19.2-39. Bond.

Every magistrate appointed under the provisions of this chapter shall enterinto bond in the sum of $5,000, made payable to the Commonwealth, before theclerk of the circuit court which exercises jurisdiction over the politicalsubdivision wherein such magistrate shall serve, for the faithful performanceof his duties. The premium for such bond shall be paid by the Commonwealth.Provided, however, that in lieu of specific bonds, the Committee on DistrictCourts may in its discretion procure faithful performance of duty blanketbonds for any or all of the districts enumerated in 16.1-69.6 covering allmagistrates included in such districts and for the penalty contained in thissection, unless in the discretion of the Committee, bonds with a largerpenalty should be obtained. Such blanket bonds shall be made payable to theCommonwealth and shall cover all funds handled by a magistrate whether suchfunds belong to the Commonwealth or any political subdivision thereof.Provided further, that in those instances where specific bonds formagistrates are in effect, the Committee on District Courts may, whenever itdeems it advisable, terminate such specific bonds upon obtaining a blanketbond covering such magistrates with appropriate refunds or credit being madefor the unearned premiums on the specific bonds terminated. A copy of anysuch blanket bond so procured shall be filed with the State Comptroller andwith the clerk of the respective circuit court which exercises jurisdictionover the district wherein such magistrate shall serve. The premiums for suchblanket bonds shall be paid by the Commonwealth.
