Jarvis Rhodes filed a petition for writ of mandamus in this court contending that the Honorable Fred Davis, Circuit Judge, had failed to act within a reasonable time on a petition for writ of habeas corpus pursuant to Act 1780 of 2001 that was filed in the Circuit Court of Jefferson County on October 15, 2002. Petitioner Rhodes now asks that the petition for writ of mandamus be dismissed.

Motion granted.
