NO. 25259 IN THE SUPREME COURT OF THE STATE OF HAWAI#I _________________________________________________________________ WILLIAM R. HAYES, JR. and IRENE Y. HAYES, Petitioners, vs. THE HONORABLE GARY W.B. CHANG, JUDGE OF THE CIRCUIT COURT OF THE FIRST CIRCUIT; PEREIRA ENTERPRISES, INC., a Hawaii corporation doing business as MERRY MAIDS; JEANNINE HIPPCHEN-PEREIRA; MERRY MAIDS, INC.; JAY S. RODRIGUES, and DOES 1-20, Respondents. _________________________________________________________________ ORIGINAL PROCEEDING (Civ. No. 98-0308-01(GWBC)) (By: ORDER Moon, C.J., Levinson, Nakayama, Ramil, and Acoba, JJ.) Upon consideration of the petition for a writ of mandate filed by Petitioners William R. Hayes, Jr. and Irene Y. Hayes and the papers in support, it appears that: (1) Petitioners ask this court to review a ruling issued by the respondent judge in Hayes v. Pereira Enterprises, Inc., Civil No. 98-0308, presently pending in the Circuit Court of the First Circuit; and (2) Petitioners fail to demonstrate that they are entitled to a writ of mandamus. See Straub Clinic & Hospital v. Kochi, 81 Hawai#i 102, 952 P.2d 390 (1996). Therefore, IT IS HEREBY ORDERED that the petition for a writ of mandate is denied without prejudice to any remedy Petitioners may have by way of appeal. DATED: Honolulu, Hawai#i, September 5, 2002.
