Where defendant in error in this court files a confession of error, the court in its discretion may reverse and set aside the judgment of the lower court under such confession of error.

Appeal from District Court, Oklahoma County; William F. Collins, Special Judge.

Action between Joe E. Meyers and Lona Meyers. From the judgment, the former appeals. Reversed and set aside upon confession of error.
