GENERAL PROVISIONS

NRS 486.011 Definitions. As used in NRS 486.011to 486.381, inclusive, unless thecontext otherwise requires, the words and terms defined in NRS 486.031 to 486.057, inclusive, have the meaningsascribed to them in those sections.

NRS 486.031 Highwaydefined. Highway means the entire width betweenthe boundary lines of every way maintained by a public authority when any partthereof is open to the use of the public for purposes of vehicular traffic.

NRS 486.038 Mopeddefined. Moped means a vehicle which looksand handles essentially like a bicycle and is propelled by a small engine whichproduces not more than 2 gross brake horsepower and which has a displacement ofnot more than 50 cubic centimeters, and:

1. Is designed to travel on not more than three wheelsin contact with the ground but is not a tractor; and

2. Is capable of a maximum speed of not more than 30miles per hour on a flat surface with not more than 1 percent grade in anydirection when the motor is engaged.

NRS 486.041 Motorcycledefined. Motorcycle means every motor vehicleequipped with a seat or a saddle for the use of the driver and designed totravel on not more than three wheels in contact with the ground, including apower cycle but excluding a tractor and a moped.

NRS 486.051 Mufflerdefined. Muffler means a device consistingof a series of chambers or baffle plates, or other mechanical design, for thepurpose of receiving exhaust gas from an internal combustion engine, and iseffective in reducing noise, but does not include such a device equipped withan apparatus which permits the exhaust gas to be discharged directly into theair without passing through such device.

NRS 486.055 Programdefined. Program means the Program for theEducation of Motorcycle Riders.

NRS 486.057 Trimobiledefined. Trimobile means every motor vehicledesigned to travel with three wheels in contact with the ground, two of whichare power driven.

DRIVERS LICENSES

NRS 486.061 Licenserequired to operate motorcycle or trimobile; exception. Except for a nonresident who is at least 16 years of ageand is authorized by the state of his residency to drive a motorcycle, a personshall not drive:

1. A motorcycle, except a trimobile, upon a highwayunless that person holds a valid motorcycle drivers license issued pursuant toNRS 486.011 to 486.381, inclusive, or a drivers licenseissued pursuant to chapter 483 of NRS endorsedto authorize the holder to drive a motorcycle.

2. A trimobile upon a highway unless that person holdsa valid motorcycle drivers license issued pursuant to NRS 486.011 to 486.381, inclusive, or a drivers licenseissued pursuant to chapter 483 of NRS.

NRS 486.071 Qualificationsfor license. Except as otherwise provided in NRS 486.161, the Department shall not issuea motorcycle drivers license unless the applicant:

1. Is at least 16 years of age; and

2. Has successfully completed:

(a) Such written examination and driving test as may berequired by the Department; or

(b) A course of motorcycle safety approved by theDepartment.

NRS 486.081 Applicationfor license: Form; verification; contents; proof of name and age; proof ofsocial security number; authority of Department to refuse to accept certaindocuments; regulations; consular identification cards.

1. Every application for a motorcycle drivers licensemust be made upon a form furnished by the Department and must be verified bythe applicant before a person authorized to administer oaths. Officers andemployees of the Department may administer those oaths without charge.

2. Every application must:

(a) State the full name, date of birth, sex andresidence address of the applicant;

(b) Briefly describe the applicant;

(c) State whether the applicant has previously beenlicensed as a driver, and, if so, when and by what state or country;

(d) State whether any such license has ever beensuspended or revoked, or whether an application has ever been refused, and, ifso, the date of and reason for such suspension, revocation or refusal; and

(e) Give such other information as the Departmentrequires to determine the competency and eligibility of the applicant.

