OPINION Applicant pleaded guilty to aggravated assault and evading arrest and was sentenced to twenty years and ten years’ imprisonment. Applicant filed these applications for writs of habeas corpus in the county of conviction, and the district clerk forwarded them to this Court. See TEX . CODE CRIM . PROC . art. 11.07. Applicant contends that plea was involuntary because trial counsel failed to properly investigate and the State withheld favorable evidence from the defense. Based on the record, the trial court has determined that Applicant’s plea was involuntary and the State withheld favorable evidence from the defense. The State agrees that relief should be granted. Relief is granted. Brady v. United States, 397 U.S. 742 (1970); Ex parte Kimes, 872 S.W.2d 2 700, 702-703 (Tex. Crim. App. 1993). The judgments in cause numbers D-18-2471-CR & D-182472-CR in the 358th District Court of Ector County are set aside, and Applicant is remanded to the custody of the Sheriff of Ector County to answer the charges as set out in the indictments. The trial court shall issue any necessary bench warrant within ten days from the date of this Court’s mandate. Copies of this opinion shall be sent to the Texas Department of Criminal Justice–Correctional Institutions Division and the Board of Pardons and Paroles. Delivered: September 15, 2021 Do not publish
