DEBRA WILBURN

Petitioner

v.

HON. GARY COTTRELL, CIRCUIT JUDGE

Respondent

Opinion Delivered April 28, 2005

PRO SE PETITION FOR WRIT OF MANDAMUS [CIRCUIT COURT OF CRAWFORD COUNTY, CR 99-199 (I)]

PETITION MOOT

PER CURIAM

On April 5, 2005, Debra Wilburn filed a pro se petition for writ of mandamus in this court pertaining to a motion filed February 24, 2005, in the Circuit Court of Crawford County. In the motion Wilburn, who was serving a term of imprisonment, sought credit against her sentence for time served in custody in a county detention facility. It is not clear whether petitioner is alleging in the mandamus petition that the respondent Circuit Judge Gary Cottrell had failed to act in a timely manner on the motion or is seeking a writ from this court to compel Judge Cottrell to grant the relief sought in the motion.

Judge Cottrell subsequently provided this court with a copy of an order that had been entered March 14, 2005, that disposed of the motion. As the court has acted in the matter, the petition for writ of mandamus is moot.

Petition moot.
