2005 Washington Revised Code RCW 16.65.440: Penalty (as amended by 2003 c 326).

    Any person who ((shall)) violates any provisions or requirements of this chapter or rules ((and regulations)) adopted by the director ((pursuant to)) under this chapter ((shall be deemed)) is guilty of a gross misdemeanor((; and any subsequent violation thereafter shall be deemed a gross misdemeanor)).

      (1) Except as provided in subsection (2) of this section, any person who ((shall)) violates any provisions or requirements of this chapter or rules and regulations adopted by the director pursuant to this chapter ((shall be deemed)) is guilty of a misdemeanor((; and any)).

           (2) A second or
      subsequent violation ((thereafter shall be deemed)) is a gross misdemeanor.
