He has alleged in the course of those proceedings that he is unable to assist in his defense due to a physical disability. Pursuant to A.O. 9, Rule 25(B), respondent is immediately transferred to disability inactive status pending determination of the incapacity by a PRB hearing panel. The hearing panel assigned by the Board to determine the incapacity may order respondent to be examined by a quali ed medical expert either sua sponte or on motion by Special Disciplinary Counsel.
