55-464. Upkeep of cooperative.

A. Except to the extent otherwise provided by the declaration, by subsectionB hereof, or by subsection G of 55-470, the association is responsible formaintenance, repair and replacement of the common elements, and eachproprietary lessee is responsible for maintenance, repair and replacement ofhis unit. Each proprietary lessee shall afford to the association and theother proprietary lessees and to their agents or employees, access throughhis unit reasonably necessary for those purposes. If damage is inflicted onthe common elements or on any unit through which access is taken, theproprietary lessee responsible for the damage or the association if it isresponsible, is liable for the prompt repair and all costs associated withthe repair thereof.

B. In addition to the liability that a declarant as a proprietary lessee hasunder this chapter, the declarant alone is liable for all expenses inconnection with real estate subject to development rights. No otherproprietary lessee and no other portion of the cooperative is subject to aclaim for payment of those expenses. Unless the declaration providesotherwise, any income or proceeds from real estate subject to developmentrights inures to the declarant.
