The Court of Appeals affirmed, holding (1) the evidence presented at trial was sufficient to support Petitioner's conviction of felony animal cruelty; and (2) it was unnecessary to address Petitioner's claim of ineffective assistance since it rested solely on his assertion that the evidence presented against him was insufficient to sustain his felony animal cruelty conviction.
