SUPREME COURT OF ALABAMA OCTOBER TERM, 2015-2016 ____________________ 1150417 ____________________ Ex parte M.G.D. PETITION FOR WRIT OF CERTIORARI TO THE COURT OF CIVIL APPEALS (In re: M.G.D. v. C.B. and J.L.B.) (Shelby Juvenile Court, JU-13-729.01, JU-13-730.01, and JU-13-731.01; Court of Civil Appeals, 2140286) BRYAN, Justice. 1150417 WRIT DENIED. NO OPINION. Moore, C.J., and Stuart, Bolin, Parker, Shaw, Main, and Wise, JJ., concur, Murdock, J., dissents. 2 1150417 MURDOCK, Justice (dissenting). M.G.D., the mother, apparently did not preserve for appeal in this case the issue of the constitutionality of ยง 30-3-4.1, statute. Ala. Code 1975, the grandparent-visitation Nonetheless, I dissent from this Court's order denying certiorari review because, once the juvenile court determined that the child was not dependent, that court lacked jurisdiction to enter any order relating to custody or visitation, a fact well explained by Presiding Judge Thompson in his dissent from the Court of Civil Appeals' opinion in this case. See M.G.D. v. C.B., [Ms. 2140286, January 8, 2016] ___ So. 3d ___, ___ (Ala. Civ. App. 2016) (Thompson, P.J., dissenting). 3
