boxing or sparring contest conforming to therequirements of this chapter and to the regulations of the Commission shall bedeemed to be a boxing contest and not a prize fight.

3. Any contest involving a form of Oriental unarmedself-defense must be conducted pursuant to rules for that form which areapproved by the Commission before the contest is conducted, held or given.

NRS 467.080 Licensefor contest or exhibition where admission fee received; application forlicense; fee; limited, restricted or conditional license; bond or deposit;Athletic Commissions Agency Account; additional deposit; exceptions.

1. The Commission may issue and revoke licenses toconduct, hold or give contests or exhibitions of unarmed combat where anadmission fee is received in accordance with such terms and provisions as theCommission prescribes.

2. Any application for such a license must be inwriting and correctly show and define the applicant. The application must beaccompanied by an annual fee to be fixed by the Commission on a uniform scale.

3. The Commission may deny an application for such alicense or grant a limited, restricted or conditional license for any causedeemed sufficient by the Commission.

4. Before any license is granted, the applicant mustfile a bond in an amount fixed by the Commission but not less than $10,000,executed by the applicant as principal, and by a corporation qualified underthe laws of this state as surety, payable to the State of Nevada, andconditioned upon the faithful performance by the applicant of the provisions ofthis chapter. In lieu of a bond, the applicant may deposit with the Commissiona like amount of lawful money of the United States or any other form ofsecurity authorized by NRS 100.065. Ifsecurity is provided in the form of a savings certificate, certificate ofdeposit or investment certificate, the certificate must state that the amountis not available for withdrawal except upon order of the Commission. All moneywhich the Commission receives pursuant to this subsection must be depositedwith the State Treasurer for credit to the Athletic Commissions AgencyAccount, which is hereby created in the State Agency Fund for Bonds.

5. If the Commission believes the requirement for abond is inadequate, the Commission may require the promoter to make a depositof money in an amount fixed by the Commission. The deposit must be made notless than 5 days before the contest or exhibition. It may be used to satisfyany obligation incurred by the promoter during the staging of the contest orexhibition upon order of the Commission. After satisfaction of all suchobligations, the Commission shall release the remainder to the promoter.

6. The provisions of subsections 4 and 5 do not applyto amateur athletic clubs.

NRS 467.100 Licensesfor contestant, promoter, manager, trainer, ring official and others;application for license; privileged statements; submission of fingerprints;withdrawal of application; uniform scale of fees; payment of costs ofproceedings.

1. All contestants, promoters, managers, seconds,trainers and ring officials must be licensed by the Commission. No person mayparticipate, directly or indirectly, in any professional contest or exhibitionof unarmed combat unless he has first procured a license from the Commission.

2. The Commission may deny an application for alicense or grant a limited, restricted or conditional license for any causedeemed sufficient by the Commission.

3. An application for a license constitutes a requestfor a determination of the applicants general suitability, character,integrity, and ability to participate or engage in, or be associated withcontests or exhibitions of unarmed combat. The burden of proof is on theapplicant to establish to the satisfaction of the Commission that the applicantis qualified to receive a license. By filing an application with the Commission,an applicant accepts the risk of adverse public notice, embarrassment,criticism, financial loss or other action with respect to his application, andexpressly waives any claim for damages as a result thereof. Any written or oralstatement that is made by any member of the Commission or any witnesstestifying under oath which is relevant to the application and investigation ofthe applicant is absolutely privileged and does not impose liability fordefamation or constitute a ground for recovery in a civil action.

4. TheCommission shall require:

(a) Each ringofficial and employee of the Commission; and

(b) Any otherapplicant the Commission wishes to investigate,

to submit tothe Commission with the application a complete set of his fingerprints whichthe Commission may forward to the Central Repository for Nevada Records ofCriminal History for submission to the Federal Bureau of Investigation for itsreport.

5. After an application has been submitted to theCommission, the application may not be withdrawn unless the Commission consentsto the withdrawal.

6. The Commission shall fix a uniform scale of licensefees.

7. In addition to the license fees required bysubsection 6, the Commission may require an applicant for a license to:

(a) Pay the costs of the proceedings associated withthe issuance of the license, including, without limitation, investigative costsand attorneys fees; and

(b) Deposit with the Commission such an amount of moneyas the Commission deems necessary to pay for those costs. If any amountrequired to be deposited pursuant to this paragraph exceeds the actual cost ofthe proceedings, including, without limitation, investigative costs andattorneys fees, the Commission shall refund the excess amount to the applicantupon the completion of the proceedings.