3. Except as otherwise provided in subsections 5, 6and 7, every applicant shall furnish proof of his name and age by displaying anoriginal or certified copy of at least one of the following documents:

(a) If he was born in the United States, including,without limitation, the District of Columbia or any territory of the UnitedStates:

(1) A birth certificate issued by a state, apolitical subdivision of a state, the District of Columbia or any territory ofthe United States;

(2) A drivers license issued by another state,the District of Columbia or any territory of the United States;

(3) A passport issued by the United StatesGovernment;

(4) A military identification card or militarydependent identification card issued by any branch of the Armed Forces of theUnited States;

(5) For persons who served in any branch of theArmed Forces of the United States, a report of separation;

(6) A Certificate of Degree of Indian Bloodissued by the United States Government; or

(7) Such other documentation as specified by theDepartment by regulation; or

(b) If he was born outside the United States:

(1) A Certificate of Citizenship, Certificate ofNaturalization, Permanent Resident Card or Temporary Resident Card issued bythe Bureau of Citizenship and Immigration Services;

(2) A Consular Report of Birth Abroad issued bythe Department of State;

(3) A drivers license issued by another state,the District of Columbia or any territory of the United States;

(4) A passport issued by the United StatesGovernment; or

(5) Any other proof acceptable to the Departmentother than a passport issued by a foreign government.

4. Every applicant who has been assigned a socialsecurity number must furnish proof of his social security number by displaying:

(a) An original card issued to the applicant by theSocial Security Administration bearing the social security number of theapplicant; or

(b) Other proof acceptable to the Department,including, without limitation, records of employment or federal income taxreturns.

5. The Department may refuse to accept a driverslicense issued by another state, the District of Columbia or any territory ofthe United States if the Department determines that the other state, theDistrict of Columbia or the territory of the United States has less stringentstandards than the State of Nevada for the issuance of a drivers license.

6. With respect to any document described in paragraph(b) of subsection 3, the Department may:

(a) If the document has expired, refuse to accept thedocument or refuse to issue a drivers license to the person presenting thedocument, or both; and

(b) If the document specifies a date by which theperson presenting the document must depart from the United States, issue to theperson presenting the document a drivers license that expires on the date onwhich the person is required to depart from the United States.

7. The Director shall adopt regulations setting forthcriteria pursuant to which the Department will issue or refuse to issue adrivers license in accordance with this section to a person who is a citizenof a foreign country. The criteria must be based upon the purpose for whichthat person is present within the United States.

8. Notwithstanding any other provision of thissection, the Department shall not accept a consular identification card asproof of the age or identity of an applicant for a motorcycle drivers license.As used in this subsection, consular identification card has the meaningascribed to it in NRS 232.006.

NRS 486.084 Paymentof child support: Statement by applicant for license; grounds for denial oflicense; duty of Department. [Expires by limitation on the date of the repealof the federal law requiring each state to establish procedures forwithholding, suspending and restricting the professional, occupational andrecreational licenses for child support arrearages and for noncompliance withcertain processes relating to paternity or child support proceedings.]

1. An applicantfor the issuance or renewal of a motorcycle drivers license shall submit tothe Department the statement prescribed by the Division of Welfare andSupportive Services of the Department of Health and Human Services pursuant to NRS 425.520. The statement must becompleted and signed by the applicant.

2. The Department shall include the statement requiredpursuant to subsection 1 in:

(a) The application or any other forms that must besubmitted for the issuance or renewal of the license; or

(b) A separate form prescribed by the Department.

3. A motorcycle drivers license may not be issued orrenewed by the Department if the applicant:

(a) Fails to submit the statement required pursuant tosubsection 1; or

(b) Indicates on the statement submitted pursuant tosubsection 1 that he is subject to a court order for the support of a child andis not in compliance with the order or a plan approved by the district attorneyor other public agency enforcing the order for the repayment of the amount owedpursuant to the order.

4. If an applicant indicates on the statementsubmitted pursuant to subsection 1 that he is subject to a court order for thesupport of a child and is not in compliance with the order or a plan approvedby the district attorney or other public agency enforcing the order for therepayment of the amount owed pursuant to the order, the Department shall advisethe applicant to contact the district attorney or other public agency enforcingthe order to determine the actions that the applicant may take to satisfy thearrearage.

