2006 Ohio Revised Code - 101.84. Effective until 12-31-10.

§ 101.84. Sunset review committee.
 

(A)  There is hereby created the sunset review committee, to be composed of nine members and function in calendar years 2009 and 2010. The president of the senate shall appoint three members of the senate to the committee, not more than two of whom shall be members of the same political party. The speaker of the house of representatives shall appoint three members of the house of representatives to the committee, not more than two of whom shall be members of the same political party. The governor, with the advice and consent of the senate, shall appoint three members to the committee, not more than two of whom shall be members of the same political party. Members shall be appointed within fifteen days after the commencement of the first regular session of the 128th general assembly. 

(B)  Each member of the committee who is appointed by the president of the senate or the speaker of the house of representatives shall serve during that committee member's term of office or until that committee member no longer is a member of the senate or the house of representatives, whichever is applicable. Each member of the committee who is appointed by the governor shall serve a two-year term that ends on the thirty-first day of December in 2010. A vacancy on the committee shall be filled in the same manner as the original appointment. 
 

In the first regular session of the 128th general assembly, the chairperson of the committee shall be a member of the house of representatives, and the vice-chairperson of the committee shall be a member of the senate. In the second regular session of the 128th general assembly, the chairperson of the committee shall be a member of the senate, and the vice-chairperson of the committee shall be a member of the house of representatives. 
 

Members of the committee shall receive no compensation, but shall be reimbursed for their necessary expenses incurred in the performance of their official duties. 

(C)  The committee shall meet not later than thirty days after the first day of the first regular session of the 128th general assembly to choose a chairperson and to commence establishment of the schedule for agency review provided for in section 101.85 of the Revised Code or perform other committee duties under sections 101.82 to 101.87 of the Revised Code. Five members of the committee shall constitute a quorum for the conduct of committee business.

The provisions of § 12 of HB 548 (148 v  - ) read as follows: 

SECTION 12. Sections 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, and 11 of this act shall take effect on January 1, 2001. 

 

Effect of Amendments

151 v S 124, effective June 27, 2005, confirmed the amendment by 150 v H 516. 

150 v H 516, effective December 30, 2004, in (A), added "and function in calendar years 2009 and 2010" to the end of the first sentence, and substituted "the 128th" for "each"; in (B), substituted "during that committee member's term of office" for "until that committee member's successor is appointed" and "in 2010" for "of each even-numbered year"; and inserted "128th" twice in the second paragraph of (B) and once in (C), and made related changes.
