38.2-3109. Contestability of reinstated policy.

Reinstatement of a life insurance policy shall not affect the running of thecontestable period except as provided in this section. A life insurancepolicy reinstated after July 1, 1986, regardless of whether the originalpolicy was issued before or after July 1, 1986, shall be contestable onaccount of fraud or misrepresentation of any material fact pertaining to thereinstatement contained in a written application for reinstatement, or in anywritten statement supplemental to the application for reinstatement, only forthe same period after reinstatement as the policy provides for contestabilityafter original issue.