NRS 486.091 Applicationfrom person previously licensed in another state; copy of record from otherstate becomes part of Nevada record; Department to furnish records to otherstates.

1. Whenever an application for a motorcycle drivers licenseis received from a person previously licensed in another state, the Departmentshall request a copy of the drivers record from such other state. Whenreceived, the drivers record shall become a part of the drivers record inthis State with the same effect as though entered on the drivers record inthis State in the original instance.

2. Whenever the Department receives a request for adrivers record from another licensing state the record shall be forwardedwithout charge.

NRS 486.101 Applicationof minors.

1. The application of any person under the age of 18years for a motorcycle drivers license must be signed and verified, before aperson authorized to administer oaths, by either or both the father or motherof the applicant, if either or both are living and have custody of him, or if neitherparent is living, then by the guardian having custody, or by an employer of theminor, or if there is no guardian or employer, then by any responsible personwho is willing to assume the obligation imposed pursuant to NRS 486.011 to 486.381, inclusive, upon a person signingthe application of a minor.

2. Any negligence or willful misconduct of a minorunder the age of 18 years when driving a motorcycle upon a highway is imputedto the person who signed the application of the minor for a license. Thatperson is jointly and severally liable with the minor for any damages caused bynegligence or willful misconduct.

NRS 486.111 Releasefrom liability. Any person who has signed theapplication of a minor for an instruction permit or license may thereafter filewith the Department a verified written request that the permit or license ofthe minor so granted be cancelled. Thereupon, the Department shall cancel thepermit or license of the minor, and the person who signed the application ofthe minor is relieved from the liability imposed pursuant to NRS 486.011 to 486.381, inclusive, by reason of havingsigned such application on account of any subsequent negligence or willful misconductof such minor in driving a motorcycle.

NRS 486.121 Cancellationof license upon death of person signing minors application. The Department, upon receipt of satisfactory evidence ofthe death of the persons who signed the application of a minor for a license,shall cancel the license and shall not issue a new license until a newapplication, signed and verified, is made as required by NRS 486.011 to 486.381, inclusive. This provision does notapply if the minor has attained the age of 18 years.

NRS 486.131 Examinationof applicants.

1. The Department may require every applicant for amotorcycle drivers license to submit to an examination conducted by theDepartment or successfully complete a course of motorcycle safety approved bythe Department.

2. An examination may be held in the county where theapplicant resides within 30 days after the date application is made and mayinclude:

(a) A test of the applicants ability to understandofficial devices used to control traffic;

(b) A test of his knowledge of practices for safedriving and the traffic laws of this State;

(c) Except as otherwise provided in a regulationadopted pursuant to subsection 2 of NRS483.330, a test of his eyesight; and

(d) An actual demonstration of his ability to exerciseordinary and reasonable control in the operation of a motorcycle.

Theexamination may also include such further physical and mental examination asthe Department finds necessary to determine the applicants fitness to drive amotorcycle safely upon the highways.

NRS 486.141 Formfor application. Every application for aninstruction permit or drivers license under the provisions of NRS 486.011 to 486.381, inclusive, must be made upon aform furnished by the Department. There must be no charge for the making andfiling of the application.

NRS 486.161 Expirationand renewal of license. [Effective until the date of the repeal of the federallaw requiring each state to establish procedures for withholding, suspendingand restricting the professional, occupational and recreational licenses for childsupport arrearages and for noncompliance with certain processes relating topaternity or child support proceedings.]

1. Except as otherwise provided in subsection 4, everymotorcycle drivers license expires on the fourth anniversary of the licenseesbirthday, measured in the case of an original license, a renewal license or alicense renewing an expired license, from the birthday nearest the date ofissuance or renewal. Any applicant whose date of birth is February 29 is, forthe purposes of NRS 486.011 to 486.381, inclusive, considered to have theanniversary of his birth fall on February 28.

