Cite as 2018 Ark. App. 318 ARKANSAS COURT OF APPEALS DIVISION No. CV-17-844 OPINION DELIVERED: MAY 16, 2018 JASON REYNOLDS V. APPELLANT APPEAL FROM THE GARLAND COUNTY CIRCUIT COURT [NO. 26DR-08-927] HONORABLE JOHN HOMER WRIGHT, JUDGE STACY REYNOLDS (NOW THOMAS) APPELLEE REMANDED TO SETTLE RECORD PER CURIAM Appellant Jason Reynolds filed a motion for extension of time to tender a supplemental record. On January 26, 2018, appellant filed a motion to supplement the record. Paragraph 3 of that motion asks that the record to be supplemented with “a Motion to Amend, Response to Amend, Amended Order After Hearing, and all supporting documents … upon which the court relied.” On February 14, 2018, we granted the motion to supplement and issued a writ returnable in thirty days. In the present motion, appellant asserts that “the circuit court has prepared only the file marked documents. Some of which were not requested by the appellant, and has not included the supporting documents, including correspondence and calendars as requested.” We surmise from the language of the second motion that perhaps some of the supporting documents may not have been filed or introduced as exhibits. Arkansas Supreme Court Rule 3-3 sets out the contents of the record in civil cases. Because we are uncertain whether these “supporting documents” were actually made a part of the record below, we are compelled to remand this case to the circuit court to settle the record. We direct that the record be settled within thirty days, after which our clerk will set the briefing schedule. 2
