Advisory Opinion to Attorney General Re Prohibits Possession of Defined Assault WeaponsAnnotate this Case
In this matter where the Attorney General requested the Supreme Court's opinion as to the validity of a citizen initiative petition circulated pursuant to Fla. Const. Art. XI, 3, the Supreme Court held that the proposed initiative, entitled "Prohibits possession of defined assault weapons," should not be placed on the ballot.
While the parties raised several issues for the Supreme Court's consideration, the Court addressed only the dispositive issue of whether the ballot summary affirmatively misleads voters regarding the exemption addressed in the next to last sentence of the ballot summary. The Supreme Court concluded that the Initiative could not be placed on the ballot because the ballot summary was affirmatively misleading and did not comply with Fla. Stat. 101.161(1).