2. Every license is renewable at any time before itsexpiration upon application, submission of the statement required pursuant to NRS 486.084 and payment of the requiredfee. Every motorcycle endorsement to a drivers license issued on or afterJanuary 1, 1972, expires simultaneously with the expiration of the driverslicense.

3. Except as otherwise provided in subsection 1 of NRS 483.384, each applicant for renewalmust appear before an examiner for a drivers license and successfully pass atest of his eyesight.

4. Any person who has been issued a drivers licensewithout having the authority to drive a motorcycle endorsed thereon must,before driving a motorcycle, successfully pass:

(a) A driving test conducted by the Department; or

(b) A course of motorcycle safety approved by theDepartment,

and have theauthority endorsed upon his license.

1. NRS 486.165 Suspensionof license for failure to pay child support or comply with certain subpoenas orwarrants; reinstatement of license. [Expires by limitation on the date of therepeal of the federal law requiring each state to establish procedures for withholding,suspending and restricting the professional, occupational and recreationallicenses for child support arrearages and for noncompliance with certainprocesses relating to paternity or child support proceedings.]

1. The Department shall, upon receiving notificationfrom a district attorney or other public agency collecting support for childrenpursuant to NRS 425.510 that a court hasdetermined that a person who has been issued a motorcycle drivers license:

(a) Has failed to comply with a subpoena or warrantrelating to a proceeding to establish paternity or to establish or enforce anobligation for the support of a child; or

(b) Is in arrears in the payment for the support of oneor more children,

send a writtennotice to that person that his motorcycle drivers license is subject tosuspension.

2. The notice must include:

(a) The reason for the suspension of the license;

(b) The information set forth in subsections 3 and 4;and

(c) Any other information the Department deemsnecessary.

3. If a person who receives a notice pursuant tosubsection 1 does not, within 30 days after he receives the notice, comply withthe subpoena or warrant or satisfy the arrearage as required in NRS 425.510, the Department shall suspendhis license without providing him with an opportunity for a hearing.

4. The Department shall reinstate a license suspendedpursuant to this section if it receives a notice from the district attorney orother public agency pursuant to NRS 425.510that the person has complied with the subpoena or warrant or has satisfied thearrearage pursuant to that section.

NRS 486.171 Permittingunauthorized person to drive. A person shallnot authorize or knowingly permit a motorcycle, except a trimobile, owned byhim or under his control to be driven upon any highway by any person who is notauthorized pursuant to NRS 486.011 to 486.381, inclusive, to drive a motorcycle.

OPERATION AND EQUIPMENT

NRS 486.181 Carryingpassengers.

1. A motorcycle or moped shall not be driven upon ahighway while carrying more than one person unless such motorcycle or moped isdesigned by the manufacturer to carry more than one person.

2. A passenger shall ride:

(a) Behind the driver and astride the permanent orregular seat which was designed for two persons;

(b) Astride another seat firmly attached at the rear ofthe driver; or

(c) In a sidecar attached.

3. Every such motorcycle or moped designed fortransporting a passenger shall be equipped with footrests adjusted to fit suchpassenger.

NRS 486.191 Driversposition while operating.

1. A person driving a motorcycle or moped shall rideonly upon the permanent and regular seat attached thereto.

2. A person shall not drive a motorcycle or moped withthe seat for the driver so positioned that the driver, when sitting astride theseat with the motorcycle or moped in a stopped and upright position, cannotreach the ground with both feet simultaneously.

NRS 486.201 Heightof handlebar. A person shall not drive amotorcycle or moped equipped with handlebars which extend above the uppermostportion of the drivers shoulders when the driver sits on the seat and the seatis depressed by the weight of the driver.

NRS 486.211 Positionof drivers hands. The driver of a motorcycleor moped shall drive with at least one hand on a handlebar at all times.

NRS 486.221 Fendersrequired while in operation. A person shallnot drive a motorcycle or moped unless the wheels are protected by fenders toprevent the throwing of rocks, dirt, water or other substances to the rear.

