John C. Peeler was convicted of capital murder and sentenced to life imprisonment without parole. This court affirmed the judgment. Peeler v. State, 326 Ark. 423, 932 S.W.2d 312 (1996). Peeler's petition for postconviction relief pursuant to Ark. R. Crim. P. 37.1 was denied and this court affirmed in an unpublished opinion. Peeler v. State, CR 97-1571 (Ark. July 1, 1999) (per curiam). Peeler then filed a motion to vacate the judgment of conviction in the trial court, which was treated as a petition for writ of error coram nobis and dismissed. Peeler filed a notice of appeal, and the record has been lodged here on appeal. Appellant Peeler now brings this motion to dismiss that appeal. The motion is granted and the appeal dismissed.
