Action by the Campbell-Ratcliff Land Company against Chris Klaus. Judgment for defendant, and plaintiff brings error. Reversed, with instructions.

WILLIAMS, J.

¶1 The facts in this case are the same as in Campbell-Ratcliff Land Company v. Florin Klaus (No. 1,302) infra, this day decided. Under the rule of that case the judgment of the lower court is reversed, and this cause remanded, with instructions to set aside and vacate the order awarding the defendant in error a new trial as a matter of right.
