63.2-1516. Tape recording child abuse investigations.

Any person who is suspected of abuse or neglect of a child and who is thesubject of an investigation or family assessment pursuant to this chapter maytape record any communications between him and child-protective servicespersonnel that take place during the course of such investigation or familyassessment, provided all parties to the conversation are aware theconversation is to be recorded. The parties' knowledge of the recording shallbe demonstrated by a declaration at the beginning of the recorded portion ofthe conversation that the recording is to be made. If a person who issuspected of abuse or neglect of a child and who is the subject of aninvestigation or family assessment pursuant to this chapter elects to make atape recording as provided in this section, the child-protective servicespersonnel may also make such a recording.
