55-445. Limited common elements.

A. Except for the limited common elements described in paragraphs 2 and 4 of 55-439, the declaration shall specify to which unit or units each limitedcommon element is allocated. That allocation may not be altered without theconsent of the proprietary lessees whose units are affected.

B. Except as the declaration otherwise provides, a limited common element maybe reallocated by an amendment to the declaration executed by the proprietarylessees between or among whose units the reallocation is made. The personsexecuting the amendment shall provide a copy thereof to the association,which shall record it. The amendment shall be recorded in the names of theparties and the cooperative.

C. A common element not previously allocated as a limited common element maynot be so allocated except pursuant to provisions in the declaration made inaccordance with subdivision A 7 of 55-442. The allocations shall be made byamendments to the declaration.
