HON. DAVID REYNOLDS, CIRCUIT JUDGE Respondent PETITION MOOT. PER CURIAM Now before us is a pro se petition for writ of mandamus filed in this court on April 14, 2009, by petitioner Mark Holsombach. On February 20, 2007, petitioner filed in the trial court a pro se petition for postconviction relief pursuant to Arkansas Rule of Criminal Procedure 37.1. He contends that the Honorable David Reynolds, respondent herein, has failed to act on the petition in a timely manner. He asks this court to direct the respondent to make a ruling on the Rule 37.1 petition. On April 20, 2009, Judge Reynolds filed a response to the mandamus petition. Appended thereto was a file-marked copy of his order entered on March 13, 2008, that denied the petition. As the court has acted on the Rule 37.1 petition, the instant petition for writ of mandamus is moot. Petition moot.