NRS 486.231 Protectiveheadgear and glasses: Standards; when use required.

1. The Department shall adopt standards for protectiveheadgear and protective glasses, goggles or face shields to be worn by thedrivers and passengers of motorcycles and transparent windscreens formotorcycles.

2. Except as provided in this section, when anymotorcycle, except a trimobile or moped, is being driven on a highway, thedriver and passenger shall wear protective headgear securely fastened on thehead and protective glasses, goggles or face shields meeting those standards.Drivers and passengers of trimobiles shall wear protective glasses, goggles orface shields which meet those standards.

3. When a motorcycle or a trimobile is equipped with atransparent windscreen meeting those standards, the driver and passenger arenot required to wear glasses, goggles or face shields.

4. When a motorcycle is being driven in a paradeauthorized by a local authority, the driver and passenger are not required towear the protective devices provided for in this section.

5. When a three-wheel motorcycle, on which the driverand passengers ride within an enclosed cab, is being driven on a highway, thedriver and passengers are not required to wear the protective devices requiredby this section.

NRS 486.241 Protectiveheadgear and glasses: Sale or distribution.

1. A person shall not sell, offer for sale ordistribute any protective headgear, glasses, goggles or face shields for use byany drivers or passengers of motorcycles or transparent windscreens formotorcycles unless the equipment is of a type and specification meeting thestandards therefor adopted by the Department.

2. The provisions of this section do not prohibit thesale of protective headgear, glasses, goggles or face shields which comply withthe rules and regulations adopted by the United States Department ofTransportation.

NRS 486.251 Useof head lamps, stop lights and turn signals required.

1. Every motorcycle or moped operated upon a highwayof this State at any time from one-half hour after sunset to one-half hourbefore sunrise and at any other time when, because of insufficient light orunfavorable atmospheric conditions, persons and vehicles on the highway are notclearly discernible at a distance of 1,000 feet ahead must display lightedlamps and illuminating devices as respectively required pursuant to NRS 486.011 to 486.381, inclusive.

2. Every motorcycle or moped operated upon a highwaymust be equipped with stop lights to be lighted in the manner prescribed forthe use of such devices.

NRS 486.261 Taillamps.

1. Except as otherwise provided in subsection 3, everymotorcycle or moped must be equipped with at least one tail lamp mounted on therear, which, when lighted as required by NRS486.011 to 486.381, inclusive, emitsa red light plainly visible from a distance of 500 feet to the rear.

2. The tail lamp must be wired to be lighted wheneverthe head lamp is lighted.

3. The tail lamp on a motorcycle may contain a blueinsert that does not exceed 1 inch in diameter.

NRS 486.271 Turnsignals.

1. Every motorcycle manufactured after January 1,1973, which is sold or offered for sale and which is intended to be operatedupon the highways of this State shall be equipped with electric turn signallamps.

2. Such lamps shall be located on the front and rearand shall indicate an intention to turn by flashing lights in the directiontoward which the turn is to be made.

3. The lamps showing to the front shall be mounted onthe same level and as widely spaced laterally as practicable and, when signaling,shall emit white or amber light, or any shade of light between white and amber.

4. The lamps showing to the rear shall be mounted onthe same level and as widely spaced laterally as practicable, and, whensignaling, shall emit red or amber light, or any shade of light between red andamber.

NRS 486.281 Headlamps.

1. Every motorcycle or moped shall be equipped with atleast one and not more than two head lamps.

2. Every such head lamp on a motorcycle shall belocated at a height of not more than 54 inches nor less than 24 inches from theground as measured from the center of the lamp to the level ground upon whichsuch motorcycle stands without a load.

NRS 486.291 Reflectors.

1. Every motorcycle or moped shall carry on the rearat least one reflector, which shall be mounted at a height not less than 20inches nor more than 60 inches from the ground as measured from the center ofthe reflector to the level ground upon which such motorcycle or moped standswithout a load.

