MICHAEL LENZ

Petitioner

v.

HONORABLE DAVID L. REYNOLDS, JUDGE

Respondent

CR 03-376

PRO SE MOTION FOR PHOTOCOPY OF MATERIAL PERTAINING TO PETITION FOR WRIT OF MANDAMUS AT PUBLIC EXPENSE [CIRCUIT COURT OF FAULKNER COUNTY, NO. CR 96-1122, CR 96-1195, CR 96-1268, CR 97-773]

MOTION DENIED

Per Curiam

Michael Lenz filed a petition for writ of mandamus in this court contending that the Honorable David L. Reynolds, Circuit Judge, had failed to act within a reasonable time on a petition for writ of error coram nobis that was filed in the Circuit Court of Faulkner County. Judge Reynolds subsequently entered an order disposing of the petition for writ of error coram nobis, and we held the mandamus petition to be moot. Lenz v. Reynolds, J., CR 03-376 (September 11, 2003) (per curiam).

Petitioner Lenz now seeks at public expense a copy of all written material related to the petition for writ of mandamus so that he may perfect an appeal of the order denying the petition for writ of error coram nobis. It appears that petitioner may have misconstrued the prevailing rules of procedure for perfecting an appeal inasmuch as the mandamus proceeding in this court is not a part of the record on appeal from the coram nobis order. The material necessary to the record to appeal the order is contained entirely in the circuit clerk's file.

Motion denied.
