38.2-3110. Incontestability not applicable to excluded or restrictedcoverage.

Any life insurance policy provision stating that the policy shall beincontestable after a specified period shall preclude only a contest of thevalidity of the policy, and shall not preclude the assertion at any time ofdefenses based upon provisions in the policy that exclude or restrictcoverages, whether or not those restrictions or exclusions are excepted inthe incontestability provision.