2. Each such reflector shall be of a size andcharacter and so mounted as to be visible at night from all distances within300 feet when directly in front of lawful lower beams of head lamps.

NRS 486.301 Brakes. Every motorcycle or moped shall be equipped with brakesadequate to control the stopping and holding as prescribed in NRS 484.593 and 484.595.

NRS 486.311 Mirrors. Every motorcycle or moped shall be equipped with twomirrors, each containing a reflection surface not less than 3 inches indiameter, with one mirror mounted on each handlebar, in positions enabling thedriver to view clearly the highway for a distance of 200 feet to the rear.

NRS 486.331 Rightsand duties of drivers. A person driving amotorcycle or moped upon a highway is entitled to all the rights and subject toall the duties applicable to the drivers of motor vehicles as provided by law,except those provisions which by their nature can have no application.

NRS 486.341 Rightto full use of traffic lane. Every motorcycleor moped when being driven on the highway is entitled to full use of thetraffic lane it is occupying, and a person shall not drive another motorvehicle in a manner which would deprive any such motorcycle or moped of suchuse.

NRS 486.351 Unlawfulpassing; driving abreast.

1. A person, except a police officer in theperformance of his duty, shall not drive a motorcycle or moped between movingor stationary vehicles occupying adjacent traffic lanes.

2. Except as provided in subsection 3, a person shallnot drive a motorcycle, moped or trimobile abreast of or overtake or passanother vehicle within the same traffic lane.

3. Motorcycles and mopeds may, with the consent of thedrivers, be operated no more than two abreast in a single traffic lane.

NRS 486.361 Driverslicense to be surrendered on demand. Every persondriving a motorcycle shall manually deliver his license to drive a motorcycleto any police officer or court upon request therefor by such officer or court.

EDUCATION AND SAFETY OF MOTORCYCLE RIDERS

NRS 486.363 Definitions. As used in NRS 486.363to 486.377, inclusive, unless thecontext otherwise requires, the words and terms defined in NRS 486.365, 486.367 and 486.370 have the meanings ascribed to themin those sections.

NRS 486.365 Departmentdefined. Department means the Department ofPublic Safety.

NRS 486.370 Motorcycledoes not include trimobile. Motorcycle doesnot include a trimobile.

NRS 486.372 Programfor Education of Motorcycle Riders: Establishment; Administrator; consultationwith Advisory Committee; approval of courses of instruction; rules andregulations; contracts for services; Account to pay expense of Program.

1. The Director shall:

(a) Establish the Program.

(b) Appoint an Administrator to carry out the Program.

(c) Consult regularly with the Advisory Committee forMotorcycle Safety concerning the content and implementation of the Program.

(d) Approve courses of instruction provided by publicor private organizations which comply with the requirements established for theProgram.

(e) Adopt rules and regulations which are necessary tocarry out the Program.

2. The Director may contract for the provision ofservices necessary for the Program.

3. The money in the Account for the Program for theEducation of Motorcycle Riders may be used only to pay the expenses of theProgram, including reimbursement to instructors licensed pursuant to NRS 486.375 for services provided for theProgram. The interest and income earned on the money in the Account, afterdeducting any applicable charges, must be credited to the Account.

NRS 486.373 Programfor Education of Motorcycle Riders: Eligibility; fee.

1. A resident of this State who holds a motorcycledrivers license or a motorcycle endorsement to a drivers license or who iseligible to apply for such a license or endorsement may enroll in the Program.

2. The Director shall establish a fee of not more than$100 for the Program.

NRS 486.374 Programfor Education of Motorcycle Riders: Instructor; course of instruction. The Program must:

1. Be taught by an instructor licensed pursuant to NRS 486.375.

2. Include:

(a) Instruction relating to the development of properhabits and skills necessary for the safe operation of a motorcycle;

(b) Instruction relating to the effects of alcohol andcontrolled substances on the operator of a motorcycle; and

(c) At least 8 hours of instruction in the actualoperation of a motorcycle for inexperienced operators and at least 4 hours ofinstruction in the actual operation of a motorcycle for experienced operators.