8. It is a violation of this chapter for any person toparticipate, directly or indirectly, as stated in subsection 1, unless he hasbeen granted a license therefor.

NRS 467.1005 Confidentialityof certain information concerning applicant for license; disclosure ofinformation; procedure.

1. Except as otherwise provided in subsection 2, theCommission shall keep confidential:

(a) Any information that it receives concerning anapplicant for the issuance of a license pursuant to this chapter which isdeclared confidential by law and that is provided to the Commission by anothergovernmental entity or the Association of Boxing Commissions;

(b) Any information contained in a medical record ofsuch an applicant, if the information is not relevant to the Commission indetermining whether to grant a license to the applicant;

(c) Any information relating to the financial recordsof an applicant or licensee; and

(d) Any information required to be disclosed to theCommission and kept confidential pursuant to federal law.

2. The Commission shall reveal the information setforth in subsection 1:

(a) Upon the lawful order of a court of competentjurisdiction;

(b) To any person upon the request of the person who isthe subject of the information; and

(c) In the course of the necessary administration ofthis chapter.

3. A person seeking an order of a court of competentjurisdiction for the disclosure of information described in subsection 1 mustsubmit a motion in writing to the court requesting the information. At least 10days before submitting the motion, the person must provide notice to theCommission, the Attorney General and all persons who may be affected by thedisclosure of the information. The notice must:

(a) Include, without limitation, a copy of the motionand all documents in support of the motion that are to be filed with the court;and

(b) Be delivered in person or by certified mail to thelast known address of each person to whom notice must be provided.

NRS 467.101 Paymentof child support: Statement by applicant for license; grounds for denial oflicense; duty of Commission. [Expires by limitation on the date of the repealof the federal law requiring each state to establish procedures forwithholding, suspending and restricting the professional, occupational andrecreational licenses for child support arrearages and for noncompliance withcertain processes relating to paternity or child support proceedings.]

1. An applicantfor the issuance or renewal of a license issued pursuant to NRS 467.100 shall submit to the Commissionthe statement prescribed by the Division of Welfare and Supportive Services ofthe Department of Health and Human Services pursuant to NRS 425.520. The statement must becompleted and signed by the applicant.

2. The Commission shall include the statement requiredpursuant to subsection 1 in:

(a) The application or any other forms that must besubmitted for the issuance or renewal of the license; or

(b) A separate form prescribed by the Commission.

3. A license may not be issued or renewed by theCommission pursuant to NRS 467.100 ifthe applicant:

(a) Fails to submit the statement required pursuant tosubsection 1; or

(b) Indicates on the statement submitted pursuant tosubsection 1 that he is subject to a court order for the support of a child andis not in compliance with the order or a plan approved by the district attorneyor other public agency enforcing the order for the repayment of the amount owedpursuant to the order.

4. If an applicant indicates on the statementsubmitted pursuant to subsection 1 that he is subject to a court order for thesupport of a child and is not in compliance with the order or a plan approvedby the district attorney or other public agency enforcing the order for therepayment of the amount owed pursuant to the order, the Commission shall advisethe applicant to contact the district attorney or other public agency enforcingthe order to determine the actions that the applicant may take to satisfy thearrearage.

NRS 467.1015 Suspensionof license for failure to pay child support or comply with certain subpoenas orwarrants; reinstatement of license. [Expires by limitation on the date of therepeal of the federal law requiring each state to establish procedures forwithholding, suspending and restricting the professional, occupational andrecreational licenses for child support arrearages and for noncompliance withcertain processes relating to paternity or child support proceedings.]

1. If theCommission receives a copy of a court order issued pursuant to NRS 425.540 that provides for thesuspension of all professional, occupational and recreational licenses,certificates and permits issued to a person who is the holder of a licenseissued pursuant to NRS 467.100, theCommission shall deem the license issued to that person to be suspended at theend of the 30th day after the date on which the court order was issued unlessthe Commission receives a letter issued to the holder of the license by thedistrict attorney or other public agency pursuant to NRS 425.550 stating that the holder of thelicense has complied with the subpoena or warrant or has satisfied thearrearage pursuant to NRS 425.560.

2. The Commission shall reinstate a license issuedpursuant to NRS 467.100 that has beensuspended by a district court pursuant to NRS425.540 if the Commission receives a letter issued by the district attorneyor other public agency pursuant to NRS425.550 to the person whose license was suspended stating that the personwhose license was suspended has complied with the subpoena or warrant or has satisfiedthe arrearage pursuant to NRS 425.560.

