NO. 24224 IN THE SUPREME COURT OF THE STATE OF HAWAI#I IN THE MATTER OF THE PROTECTION OF THE PROPERTY OF JANE DOE The Protected Person APPEAL FROM THE THIRD CIRCUIT COURT (G. NO. 99-003K) ORDER DISMISSING APPEAL (By: Moon, C.J., Levinson, Nakayama, Ramil, and Acoba, JJ.) Upon review of the record, it appears that: (1) Guardianship No. 99-003K has not been finally concluded and a final judgment closing the proceeding has not been entered; (2) the May 3, 2001 order approving the sale of real property, the Honorable Greg K. Nakamura, presiding, is an interlocutory order that was not certified for interlocutory appeal pursuant to HRS § 641-1(b); Hawai#i Probate Rule 34(d); and thus, (3) this appeal is premature and we lack jurisdiction. HRS § 641-1(a). Therefore, IT IS HEREBY ORDERED that this appeal is dismissed for lack of appellate jurisdiction. DATED: Honolulu, Hawai#i, July 19, 2001.
