¶0 Appeal and Error - Dismissal of Appeal Where not Perfected Within Six Months.
Where a motion to dismiss is filed upon the ground that the appeal is not filed in the Supreme Court within the six months provided by statute, and, after a response is called for, the motion is not contested, and the record together with the authorities cited reasonably support the motion, the appeal will be dismissed.

Appeal from District Court, Ottawa County; Dennis H. Wilson, Judge.

Action by Lawrence E. Holt against J. Sam Brown. From a judgment for plaintiff, defendant appeals. Dismissed.

¶1 The journal entry and the record show that this cause was disposed of on the 25th day of February, 1933, upon an agreed statement of facts. The defendant in error has filed motion to dismiss for the reason the appeal from the judgment of the court was not filed in this court within six months from the date of the judgment rendered. The movant cites in support thereof Durant et al. v. Nesbit, 59 Okla. 11, 157 P. 353, and related cases. This motion is not contested.
