In 2006, Mlsna was hired by Union Pacific, as a conductor. Union Pacific was aware of Mlsna’s hearing impairment. Union Pacific rejected his proposal because that device did not have a factory‐issued or laboratory‐tested noise reduction rating, as required by the regulation. Mlsna’s employment was terminated.
