Case No. 20020246-CA

F I L E D
(June 19, 2003)

2003 UT App 209

-----

Third District, Salt Lake Department

The Honorable Timothy R. Hanson

Attorneys: Margaret Prim Lindsay and Patrick V. Lindsay, Provo, for Appellant

Mark L. Shurtleff and Joanne C. Slotnik, Salt Lake City, for Appellee

-----

Before Judges Jackson, Greenwood, and Orme.

PER CURIAM:

This case is before the court on the State's motion to dismiss the appeal for lack of jurisdiction. Appellant Louis William Morresi concedes that the motion to withdraw his guilty plea was filed more than thirty days after entry of judgment and that this court lacks jurisdiction to consider the issues raised in this appeal. See State v. Reyes, 2002 UT 13,¶¶3-5, 40 P.3d 630; State v. Ostler, 2001 UT 68,¶13, 31 P.3d 528. Morresi further concedes that this court should grant the State's motion to dismiss.

We dismiss the appeal for lack of jurisdiction.
