33.1-11. Defense of employees.

If any person employed by the Commonwealth Transportation Board shall bearrested or indicted or otherwise prosecuted on any charge arising out of anyact committed in the discharge of his official duties, CommonwealthTransportation Commissioner may employ special counsel approved by theAttorney General to defend such employee. The compensation for specialcounsel employed, pursuant to this section, shall, subject to the approval ofthe Attorney General, be paid out of the funds appropriated for theadministration of the Commonwealth Transportation Board.
