PER CURIAM
A judgment and commitment order entered March 7, 2003, in Washington County Circuit
Court reflects that appellant David Preston Pardue entered a negotiated plea of guilty to two counts
of aggravated assault and one count of aggravated robbery and received an aggregate sentence of 288
months’ imprisonment. While in custody in Jefferson County, appellant filed a pro se petition for
writ of habeas corpus in Jefferson County Circuit Court on November 28, 2005, which was
dismissed by order entered January 10, 2006. Appellant has lodged an appeal from that order in this
court.
Appellant, who is proceeding pro se, now seeks an extension of time to file the appellant’s
brief. After the motion to extend was timely filed, appellant tendered the brief. The motion for
extension of time to file the appellant’s brief, which is the first such motion filed by appellant in this
appeal, is granted. Our clerk is directed to file the tendered brief as of the date of this opinion.
