On July 12, 2005, Willie Wells filed a pro se petition for writ of mandamus in this court contending that the Honorable David Burnett, Circuit Judge, had failed to act in a timely manner on a series of pleadings filed in two cases in the Circuit Court of Crittenden County: in CR 2004-588, petition for writ of habeas corpus filed July 2, 2004, motion for default judgment filed August 3, 2004, and motion for speedy trial filed December 30, 2004; in CR 2005-275, petition for writ of habeas corpus filed May 11, 2005, motion for limitation to reply to habeas petition filed May 11, 2005, motion for discovery filed May 12, 2005, and motion for default judgment filed May 25, 2005.
On July 22, 2005, Judge Burnett filed a response to the mandamus petition in which he said that a hearing on all pleadings filed in the two cases had been scheduled. On August 30, 2005, Judge Burnett entered a final order disposing of all motions and petitions pending in the cases. As the court has acted in the matter, the petition for writ of mandamus is moot.