1. Any person who charges and receives an admissionfee for exhibiting any live contest or exhibition of unarmed combat on aclosed-circuit telecast, or motion picture, shall, within 10 days after theevent, furnish to the Commission a verified written report on a form which issupplied by the Commission, showing the number of tickets sold and issued orsold or issued, and the gross receipts therefor without any deductions.

2. That person shall also, not later than 20 daysafter the exhibition, pay to the Commission a license fee, exclusive of federaltaxes thereon, of 4 cents for each $1 or fraction thereof received foradmission at the exhibition. The license fee applies uniformly at the same rateto all persons subject to it. The license fee must be based on the face valueof all tickets sold and complimentary tickets issued.

NRS 467.105 Permitfor promoter to present program; limited, restricted or conditional permit;fees; exceptions.

1. Every promoter, in order to present a program ofcontests or exhibitions of unarmed combat, must obtain a permit from theCommission for each program.

2. The Commission may deny an application for such apermit or grant a limited, restricted or conditional permit for any causedeemed sufficient by the Commission.

3. The Commission shall charge and collect thefollowing fees for a permit to present a program of contests or exhibitions:

 

Permit for a promoter who has noplace of business in this state.................. $100

Permit for a promoter who has aplace of business in this state....................... 100

 

The provisions of this subsection do not apply to thepresentation of a program of amateur contests or exhibitions of unarmed combat.

NRS 467.107 Additionalfees for license of promoter; exemption; regulations.

1. In addition to the payment of any other fees andmoney due under this chapter, every promoter, except as provided in subsection2, shall pay a license fee of:

(a) Four percent of the total gross receipts fromadmission fees to the live contest or exhibition of unarmed combat, exclusiveof any federal tax or tax imposed by any political subdivision of this state;and

(b) Three percent of the first $1,000,000, and 1percent of the next $2,000,000, of the total gross receipts from the sale,lease or other exploitation of broadcasting, television and motion picturerights for that contest or exhibition,

without anydeductions for commissions, brokerage fees, distribution fees, advertising,contestants purses or any other expenses or charges.

2. A corporation organized pursuant to NRS 81.550 to 81.660, inclusive, which promotes anamateur contest or exhibition of unarmed combat whose net proceeds are to bespent entirely in this state, for the purposes for which the corporation isorganized, is exempt from the fees payable under this section. The corporationmust retain the services of a promoter licensed pursuant to this chapter.

3. The Commission shall adopt regulations:

(a) Requiring that the number and face value of allcomplimentary tickets be reported.

(b) Governing the treatment of complimentary ticketsfor the purposes of computing gross receipts from admission fees underparagraph (a) of subsection 1.

NRS 467.108 Additionalfee for each ticket sold for admission to live professional boxing or wrestlingcontest, match or exhibition; money collected to be used for amateur boxingcontests or exhibitions; application for grant; regulations.

1. Except as otherwise provided in subsection 2, inaddition to the payment of any other fees or taxes required by this chapter, apromoter shall pay to the Commission a fee of $1.00 for each ticket sold foradmission to a live professional boxing or wrestling contest, match orexhibition which is held in this state.

2. In lieu of the fee imposed pursuant to subsection1, the Executive Director of the Commission may require a promoter to pay tothe Commission a fee of $0.50 for each ticket sold for admission to a liveprofessional boxing or wrestling contest, match or exhibition which is held inthis state if the gross receipts from admission fees to the contest, match orexhibition are less than $500,000.

3. The money collected pursuant to subsections 1 and 2must be used by the Commission to award grants to organizations which promoteamateur boxing contests or exhibitions in this state.

4. The Commission shall adopt by regulation the mannerin which:

(a) The fees required by subsections 1 and 2 must bepaid.

(b) Applications for grants may be submitted to theCommission and the standards to be used to award grants to organizations whichpromote amateur boxing contests or exhibitions in this state.

NRS 467.109 Timefor report to Commission and payment of additional fees by promoter.

