Upon consideration of the notice of certiorari filed by Petitioner/Defendant-Appellant Paul Kenneth Grubb on January 23, 2001 seeking review of the Intermediate Court of Appeals memorandum opinion filed on November 9, 2000, it appears that: (1) the Intermediate Court of Appeals issued its memorandum opinion on November 9, 2000; (2) on December 18, 2000, petitioner/defendant-appellant filed a notice of certiorari, which this court deemed as an application for certiorari; (3) on January 9, 2001, this court issued an order denying the application for writ of certiorari; and (4) pursuant to Hawai#i Rules of Appellate Procedure Rule 40(e) a party may file only one application for writ of certiorari. Therefore, IT IS HEREBY ORDERED that the notice of certiorari, which this court will deem as an application for writ of certiorari, is denied. DATED: Honolulu, Hawai#i, January 31, 2001.
