29.1-738.01. Operating boat in an improper manner; penalty.

Notwithstanding the provisions of 29.1-738, upon the trial of any personcharged with reckless boating where the degree of culpability is slight, thecourt in its discretion may find the accused not guilty of reckless boatingbut guilty of improper boating. Improper boating shall be punishable as aClass 3 misdemeanor.
