37.2-1026. Fiduciary to prosecute and defend.

All actions or suits to which the incapacitated person is a party at the timeof qualification of the fiduciary and all such actions or suits subsequentlyinstituted shall, subject to any conditions or limitations set forth in theorder appointing him, be prosecuted or defended, as the case may be, by thefiduciary, after 10 days' notice of the pendency thereof, which notice shallbe given by the clerk of the court in which the same are pending.
