REMANDED
Appellant, Rosemarie Clampitt, has filed an application for leave to file bond, motion
for stay pending appeal, and for supersedeas. Attached to her motion is a cashier’s check for
$250, payable to “clerk of the court,” along with her request that the check be accepted by
this court as bond for a stay of the decree entered in this case on April 16, 2007. Appellees
have responded, contending that $250 is not sufficient. The April 16, 2007 decree is not a
money judgment. Consequently, the appropriate amount of a supersedeas bond is not clear
from the record before us. Therefore, we remand this matter to the trial court for the limited
purposes of (1) gathering facts to determine the appropriateness of issuing a supersedeas, and
(2) if appropriate, deciding in what amount the supersedeas bond should be set. We direct the
trial court to file an order containing such findings with the clerk of this court within thirty
(30) days.
