PER CURIAM
Appellant John Michael Singleton filed in the circuit court in the county where he was
incarcerated a pro se petition for writ of habeas corpus. The petition was denied, and appellant lodged
an appeal from the order in this court. Now before us is a motion filed by the appellee asking that the
appeal be dismissed for failure to submit a brief.

has not filed a brief nor has he sought leave to file a belated brief. The appellee’s motion is granted
pursuant to Arkansas Supreme Court Rule 4-5 (2009).
