City Department
The Honorable Jeffrey R. Burbank
Attorneys:
Kevin McGaha and Justin C. Bond,
Brigham City, for Appellant
Jan Graham and Carol L.C. Verdoia,
Salt Lake City, for Appellee
-----
Before Judges Greenwood, Billings, and Davis.
PER CURIAM:
Pursuant to Utah R. App. P. 4(a) a notice of appeal must be filed "with the clerk of the trial court within 30 days after the date of entry of the judgment or order appealed from." The judgment from which appellant seeks to appeal was entered on January 12, 1999. Pursuant to Utah R. App. P. 4(a), the deadline for filing an appeal from this order was February 11, 1999. The notice of appeal was not filed until February 16, 1999. Because appellant's notice of appeal was not timely filed, we have no alternative but to dismiss the appeal for lack of jurisdiction.
See Varian-Eimac v. Lamoreaux,
767 P.2d 569, 670 (Utah Ct. App. 1989).
