Millard Russey filed a petition for writ of mandamus in this court contending that the Honorable John Thomas, Circuit Judge, had failed to act within a reasonable time on a motion to vacate judgment filed in the Circuit Court of Clark County on November 26, 2003. On May 24, 2004, Judge Thomas entered an order disposing of the motion to vacate judgment. As the circuit court has acted in the matter, the petition for writ of mandamus is moot.
