AN ACT

 

Amending Title 3 (Agriculture) of the Pennsylvania Consolidated Statutes, in soil and plant amendment, further providing for registration, for inspection fees, for tonnage reports and for disposition of funds.

 

The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:

 

Section 1.  Section 6904(c) of Title 3 of the Pennsylvania Consolidated Statutes is amended to read:

§ 6904.  Registration.

(c)  Exemption.--

(1)  A distributor shall not be required to register a brand of soil amendment or plant amendment which is already registered under this chapter by another person, providing the label does not differ in any material respect.

(2)  A person shall not be required to pay the registration fee under this section if the product contains a fertilizer and is actively registered under section 6803 (relating to registration of specialty fertilizers).

Section 2.  Section 6906(a)(2) and (3) of Title 3 are amended and the section is amended by adding a subsection to read:

§ 6906.  Inspection fees.

(a)  Amounts.--

[(2)  On packages of 15 pounds or less, there shall be paid in lieu of the inspection fee of 15¢ per ton provided for in paragraph (1), annually and not later than January 31 of each year, an inspection fee of $25 for each brand and grade of soil amendment or plant amendment distributed.

(3)  If the guarantor whose name appears on the label distributes soil amendments or plant amendments in this Commonwealth in both packages of less and more than 15 pounds, the $25 inspection fee shall be paid for its brands sold in packages of 15 pounds or less, and the 15¢ per ton fee shall be paid for its packages of more than 15 pounds.]

(c)  Exemption.--The guarantor shall not be required to pay an inspection fee under this section for a product that was subject to an inspection fee under section 6806 (relating to inspection fees).

Section 3.  Section 6907 of Title 3 is amended by adding a subsection to read:

§ 6907.  Tonnage reports.

(f)  Exemption.--The guarantor shall not be required to report tonnage under this section for a product that was reported under section 6807 (relating to tonnage reports).

Section 4.  Section 6921 of Title 3, amended July 11, 2022 (P.L.1538, No.83), is amended to read:

§ 6921.  Disposition of funds.

Moneys received from license fees, registration fees, inspection fees, fines and penalties shall be paid into the Agronomic Regulatory Account established in section 6831 (relating to disposition of funds). All moneys in the Agronomic Regulatory Account are hereby appropriated to the department for the purposes of this chapter, Chapter 68 (relating to fertilizer) [and], Chapter 71 (relating to seed) and the promotion of soil health improvement practices generally.

Section 5.  This act shall take effect immediately.