3. Each course of instruction must be approved by theDirector before it is offered to persons enrolled in the Program. The Directorshall not approve any course of instruction which does not meet or exceed therequirements established for courses for the education of motorcycle riders bynationally recognized public or private organizations approved by the Director.

NRS 486.375 Qualificationsof instructor; standards for licensing instructors.

1. A person who:

(a) Is a resident of this State or is a member of theArmed Forces of the United States stationed at a military installation locatedin Nevada;

(b) Is at least 21 years old;

(c) Holds a motorcycle drivers license or a motorcycleendorsement to a drivers license issued by the Department;

(d) Has held a motorcycle drivers license orendorsement for at least 2 years; and

(e) Is certified as an instructor of motorcycle ridersby a nationally recognized public or private organization which is approved bythe Director,

may apply tothe Department for a license as an instructor for the Program.

2. The Department shall not license a person as aninstructor if, within 2 years before he submits his application for a license:

(a) He has accumulated three or more demerit pointspursuant to the uniform system of demerit points established pursuant to NRS 483.473, or has been convicted oftraffic violations of comparable number and severity in another jurisdiction;or

(b) His drivers license was suspended or revoked inany jurisdiction.

3. The Director shall adopt standards and proceduresfor the licensing of instructors for the Program.

NRS 486.376 AdvisoryBoard on Motorcycle Safety: Creation; appointment of members; terms; Chairman;meetings; vacancy; removal; reimbursement.

1. The Advisory Board on Motorcycle Safety, consistingof five members appointed by the Governor, is hereby created.

2. The Governor shall appoint to the Board:

(a) One member who is a retail motorcycle dealer;

(b) One member who is a peace officer and operates amotorcycle in carrying out his duties;

(c) One member who is an instructor licensed pursuantto NRS 486.375; and

(d) Two members of the general public with experienceoperating a motorcycle. Not more than one of the members of the general publicmay be a commercial dealer, distributor or manufacturer of motorcycles.

3. After the initial terms, the members of theAdvisory Board on Motorcycle Safety serve terms of 3 years. No member of theBoard may serve more than two consecutive terms.

4. The Board shall elect a Chairman from among itsmembers.

5. The Board shall meet at least twice each year andmay meet upon a call of the Chairman.

6. If a vacancy occurs during the term of a member,the Governor shall appoint a person similarly qualified to replace that memberfor the remainder of the unexpired term.

7. The Governor may remove a member from the Board ifthe member neglects his duty or commits malfeasance in office.

8. Members of the Board serve without compensation butare entitled to receive reimbursement from the Account for the Program for theEducation of Motorcycle Riders for the actual amounts of their reasonable andnecessary expenses while engaged in the business of the Board.

NRS 486.377 AdvisoryBoard on Motorcycle Safety: Duties.

1. The Board shall:

(a) Advise and assist the Director and theAdministrator of the Program in developing, establishing and maintaining theProgram;

(b) Regularly review the Program and makerecommendations to the Director and the Administrator of the Program relatingto the administration and content of the Program; and

(c) Submit a report, not later than January 1 of eachodd-numbered year, to the Governor and the Director of the Legislative CounselBureau for presentation to the Legislature.

2. The report must include:

(a) The number of courses offered in the Program.

(b) The address of each location where a course wasoffered.

(c) The number of instructors licensed pursuant to NRS 486.375.

(d) The number of persons who have completed theProgram in the preceding 2 years and the number of persons who have completedthe Program since it was established.

(e) The amount of fees for motorcycle safety collectedpursuant to subsection 4 of NRS 482.480.

(f) A detailed accounting of the expenses of theProgram.

3. The Director shall make copies of the reportavailable for distribution to the public.

PENALTIES

NRS 486.381 Violationof provisions concerning motorcycles and similar vehicles. Any person violating any provisions of NRS 486.011 to 486.361, inclusive, is guilty of amisdemeanor.
