46.2-341.20:2. Employer penalty; railroad/highway grade crossingviolations; out-of-service order violation.
Any employer who knowingly allows, permits, authorizes, or requires anemployee to operate a commercial motor vehicle in violation of any law orregulation pertaining to railroad/highway grade crossings, or in violation ofan out-of-service order, shall be subject to a civil penalty of not more than$15,000 for each violation, which shall be imposed by the Commissioner uponreceipt of notification from federal or state motor carrier officials that anemployer may have violated this provision, and upon notice to the employer ofthe charge and a hearing conducted as provided under the AdministrativeProcess Act ( 2.2-4000 et seq.), to determine whether such employer hasviolated this provision. Civil penalties collected under this section shallbe deposited into the Transportation Trust Fund.