1. Every promoter shall, within 10 days after thecompletion of any contest, match or exhibition for which an admission fee ischarged and received, furnish to the Commission a verified written reportshowing:

(a) The number of tickets sold and issued or sold orissued for the contest, match or exhibition;

(b) The amount of the:

(1) Gross receipts from admission fees; and

(2) Gross receipts derived from the sale, leaseor other exploitation of broadcasting, motion picture and television rights ofsuch contest, match or exhibition,

without anydeductions for commissions, brokerage fees, distribution fees, advertising,contestants purses or any other expenses or charges; and

(c) Such other matters as the Commission may prescribe.

2. The promoter shall, not later than 20 days afterthe contest, match or exhibition, pay to the Commission the license feedescribed in NRS 467.107.

NRS 467.110 Suspension,revocation and other disciplining of contestant and other participants; groundsfor refusal to issue license.

1. The Commission may suspend or revoke the licenseof, otherwise discipline, or take any combination of such actions against anycontestant, promoter, ring official or other participant who, in the judgmentof the Commission:

(a) Enters into a contract for a contest or exhibitionof unarmed combat in bad faith;

(b) Participates in any sham or fake contest orexhibition of unarmed combat;

(c) Participates in a contest or exhibition of unarmedcombat pursuant to a collusive understanding or agreement in which thecontestant competes in or terminates the contest or exhibition in a manner thatis not based upon honest competition or the honest exhibition of the skill ofthe contestant;

(d) Is guilty of a failure to give his best efforts, afailure to compete honestly or a failure to give an honest exhibition of hisskills in a contest or exhibition of unarmed combat;

(e) Is guilty of an act or conduct that is detrimentalto a contest or exhibition of unarmed combat, including, but not limited to,any foul or unsportsmanlike conduct in connection with a contest or exhibitionof unarmed combat; or

(f) Fails to comply with any limitation, restriction orcondition placed on his license.

2. The Commission may refuse to issue a license to anapplicant who has committed any of the acts described in subsection 1.

NRS 467.113 Hearingby member of Commission; notice of disciplinary hearing; approval ofadjudication and order by majority of Commission; distribution of writtenreport.

1. Any member of the Commission may conduct hearings.

2. All disciplinary hearings conducted under theprovisions of this chapter must be preceded by a written notice to be servedupon the accused at least 10 days before the hearing.

3. Before any adjudication is rendered, a majority ofthe members of the Commission shall examine the record and approve theadjudication and order.

4. The Commission shall file a written report of itsfindings, adjudication and order in the record of the proceedings and send acopy to the accused.

NRS 467.115 Commission may issue subpoenas,administer oaths, appoint hearing examiners and pay certain expenses; penaltyfor making false oath before Commission.

1. TheCommission, or a quorum of three members thereof, may:

(a) Issuesubpoenas to require the attendance and testimony of a licensee or other personwhom the Commission believes to have information of importance to theCommission;

(b) Issuesubpoenas duces tecum to require the production of books and papers by alicensee or other person whom the Commission believes to have books or papersof importance to the Commission;

(c) Administeroaths and require testimony under oath;

(d) Appointhearing examiners who may administer oaths and receive evidence and testimonyunder oath; and

(e) Pay suchtransportation and other expenses of witnesses as it may deem reasonable andproper.

2. Service ofprocess or notice required pursuant to this section must be served in themanner provided for service of process and notices in civil actions.

3. A person making false oath in a matter before theCommission or a hearing examiner is guilty of perjury which is a category Dfelony and shall be punished as provided in NRS193.130.

NRS 467.117 Suspensionof license or permit by member or Executive Director of Commission pendingfinal determination by Commission; continuation of suspension by Commission;procedure.

1. Each member of the Commission or the ExecutiveDirector of the Commission may, upon his own motion or upon the verifiedwritten charge of any person charging a licensee or the holder of a permit withviolating any provision of this chapter or the regulations adopted pursuantthereto, suspend for a period not exceeding 10 days any license or permit untilfinal determination by the Commission if, in his opinion, the action isnecessary to protect the public welfare and the best interests of the sportsregulated pursuant to this chapter.

2. If a license or permit is suspended pursuant tosubsection 1, the Commission may, upon written notice to the licensee or holderof the permit and after a hearing, continue the suspension until it makes afinal determination of any disciplinary action to be taken against the licenseeor holder of the permit.

NRS 467.120 Contractbetween contestant and licensee: Copy provided to contestant and ExecutiveDirector; impounding gate receipts.

1. Every contestant competing under the terms of thischapter or regulation of the Commission is entitled to receive a copy of awritten contract or agreement approved as to form by the Commission binding thelicensee to pay the contestant a certain fixed fee or percentage of the gatereceipts.

