19.2-264.3:2. Notice to the defendant of intention to present evidence ofunadjudicated criminal conduct.

Upon motion of the defendant, in any case in which the offense for which thedefendant is to be tried may be punishable by death, if the attorney for theCommonwealth intends to introduce during a sentencing proceeding heldpursuant to 19.2-264.4 evidence of defendant's unadjudicated criminalconduct, the attorney for the Commonwealth shall give notice in writing tothe attorney for the defendant of such intention. The notice shall include adescription of the alleged unadjudicated criminal conduct and, to the extentsuch information is available, the time and place such conduct will bealleged to have occurred.

The court shall specify the time by which such notice shall be given.
