33.1-171. Acquisition of lands for such relocation.

Upon the approval of such plans and specifications by the Commissioner, thecity or town shall solely at its own expense acquire, in the name of theCommonwealth of Virginia, either by purchase or condemnation, theright-of-way necessary to construct the highway on the new location as shownby the plans approved by the Commissioner and, in the event of condemnation,the proceedings shall be instituted in the name of the city or town and shallin all respects conform to the proceedings which would be applicable if theyhad been instituted by the Commonwealth Transportation Commissioner, but thetitle to the lands acquired in the proceedings shall, when the award of thecommissioners has been paid, vest in the Commonwealth of Virginia in the samemanner as if the Commissioner had instituted and conducted the proceedingsand had paid the amount of the award.