2. One copy of the agreement must be filed with theExecutive Director of the Commission and one copy must be retained by thelicensee or sponsor of the contest.

3. The inspector or member of the Commission inattendance at the contest shall determine whether such an agreement has beendelivered to each contestant and may require that a sufficient amount of thegate receipts be impounded to pay the contestants according to thoseagreements.

NRS 467.125 Insurancefor licensed contestants. The Commission may,by regulation, require insurance coverage for each licensed contestant toprovide for medical, surgical and hospital care for injuries sustained whileengaged in contests or exhibitions of unarmed combat, in an amount of $50,000or more payable to the physician or hospital which treated the contestant forhis injuries or, if he has paid for that care, directly to him or hisbeneficiary.

NRS 467.130 Advanceagainst purse by promoter to licensee prohibited; permission of member of Commissionfor advance to contestant for necessary expenses. Nopromoter may pay or give any money to a licensee before any contest orexhibition of unarmed combat as an advance against a contestants purse or fora similar purpose, except that the promoter may, with the prior writtenpermission of a member of the Commission, pay or advance to a contestantnecessary expenses for transportation and maintenance in preparation for acontest or exhibition.

NRS 467.135 Orderto promoter to withhold part of purse or other money due certain contestants ormanager or second; hearing; disposition of money.

1. The Commission, its Executive Director or any otheremployee authorized by the Commission may order the promoter to withhold anypart of a purse or other money belonging or payable to any contestant, manageror second if, in the judgment of the Commission, Executive Director or otheremployee:

(a) The contestant is not competing honestly or to thebest of his skill and ability or the contestant otherwise violates anyregulations adopted by the Commission or any of the provisions of this chapter,including, but not limited to, the provisions of subsection 1 of NRS 467.110; or

(b) The manager or seconds violate any regulationsadopted by the Commission or any of the provisions of this chapter, including,but not limited to, the provisions of subsection 1 of NRS 467.110.

2. This section does not apply to any contestant in awrestling exhibition who appears not to be competing honestly or to the best ofhis skill and ability.

3. Upon the withholding of any part of a purse orother money pursuant to this section, the Commission shall immediately schedulea hearing on the matter, provide adequate notice to all interested parties anddispose of the matter as promptly as possible.

4. If it is determined that a contestant, manager orsecond is not entitled to any part of his share of the purse or other money,the promoter shall pay the money over to the Commission. Subject to theprovisions of subsection 5, the money must be deposited with the StateTreasurer for credit to the State General Fund.

5. Money turned over to the Commission pending finalaction in any matter must be credited to the Athletic Commissions AgencyAccount and must remain in that Account until the Commission orders itsdisposition in accordance with the final action taken.

NRS 467.136 Registrationof sanctioning organization or television network; fees, costs and deposit;regulations.

1. The Commission may require a sanctioningorganization or a broadcasting network for television that televisesprofessional contests of unarmed combat in this State to register with theCommission before it participates, directly or indirectly, in any professional contestor exhibition of unarmed combat.

2. If such registration is required, the Commissionshall adopt regulations that prescribe, without limitation, the requirementsfor registration and any fees for registration.

3. The Commission may require a sanctioningorganization or broadcasting network that applies for registration to:

(a) Pay the costs of the proceedings relating to theissuance of the registration, including, without limitation, investigativecosts and attorneys fees; and

(b) Deposit with the Commission such an amount of moneyas the Commission deems necessary to pay for those costs. If any amountrequired to be deposited pursuant to this paragraph exceeds the actual cost ofthe proceedings, including, without limitation, investigative costs andattorneys fees, the Commission shall refund the excess amount to thesanctioning organization or broadcasting network upon the completion of theproceedings.

NRS 467.137 Promoterand network to file copy of contracts for television rights; records ofaccounts and other documents; assessment of fee for license; confidentiality ofcontract.

1. A promoter and a broadcasting network for televisionshall each, at least 72 hours before a contest or exhibition of unarmed combat,or combination of those events is to be held, file with the CommissionsExecutive Director a copy of all contracts entered into for the sale, lease orother exploitation of television rights for the contest or exhibition.

2. The promoter shall keep detailed records of theaccounts and other documents related to his receipts from the sale, lease orother exploitation on the television rights for a contest or exhibition. TheCommission, at any time, may inspect these accounts and documents to determinethe amount of the total gross receipts received by the promoter from thetelevision rights.

