ARKANSAS SUPREME COURT No. CR 08-565 Opinion Delivered September 25, 2008 PRO SE PETITION FOR WRIT OF MANDAMUS [CIRCUIT COURT OF FAULKNER COUNTY, CR 2004-972, CR 2004-1434, CR 2004-1563, CR 20041630, CR 2004-2630, CR 2004-2706] JAMES NELSON Petitioner v. HON. MICHAEL A. MAGGIO, CIRCUIT JUDGE Respondent PETITION MOOT. PER CURIAM Petitioner James Nelson, a prisoner incarcerated in the Arkansas Department of Correction, filed a pro se petition for writ of habeas corpus in Faulkner County Circuit Court on January 28, 2008. On May 13, 2008, petitioner filed in this court a pro se petition for writ of mandamus contending that the Honorable Michael A. Maggio, Circuit Judge, had failed to act in a timely manner on that petition and motions filed related to it. Judge Maggio filed a response to the mandamus petition and attached a copy of his order entered on May 19, 2008, that dismissed the habeas petition. In dismissing the petition, the court disposed of the motions, as well. As the court has acted on the habeas petition and motions, the petition for writ of mandamus is moot. Petition moot. Glaze, J., not participating.
