2006 Ohio Revised Code - 5112.99. Effective until 10-16-07.

§ 5112.99. Penalties.
 

(A)  The director of job and family services shall impose a penalty of one hundred dollars for each day that a hospital fails to report the information required under section 5112.04 of the Revised Code on or before the dates specified in that section. 

(B)  In addition to any other remedy available to the department of job and family services under law to collect unpaid assessments and transfers, the director shall impose a penalty of ten per cent of the amount due, not to exceed twenty thousand dollars, on any hospital that fails to pay assessments or make intergovernmental transfers by the dates required by rules adopted under section 5112.03 of the Revised Code. 

(C)  The director shall waive the penalties provided for in divisions (A) and (B) of this section for good cause shown by the hospital. 

(D)  All penalties imposed under this section shall be deposited into the general revenue fund.

SECTION 213. The amendment by this act of section 5112.99 of the Revised Code is not intended to supersede the earlier repeal, with delayed effective date, of that section.

Effect of Amendments

150 v H 95, effective September 26, 2003, in (A), deleted "of one hundred dollars" following "a penalty", and added the last sentence; deleted "not to exceed twenty thousand dollars" following "amount due" in (B); and substituted "health care administration fund created by section 5111.94 of the Revised Code" for "general revenue fund" in (D).