3. If a promoter or a network fails to comply with therequirements of this section, the Commission may determine the amount of thetotal gross receipts from the sale, lease or other exploitation of televisionrights for the contest or exhibition and assess the appropriate license feepursuant to paragraph (b) of subsection 1 of NRS467.107.

4. Each contract filed with the Commission pursuant tothis section is confidential and is not a public record.

NRS 467.140 Attendanceof representative or member of Commission at weigh-ins, medical examinations,contests and exhibitions. The Executive Directorof the Commission, a chief inspector or a member of the staff of the Commissionmust be present at all weigh-ins, medical examinations, contests, exhibitionsor matches, and shall ensure that the rules are strictly enforced.

NRS 467.145 Promoterto control seating arrangements; member of Commission furnished ringside seat. Each promoter of a contest or exhibition of unarmed combathas charge of all seating arrangements but shall furnish to each member of theCommission who is present one ringside seat.

NRS 467.150 Lengthof boxing contests and rounds; rest between rounds. Noboxing contest, sparring match or exhibition may be more than 12 rounds inlength. Rounds must be not more than 3 minutes. There must be a rest period of60 seconds between successive rounds.

NRS 467.155 Weighing-inof participants in boxing contests. Every participantin a boxing contest shall be present and weighed in no later than 12 m. on theday of the contest.

NRS 467.157 Revocationof license. Any license issued under thischapter may be revoked for cause deemed sufficient by the Commission upon ahearing as provided for in NRS 467.113.

NRS 467.158 Penaltiesin lieu of or in addition to other disciplinary action; payment of costs ofproceedings.

1. If disciplinary action is taken against a personpursuant to this chapter and the disciplinary action does not relate to acontest or exhibition of unarmed combat as provided in subsection 2, theCommission may, in lieu of revoking a license, prescribe a penalty not toexceed $250,000.

2. If disciplinary action is taken against a personpursuant to this chapter, including, but not limited to, a hearing for therevocation of a license, and the disciplinary action relates to:

(a) The preparation for a contest or an exhibition ofunarmed combat;

(b) The occurrence of a contest or an exhibition ofunarmed combat; or

(c) Any other action taken in conjunction with acontest or an exhibition of unarmed combat,

theCommission may prescribe a penalty pursuant to subsection 3.

3. A penalty prescribed by the Commission pursuant tosubsection 2:

(a) Must not exceed $250,000 or 100 percent of theshare of the purse to which the holder of the license is entitled for thecontest or exhibition, whichever amount is greater; and

(b) May be imposed in addition to or in lieu of anyother disciplinary action that is taken against the person by the Commission.

4. If disciplinary action is taken against a personpursuant to this chapter, the Commission may require the person against whomsuch action is taken to pay the costs of the proceeding, includinginvestigative costs and attorneys fees.

NRS 467.159 Reinstatementof revoked license: Payment of penalty prescribed by Commission; payment ofcosts of proceedings.

1. Except as otherwise provided in NRS 467.158, upon receipt of an applicationand the payment of a penalty prescribed by the Commission, not to exceed$250,000, the Commission may reinstate a revoked license.

2. In addition to the penalty required by subsection1, the Commission may require the applicant to:

(a) Pay the costs of the proceedings associated withthe reinstatement of the license, including investigative costs and attorneysfees; and

(b) Deposit with the Commission such an amount of moneyas the Commission deems necessary to pay for those costs. If any amount requiredto be deposited pursuant to this paragraph exceeds the actual cost of theproceedings, including investigative costs and attorneys fees, the Commissionshall refund the excess amount to the applicant upon the completion of theproceedings.

APPLICABILITY OF CHAPTER; PENALTIES

NRS 467.170 Amateurcontest or exhibition of school, college or university exempted from provisionsof chapter. The provisions of this chapter donot apply to any amateur contests or exhibitions of unarmed combat or anycombination thereof conducted by or participated in exclusively by any school,college or university or by any association or organization of a school, collegeor university, when each participant in the contests or exhibitions is a bonafide student in the school, college or university.

NRS 467.173 Certainexhibitions of Oriental unarmed self-defense exempted from provisions ofchapter. The provisions of this chapter do notapply to exhibitions of Oriental unarmed self-defense in which no dangerousblow is intended to be struck.

NRS 467.180 Penalty. Any person who shall, directly or indirectly, violate anyof the provisions of this chapter, or the rules or regulations of theCommission, shall be guilty of a misdemeanor.
