NO. 26714 IN THE SUPREME COURT OF THE STATE OF HAWAI#I SUSAN FAITH RUBIN, Appellant-Appellant vs. ROGER KUI SIN GOO; CHILD SUPPORT ENFORCEMENT AGENCY, STATE OF HAWAII, Appellees-Appellees APPEAL FROM THE FAMILY COURT OF THE FIFTH CIRCUIT (FC-AP 03-1-0002) ORDER DENYING MOTION FOR RECONSIDERATION (By: Moon, C.J., Levinson, Nakayama, Acoba, and Duffy, JJ.) Upon consideration of the motion for reconsideration of the December 1, 2004 order dismissing appeal, the papers in support and the record, it appears that the motion for reconsideration required by HRS § 571-54 as a prerequisite to appeal applies only to proceedings based on HRS § 571-11(1), (2), (6), or (9), which does not include agency appeals to the family court. See HRS § 571-54. Therefore, IT IS HEREBY ORDERED that the motion for reconsideration is denied. DATED: Honolulu, Hawai#i, December 20, 2004.
