Case No. 20020753-CA

F I L E D
November 29, 2002 2002 UT App 400 -----

Original Proceeding in this Court

Attorneys:
Shaun Mann, Kaysville, Petitioner Pro Se
Thomas Patterson, Salt Lake City, for Respondent -----

Before Judges Billings, Bench, and Thorne.

PER CURIAM:

Petitioner seeks review of the Workforce Services Appeals Board's denial of unemployment benefits. The final decision of the agency was issued on August 21, 2002. A petition for review was filed in this court on September 23, 2002, beyond the thirty days allowed for filing a petition for review of an agency decision. See Utah R. App. P. 14(a). Petitioner does not dispute that his petition was untimely. Instead, he argues that compelling reasons justify acceptance of the late petition by this court.

However, timely filing of a petition for review of an agency decision is necessary to confer jurisdiction upon this court. See Silva v. Department of Employment Sec., 786 P.2d 246, 247 (Utah Ct. App. 1990). Moreover, this court has no authority to extend the deadline for filing of a petition.

The petition is dismissed for lack of jurisdiction.
