CV 17-678 Opinion Delivered: March 8, 2018 APPELLANTS APPEAL FROM THE PULASKI COUNTY CIRCUIT COURT [NO. 60CV-16-3003] BOLL WEEVIL PAWN CO., INC. HONORABLE TIMOTHY FOX APPELLEE SUPPLEMENTAL RECORD ORDERED; SUPPLEMENTAL BRIEFING ORDERED. JOSEPHINE LINKER HART, Justice This is an appeal from an order denying Appellants’ motion for class certification. Appellee asserts in its brief that the transcript from the hearing on Appellants’ motion for class certification is omitted from the record. Appellants respond that no evidence or witness testimony was presented at the hearing on their motion for class certification. However, transcripts of any of “counsel’s statements and arguments [or] colloquies between the court and counsel” that contributed to the circuit court’s decision must be included in the record and abstracted. Ark. Sup. Ct. R. 4-2(a)(5)(A). Based on the record currently before us and the arguments raised on appeal, we order that the record be supplemented with the transcript from the hearing on Appellants’ motion for class certification, that the transcript be abstracted, and that the abstract be included in Appellants’ brief. Supplemental record ordered; supplemental briefing ordered.
