33.1-201. Improving certain private roads and certain town streets androads.

The Commonwealth Transportation Commissioner may, in his discretion, upon therequest of the board of supervisors or other governing body of any county andat the expense of the owner of the land, improve private roads giving directaccess from the home or other central buildings on the property along theshortest practical route to the nearest public highway; provided, however,that:

(1) The Commissioner shall in no case undertake any such work untilcertification is made by the board of supervisors or other governing bodythat the property owner cannot secure the services of a private contractor toperform the work nor then until the owner has deposited with him a certifiedcheck in the amount estimated by the Commissioner as the cost of the work;

(2) Not more than $1,000 shall be expended on any one such private project inany one year;

(3) No work of ordinary maintenance shall be done on any such private roadunder the provisions of this section.

And the Commissioner may, upon the request of the council of any town havinga population of less than 1,500 and at the expense of such town, improve andmaintain any streets or roads therein not in the State Highway System. As tostreets and roads in such town, no certification by the board of supervisorsor deposit shall be necessary.

Any work done by the Commissioner pursuant to the provisions of this sectionshall only be done with the equipment and employees of the CommonwealthTransportation Board.
